IN THE COURT OF COMMON FLEAS OF CUMBERLAND COUNTY, PENNSYLVANIA NO. 09-1901 CIVIL ACTION TO QUIET TITLE UNKNOWN HEIRS, Successors, Assigns, And All Persons, Firms, or Associations Claiming Right, Title or Interest, From or Under MATHIAS SAILOR, Defendants COMPLAINT AND NOW, comes the Plaintiffs, CHARLES E. AVIS and CHERIE L. AVIS, husband and wife, along with Plaintiff, DEBORAH A. PRINZ, sister of CHARLES E. AVIS, and together they file this Action to Quiet Title to a certain tract of land, situate in Silver Spring Township, Cumberland County, Pennsylvania, and in support thereof respectfully ;,represent: BACKGROUND 1. The last owner of record of the land which is the subject matter of this action was Mathias Sailor pursuant to a deed dated February 10, 1806. A copy of this deed is attached hereto as Exhibit "A". 2. It is believed and therefore averred that John Sailor was the son of Mathias Sailor. There is no record of a conveyance of this land to John Sailor, but the Last Will and Testament of John Sailor dated May 8, 1828, devises the land dj scribed in Exhibit "A" to his three (3) grandsons, namely John Sailor, George (Sailor, and Mathias Sailor. A copy of that Last Will and Testament is attached (hereto as Exhibit "B". III 3. There is no survey of record establishing a subdivision of this 22 acres 7 perches tract of land between the grandsons, but there is a deed dated January 5, 1848, from George Sailor and Elizabeth, his wife, to William C. Houser, of George Sailor's undivided one-third (1/3) interest in this land. This deed 49es not contain a metes and bounds description of the land. A copy of this deed isl attached hereto as Exhibit "C". 4. A subsequent deed dated April 1, 1850, from Assignees of Williams ,C. Houser to Mary Smith did contain a metes and bounds description of George&ilor's undivided one-third (1/3) interest and further stated, "John, George and Mathias Sailor who divided the same among themselves agreeably to said will and the above described tract fell to the share or lot of George Sailor ..." F copy of this deed is attached hereto as Exhibit "D". 5. Title of George Sailor's undivided one-third (1/3) interest can be treed from William C. Houser to Ernest Avis and Phyllis Avis, the parents of the Plaintiffs herein, who took title to this tract by deed dated January 31, 1973. 6. The undivided one-third (1/3) interest of John Sailor was deeded to John Bobb on April 1, 1847, without a metes and bounds description. A copy of that deed is attached hereto as Exhibit "E". 7. From April 1, 1847, through March 28, 1892, no record transfers of the John Sailor tract could be found, but the records do show that on March, 1892, the John Sailor tract was conveyed by deed from the Executor of Geor?d Houck, deceased, to James Bell, and this deed included a metes and bounds, description of III John Sailor's undivided one-third (1/3) interest in the land. A copy of this deed is attached hereto as Exhibit "F" 8. From James Bell to the present, title can be traced to Ernest Avis and Phyllis Avis, the parents of the Plaintiffs herein, who took title to this tract by deed dated January 31, 1973. 9. Since July 27, 1942, both the George Sailor tract and the John Sailer tract have been transferred/conveyed together on the same deed. 10. What gives rise to this action to quiet title is the lack of any recordxelating to the interest of the third grandson of John Sailor, namely Mathias Sailor: 11. In 1849, Mathias Sailor died intestate at the age of twenty-three (23) years. He was not married and he had no children. Records maintained by the' Cumberland County Historical Society seem to establish his date of death as February 21, 1849. A copy of this historical record is attached hereto as Exhibit "G". 12. A review of the inventory of the estate of Mathias Sailor, then deceased, was filed by George Sailor, but the inventory made no reference to Mathias Sailor's undivided one-third (1/3) interest in the land devised to him by his grandfather, John Sailor. A copy of the inventory is attached hereto as Exhibit "H". 13. There is no deed of record from Mathias Sailor to any grantee of his undivided one-third (1/3) interest in the land. 14. According to April 8, 1833, Pamph. L. page 315, the interest of Mathias Sailor in real property, upon his death without a will, would have passed to a0d vested in his brothers and sister. A copy of the April 8, 1833, Pamph. L. page':315 is attached hereto as Exhibit "I". 11% 15. There is no record that any of Mathias Sailor's siblings ever took title to the one- third (1/3) interest in the land belonging to Mathias Sailor, nor is there any record that this one-third (1/3) tract has ever been transferred to another party. 