PETITION TO CORRECT NAME OF CORPORATE DEFENDANT
Pursuant to Local Rule 208.3(a), Defendant Foremost, by its attorneys, Brigid Q. Alford,
Esquire and Marshall, Dennehey, Warner, Coleman & Goggin, respectfully petitions the Court to
allow and order the correction of the caption in this case, in order to reflect the correct name of
the corporate defendant, from FOREMOST INSURANCE GROUP to FOREMOST
INSURANCE COMPANY GRAND RAPIDS MICHIGAN, and in support thereof states as
follows:
1. Plaintiffs have initiated the above-captioned action, and have named as one of the
defendants an entity they have designated as FOREMOST INSURANCE GROUP.
2. The correct corporate name for this entity is FOREMOST INSURANCE
COMPANY GRAND RAPIDS MICHIGAN ("Foremost")
3. Defendant Foremost desires to have the caption changed in order that the correct
corporate name is being utilized throughout the pendency of the case and on the docket and any
and all pleadings and orders filed herein.
4. Through its counsel, by letter dated January 10, 2011, Defendant Foremost
solicited the concurrence of counsel for Plaintiffs, counsel for Defendants Wells and Deitch, and
the Wonders Defendants (pro se), in order to effect the correction of the caption via Stipulation,
but has had no response to her request.
5. A judge has not ruled upon any other issue in this case.
WHEREFORE, Defendant Foremost respectfully petitions the Court to allow the
correction and to order that the docket be changed to reflect the correction.

COMPLAINT
AND NOW, this day of April, 2011, comes the Plaintiffs, Michael Frey and
Laurie Frey, husband and wife, through and by their attorney, Steven D. Stambaugh,
Esquire, and Stambaugh Law, P.C., and files this Complaint, whereof the following is a
statement:
1.
The Plaintiffs, Michael Frey and Laurie Fey, husband and wife, (hereinafter
individually referred to as "Plaintiff' and/or collectively referred to as "Plaintiffs") are
adult citizens of the Commonwealth of Pennsylvania currently residing at 20 Swartz Road,
Newburg, PA 17240.
2.
The Defendant, Katheryne Wells (hereinafter "Defendant Wells"), is an adult
citizen of the Commonwealth of Pennsylvania currently residing at 110 Old Saw Mill
Road, Newberg, Pennsylvania 17240.
3.
The Defendant, Richard S. Deitch (hereinafter "Defendant Deitch"), is an adult
citizen of the Commonwealth of Pennsylvania currently residing at 2212 Newville Road,
Carlisle, PA 17015.

The Defendants, Liliane E. Wonders and Bradley A. Wonders (hereinafter
STAMBAUGH LAW, P.C.

collectively referred to as "Defendants Wonders"), are adult citizens of the Commonwealth
of Pennsylvania currently residing at 422 Steelstown Road, Newville, PA 17241.

The Defendant, Foremost Insurance Group (hereinafter "Defendant Foremost"), is
a corporation authorized to do business in the Commonwealth of Pennsylvania with a
current business address at 5600 Beech Tree Lane, Caledonia, MI 49316.

The facts and occurrences hereinafter related took place on or about September 15,
2008, at approximately 6:40 a.m., on Steelstown Road, near 422 Steelstown Road, North
Newton Township, Cumberland County, Pennsylvania.
7.
At all times relevant hereto, Plaintiff Michael Frey was the owner and operator of a
1982 Yamaha XV920J motorcycle bearing Pennsylvania registration number SLK97
traveling east on Steelstown Road.
8.
At all times relevant hereto, Defendant Wells was the operator of a 2000
International Harvester school bus bearing Pennsylvania registration number SC09047
(hereinafter "the school bus")
9.
At all times relevant hereto, Defendant Deitch was the owner of the school bus
which was being operated by Defendant Wells.

At all times relevant hereto, Defendant Wells was operating Defendant Deitch's
STAMBAUGH LAW, P.C.

school bus with Defendant Deitch's express and/or implied knowledge, consent,
permission and authority.

At all times relevant hereto, Defendants Liliane E. Wonders and Bradley A.
Wonders were the property owners of 422 Steelstown Road, Newville, Pennsylvania
17241.
12.
At all times relevant hereto, Defendant Liliane E. Wonders was the normal and
usual operator of the school bus.
13.
At all times relevant hereto, Plaintiff was covered by full tort under Pennsylvania
Law or has limited tort with exclusions that apply, or in the alternative, has serious bodily
injury as defined by Pennsylvania Law or was not provided proper notice of the limited tort
option pursuant to 75 Pa. C.S.A. § 1701 et. seq., specifically § 1705 and § 1791, and other
applicable laws and regulations.

The said damages, as described hereafter, are in excess of $50,000.00 and outside
the scope and authority of mandatory arbitration and a jury trial is hereby demanded.

forth fully hereunder.

Plaintiff, at or about the aforementioned date and time, was traveling east on
Steelstown Road near its intersection with the driveway located at 422 Steelstown Road.
17.
At that time, Defendant Wells pulled her vehicle from the driveway at 422
Steelstown Road attempting to turn left onto westbound Steelstown Road without yielding
the lawful right of way to Plaintiff with the result that Defendant Wells pulled directly into
the lawful travel path of Plaintiff s motorcycle causing Plaintiff to swerve in order to avoid
Defendant Wells' vehicle thereby traveling off of the roadway, striking a mailbox and
sustaining myriad injuries according to proof at trial.

Said accident was directly and proximately caused by the joint and several
negligence and carelessness of Defendant Wells which consisted of the following and as
according to proof at trial:
a) Operating said motor vehicle without due regard to the rights, safety, and
position of Plaintiffs motorcycle;
b) Failing to have said vehicle under proper control so as to prevent the same
from traveling into the path of Plaintiffs motorcycle;
C) Failing to keep a proper lookout for other vehicles lawfully on the road;
d) Failing to operate said vehicle with due regard for the highway and traffic
conditions which were then and there existing and of which she was or
should have been aware;
e) Failing to take evasive action in order to avoid traveling into the direct path
of Plaintiffs motorcycle;

f) Violating 75 Pa.C.S.A. §3322 by turning left without yielding the right of
way to Plaintiff s motorcycle;
g) To the extent that Defendant Wells alleges that the accident was caused by
a defect and/or other deficiency of Defendant Deitch's vehicle, and/or that
any such alleged defect and/or deficiency caused and/or contributed to the
said accident, then Defendant Wells knew and/or should have known of any
and all such defects and/or deficiencies he alleges, and further knew and/or
should have known that, if operated on the roadway, the vehicle posed a
posed a risk of injury to lawful users of the roadways such that Defendant
Wells should not have attempted to operate the vehicle; and
h) To the extent that Defendant Wells alleges that she either or both could not
see due to Defendants Wonders' trees and/or Defendants Wonders' mirror,
then Defendant Wells should not have pulled on to Steelstown Road,
should have obtained assistance in pulling the school bus on to Steelstown
Road and/or should have requested that Defendants Wonders' trees be
removed or Defendants Wonders' mirror been of proper size, quality,
placement, etc. so as to allow Defendant Wells to safely pull on to
Steelstown Road.
19.
Said accident resulted from Defendant Wells' aforesaid joint and several
negligence and carelessness and was in no way the result of any act or failure to act on the
part of the Plaintiff.
20.
As a direct and proximate result of Defendant Wells' aforesaid joint and several
negligence and carelessness Plaintiff has sustained myriad personal injuries resulting in
serious impairment of bodily function which include the following all as according to
proof at trial:
a) Physical pain and suffering resulting from bodily injuries including but not
limited to injuries to Plaintiff s neck, back, shoulders, right forearm and
elbow, left bicep and clavical, and both hips, thighs and knees;

b) Mental anguish;
C) Discomfort;
d) Inconvenience;
e) Distress;
f) Loss of life's pleasures;
g) Embarrassment and humiliation;
h) An impairment of health and sense of well being; and
i) Disfigurement.

As a direct and proximate result of Defendant Wells' aforesaid joint and several
negligence and carelessness Plaintiff has suffered, is suffering, and in the future will
continue to suffer myriad financial injuries which include the following all as according to
proof at trial:
a) Past, present, and future medical expenses which have or may in the future
exceed applicable legal limits;

b) Incidental costs resulting from dealing with said injuries;
C) Loss of earnings and earning capacity;
d) Property damages and related damages; and
e) Loss of use;

against Defendant Wells, jointly and severally, in an amount in excess of $50,000.00, plus
delay damages, costs, interest and such other and further relief as allowed by law.
COUNT II
Michael Frey v. Richard S. Deitch

Paragraphs one (1) through twenty-one (21) are incorporated by reference as if set
forth fully hereunder.

At all times relevant hereto, Defendant Deitch knew and/or should have known that
Defendant Wells was operating his vehicle, and permitted Defendant Wells to operate said
vehicle expressly and/or impliedly.
24.
To the extent that Defendant Wells alleges that the accident was caused by a defect
or other deficiency of Defendant Deitch's vehicle and/or that any such alleged defect or
deficiency contributed to the said accident, then Defendant Deitch knew or should have
known of any and all such defects and/or deficiencies as alleged by Defendant Wells, and
further knew or should have known that, if permitted to be operated on the roadway, the
vehicle posed a posed a risk of injury to lawful users of the roadways.
25.
Despite what he knew or should have known, Defendant Deitch failed to take the
steps reasonable and necessary to prevent Defendant Wells from using Defendant Deitch's
vehicle, and/or Defendant Deitch failed to take the steps reasonable and necessary to make
the vehicle safe to be used on the roads.

Plaintiff sustained myriad injuries and damages, as aforesaid and as according to

proof at trial, all as a direct and proximate result of Defendant Deitch's aforesaid joint and
several negligence and carelessness.