16. Prior to April 24, 1981, there are no known surveys which included descriptions of any of the three (3) tracts which had at one time been owned by John Sailor, George Sailor, and Mathias Sailor. 17. It is believed and therefore averred that since August 12, 1946, each successive owner to the combined George Sailor and John Sailor tracts believed that their deed included the Mathias Sailor tract, although the existence of this separate tract would have been unknown to each owner. 18. The first known survey and site plan is dated April 24, 1981, and was prepared by Eugene Albert Hockensmith, Registered Surveyor, at the behest of 'Ernest Avis and Phyllis Avis, husband and wife, who intended to subdivide them' land and gift a part to CHARLES E. AVIS and CHERIE L. AVIS, his wife, and a second part to DEBORAH A. PRINZ, their daughter. (A copy of the Final Plan.dated April 24, 1981, is attached hereto as Exhibit "J".) 19. This survey makes reference to an area of land just east of the Avis property which the surveyor indicated as "unknown owner". 20. Prior to this survey, Ernest and Phyllis Avis believed they owned the portion of land which the surveyor identified as "unknown owner". This belief was based upon an oral description of the land as given to them by Albert H. Jacobs, who conveyed this land to them. (A copy of the deed held by Ernest and Phyllis Avis is attached hereto as Exhibit "K".) 1 21. In reliance upon the Hockensmith survey, Ernest Avis and Phyllis Avis subdivided their land and gifted Tract 1, containing 4.861 acres to their daughter, DEBORAH A. PRINZ, and gifted Tract 2, containing 12.134 acres; to CHARLES E. AVIS and CHERIE L. AVIS, his wife. 22. The deed conveying title to CHARLES E. AVIS and CHERIE L. AjVIS is dated May 13, 1981. (A copy of the deed is attached hereto as Exhibit "L".) 23. The deed conveying title to DEBORAH A. PRINZ is dated March, 21, 1995. (A copy of the deed is attached hereto as Exhibit "M".) 24. In reliance upon their deed and the Hockensmith survey, CHARLES E. AVIS and CHERIE L. AVIS built a house, swimming pool, and greenhouse on the western portion of their 12.134 acre tract. 25. In an effort to determine the owner of the land adjacent to the eastdtn boundary of the Avis property as shown on the Hockensmith survey, Plaintiffs engaged the service of C. W. Junkins Associates, Inc., a registered surveyor. 26. C. W. Junkins Associates, Inc., determined that the tract of land with no current owner of record was, in fact, the western most tract of land where Plaintiffs, CHARLES E. AVIS and CHERIE L. AVIS, had built their house, swimming pool, and greenhouse. A copy of the survey of C. W. Junkins Associates, Inc., is attached hereto as Exhibit "N". 27. Tracts 3A and 3B on the Junkins' survey represent the land where no record owner has been found. 28. It is believed and therefore averred that Tracts 3A and 3B on the RAWns' survey represent land which was a portion of the land conveyed to Mathias ,,Sailor, the last owner of record, by John Blosser in the deed dated February 10, 1806, which is attached hereto as Exhibit "A. 29. It is further believed and therefore averred that Tracts 3A and 3B ropresent the land that was devised to Mathias Sailor, the grandson of John Sailor, in John Sailor's will dated May 8, 1828. (See Exhibit "B") 30. CHARLES E. AVIS and CHERIE L. AVIS, in reliance upon the Hbckensmith survey, built their house, swimming pool, and greenhouse on the land described as Tract 3A on the Junkins' survey. 31. Plaintiff, DEBORAH A. PRINZ, and her parents, Ernest Avis and I?hyllis Avis, have exercised exclusive control over the land described as Tract 3B on the Junkins' survey since January 31, 1973. COUNT I - ACTION TO QUIET TITLE CHARLES E. AVIS AND CHERIE L. AVIS V. HEIRS OF MATHIAS SAILOR 32. Paragraphs 1 through 31 are incorporated herein as if set forth at lelrigth. 33. Plaintiffs, CHARLES E. AVIS and CHERIE L. AVIS, are husband and wife and reside at 458 Sample Bridge Road, Enola, Silver Spring Township, Cumberland County, Pennsylvania 17025. 34. Defendants are the HEIRS OF MATHIAS SAILOR, who died inte$?ate, a single man with no known children, while a resident of Cumberland Coun% Pennsylvania, in 1849. 35. Despite diligent efforts on the part of Plaintiffs, no heirs of Mathias Sailor have been identified and, if there are heirs of Mathias Sailor, deceased, their whereabouts are unknown. 36. By will of John Sailor, deceased, dated May 8, 1828, Mathis Sailor'was to become the owner of an undivided one-third (1/3) interest in a parcel of land containing 22 acres 7 perches located in Silver Spring Township, Cumberland County, Pennsylvania. 37. There is no record of a transfer of Mathias Sailor's undivided one-third (1/3) interest in the above-described land during his lifetime, nor is there ;any record that such a transfer was made by his estate or next of kin. 38. There has been no record owner of this undivided one-third (1/3) interest in the above-described land since 1806. 39. A metes and bounds description of this land which is now subject to Plaintiffs' claim of adverse possession is as follows: BEGINNING in the centerline of Sample Bridge Road at the southeast corner of land now or formerly owned by Joshua L. Shindel, thence North 2 degrees 30 minutes 00 seconds West a distance of 1260.73 feet to an iron pipe; thence South 80 degrees 13 minutes 29 seconds East a distance of 147.02 feet to a point; thence South 2 degrees 50 minutes 17 seconds East, along lands currently owned by Charles E. Avis and Cherie L. Avis, a distance of 1250.09 feet to a nail set in the centerline of Sample Bridge Road; thence North 84 degrees 44 minutes 05 seconds West along the centerline of Sample Bridge Road a distance of 152.44 feet to the point and place of BEGINNING. Containing 4.244 acres. I 1 40. Plaintiffs have been in actual possession of the property described in the preceding paragraph since May 13, 1981, having built their residence and other structures thereon. 41. By their manner of possession of these premises, Plaintiffs have a!0,erted their ownership rights to the premises to the exclusion of all others. 42. Since 1981, Plaintiffs have had actual, continuous, exclusive, visiblie, notorious, distinct, and hostile possession of the land. A time period that exccj ds twenty- one (21) years. WHEREFORE, Plaintiffs, CHARLES E. AVIS and CHERIE L. AVIS, pray that this Honorable Court will enter judgment in their favor and order that: (a) title in fee simple to the 4.244 acres described herein be confirmed In the names of CHARLES E. AVIS and CHERIE L. AVIS, husband and wife, Tenants by the entireties; (b) that a deed be prepared naming the Recorder of Deeds in and for Cumberland County, Pennsylvania, as Grantor and CHARLES E. AVIS and CHERIE L. AVIS as Grantees; and (c) the Recorder of Deeds be directed to execute and record this deed upon payment of the recording fees by Plaintiffs. COUNT II - DEBORAH A. PRINZ V. HEIRS OF MATHIAS SAILOR 43. Paragraphs 1 through 42 are incorporated herein as if set forth at lepgth. 44. Plaintiff DEBORAH A. PRINZ is an adult individual, the sister of Plaintiff CHARLES E. AVIS, and she resides at 456 Sample Bridge Road, Enola, Silver Spring Township, Cumberland County, Pennsylvania. 45. DEBORAH .A. PRINZ became the owner in fee simple of her tract by deed dated March 21, 1995. 46. A metes and bounds description of the land subject to this Plaintiff's claim of adverse possession is as follows: BEGINNING in the centerline of Sample Bridge Road at the southeast corner of land now or formerly owned by Joshua L. Shindel; thence South 84 degrees 44 minutes 05 seconds East, a distance of 152.44 feet to a nail in the centerline of Sample Bridge' Road; thence South 2 degrees 50 minutes 17 seconds East, a distance of 565.72 feet to a point; thence South 77 degrees 18 minutes 00 seconds West, a distance of 156.86 feet to an iron pipe;; thence North 02 degrees 30 minutes 00 seconds West, a distance of 614.08 feet to a point in the centerline of Sample Bridge Road, the place of BEGINNING. Containing 2.068 acres. 47. Plaintiff has exercised actual, continuous, exclusive, visible, notorious, distinct and hostile possession of this land since March 21, 1995. 48. Plaintiffs parents, Ernest and Phyllis Avis, exercised actual, contiguous, exclusive, visible, notorious, distinct and hostile possession of this 9?me land from January 31, 1973, until March 31, 1995, the date they transferred possession of this land to Plaintiff. 49. By their manner of possession of this land, Plaintiff and her parents)) before her have asserted continuous ownership of this land to the exclusion of '?11 others since January 31, 1973. A time period that exceeds twenty-one (21) years. WHEREFORE, Plaintiff, DEBORAH A. PRINZ, prays that this Honorable Court will enter judgment in her favor and order that: (a) title in fee simple to the 2.068 acres described herein be confirmed in the name of DEBORAH A. PRINZ, and unmarried woman; (b) that a deed be prepared naming the Recorder of Deeds in and for Cumberland County, Pennsylvania, as Grantor and DEBORAH A. On even date with the filing of this Motion, the Plaintiffs have filed an Action to Quiet Title to certain real property located within Silver Spring Township, Cumbd?land County, Pennsylvania. The last record title holder of the real property in question was Matthias Sailor, who acquired a deed to this property dated February 10, 1806. 3. The last reference of record to this real property is contained within! the probated will of John Sailor dated May 28, 1828, wherein John Sailor devises this propertyy,in substantially equal shares, to John Sailor's grandchildren, namely John Sailor, Gel rge Sailor, and Mathias Sailor. 4. There is no record of the property being subdivided among these three grandsons of John Sailor. 5. The grandson, Mathias Sailor, died intestate on or about February 21, 1849, a single man with no issue. 6. Since 1849, the portion of this land that was devised to John Sailor) and George Sailor can be traced to the current owners, the Plaintiffs herein. 7. There is no record concerning that portion of the land that was devised to Mathias Sailor, who was twenty-three (23) years of age when he died on February 21, 1849. 8. An inventory filed in the administration of the estate of Mathias Sailor in the Cumberland County Office of the Register of Wills, makes no reference to this real property. 9. The land in question has been continuously under the control of those persons whose chain of title can be traced back to John Sailor and George Sailor since at least July 27, 1942. 10. Although this land has been under the exclusive control of those poisons since July 27, 1942, the deed descriptions for each of these owners has been limited to only a description of the combined tracts of John Sailor and George Sailor. 11. Plaintiffs, through their counsel, have made a diligent effort to locale the heirs of John Sailor, George Sailor, and Mathias Sailor, but have not been successful in these efforts. 12. The efforts to locate the heirs include the following: a. A search has been made through the telephone directory to,lpcate any heirs of John Sailor, George Sailor, and Mathias Sailor. Letters have been sent toi all persons listed in the Verizon and Embarq telephone books whose last name is spelled Sai1',er, Saylor, Seylar, Sayler, and Seler. A copy of the letter sent to each of these persons, dated March 8, 2010, is attached hereto as Exhibit "A". To date, only one (1) letter was returned by the postal authorities, and no response has been received from any of the addressees; b. Everyone in the local telephone book with the last named of"Sailor" was called, but no heirs of Mathias Sailor, John Sailor, or George Sailor were found; C. The name of George Sailor, his wife, and four (4) children here identified in the Census of 1860 as living in Cumberland County, Pennsylvania, but the Census of 1870, revealed that only the youngest of the four (4) children, namely Adam Sailor, stillliesided in Cumberland County, Pennsylvania, in 1870, and he, at age 10, resided with a family whose last name appears to be "Line" in the Census records; d. A review of the Census records available after 1870 did not 4isclose that Adam Sailor, or any other individuals with the last name of Sailor, continued to ride in this area; and e. The search for heirs led counsel to a website known as the "Saylor DNA Project" which was a private website searching for certain family members with th? last name of "Saylor, Sailor, Seiler, and Seyler." Contact was made with the website by email and counsel was advised that John Sailor, George Sailor, and Mathias Sailor were not connected to the "Saylor DNA Project"; 13. Based upon counsel's investigation to locate the heirs of John Sailbfr, George Sailor, and Mathias Sailor, counsel has not been able to identify any heirs, and is *able to perform service of the action to quiet title on any known individuals. Histgpcally, official records which were maintained under a person's last name did not always have tl}o last name spelled correctly. It was not uncommon for the record keeper to spell a person's list name phonetically, which could result in that person's official records being maintained under an incorrectly spelled last name. I am searching for the heirs of Mathias Sailor who !died in Cumberland County, Pennsylvania, in 1849. The records which I have found show that Mathias Sailor was born in 18?? and died in 1849. These records show that when he died, he was not married and had no children. However, Mathias Sailor was survived by two (2) brothers, namely John Sailor and George', ?ailor, each of whom also resided in Cumberland County, Pennsylvania. Some members of the I,?ailor family were buried in the Trindle Springs Cemetery in Mechanicsburg, Pennsylvania. 40ough Mathias Sailor had no children, you may be an heir of Mathias Sailor if you are aI descendant of either John Sailor or George Sailor, his brothers, each of whom would have died sometime after 1849.