Said accident resulted from said Defendant Deitch's aforesaid joint and several
negligence and carelessness and was in no way the result of any act or failure to act on the
part of Plaintiff.
Wherefore, Plaintiffs respectfully request that this Honorable Court enter judgment
against Defendant Deitch, jointly and severally, in an amount in excess of $50,000.00,
according to proof at trial, together with delay damages, interest, costs of suit, and such
other relief as this Court deems just and proper.
COUNT III
Michael Frey vs. Liliane E. Wonders and Bradley A Wonders
28.
Paragraphs one (1) through twenty-seven (27) are incorporated by reference as if
set forth fully hereunder.
29.
Defendants Wonders, as aforesaid were the property owners of 422 Steelstown
Road, Newville, Pennsylvania 17241 (hereinafter "the Property").
30.
Defendants Wonders had a duty, as the owners of the Property which abutted a

public roadway, to maintain the Property and prevent possible dangerous conditions, and
to inspect the premises so as to make the same safe.
31.
At all times relevant hereto, Defendants Wonders breached their duty to keep the
Property and premises in a safe, well maintained, nonhazardous condition, as follows:
a) Planted and/or failed to remove trees/shrubs and other such foliage which
obstructed a clear line of sight between the driveway at the Property and
Steelstown Road causing a dangerous condition which resulted in the
subject accident;
b) Failed to properly trim and maintain trees/shrubs and other such foliage
thereby preventing line of sight between the driveway at the Property and
Steelstown Road causing a dangerous condition which resulted in the
subject accident;
C) Failed to properly warn motorists on Steelstown Road, either by signage or
other method, of the hidden driveway at the Property causing a dangerous
condition which resulted in the subject accident;
d) Failed to maintain a sufficient method to view Steelstown Road for vehicles
attempting to enter onto Steelstown Road from the driveway at the Property
causing a dangerous condition which resulted in the subject accident; and
e) Although a mirror was in place, Defendants failed to place a mirror that was
of a proper size, at the proper location, or sufficiently clear causing a
dangerous condition which resulted in the subject accident.
32.
Plaintiff sustained myriad injuries and damages, as aforesaid and as according to
proof at trial, all as a direct and proximate result of Defendants Wonders' aforesaid joint
and several negligence and carelessness.
33.
Said accident was the result of Defendants Wonders' aforesaid joint and several

negligence and carelessness, and was due in no manner whatsoever to an act or failure to
act on the part of Plaintiff.

according to proof at trial, together with delay damages, interest, costs of suit, and such
other relief as this Court deems just and proper.
COUNT IV
Michael Frey vs. Liliane E. Wonders

Paragraphs one (1) through thirty-three (33) are incorporated by reference as if set
forth fully hereunder.

Defendant Liliane E. Wonders, as aforesaid was the normal and usual operator of
the school bus.
36.
Defendant Liliane E. Wonders had a duty, as the normal and usual operator of the
school bus, and as a co-owner of the Defendants Wonders' Property, and knowing the risks
posed by said Property to lawful users of Steelstown Road, to warn Defendant Wells of the
dangerous conditions which existed on Defendants Wonders' Property as aforesaid, and
further to take such reasonable and prudent actions as are and were necessary to ensure that
Defendant Wells' operation of the school bus did not pose a risk of injury to lawful users
of Steelstown Road.

At all times relevant hereto, Defendant Liliane E. Wonders breached her duty to
Plaintiff as follows all as according to proof at trial:
a) Failed to allow the school bus to be picked up by Defendant Wells at an
alternative location from Defendants Wonders' Property which was free of
the dangerous conditions on Defendants Wonders' Property as aforesaid;
b) Failed to warn Defendant Wells of the dangerous conditions on Defendants
Wonders' property as aforesaid which resulted in the subject accident;
C) Failed to remove the trees/shrubs and other such foliage which obstructed a
clear line of sight between the driveway at the Property and Steelstown
Road causing a dangerous condition which resulted in the subject accident;
d) Failed to properly trim and/or maintain the trees/shrubs and other such
foliage thereby preventing a clear line of sight between the driveway at the
Property and Steelstown Road causing a dangerous condition which
resulted in the subject accident;
e) Failed to properly warn motorists on Steelstown Road, either by signage or
other method, of the hidden driveway at the Property causing a dangerous
condition which resulted in the subject accident;
f) Failed to maintain a sufficient method to view Steelstown Road for vehicles
attempting to enter onto Steelstown Road from the driveway at the Property
causing a dangerous condition which resulted in the subject accident;
g) Although a mirror was in place, Defendants failed to place a mirror that was
of a proper size, at the proper location, and/or sufficiently clear causing a
dangerous condition which resulted in the subject accident;
h) Failed to provide assistance to Defendant Wells in turning on to Steelstown
Road which resulted in the subject accident; and
i) Failed to drive the school bus from Defendants Wonders' Property to a safe
and secure location where Defendant Wells could take over operation of the
school bus.

Plaintiff sustained myriad injuries and damages, as aforesaid and as according to

proof at trial, all as a direct and proximate result of Defendant Liliane E. Wonders'
aforesaid joint and several negligence and carelessness.

Said accident was the result of Defendant Liliane E. Wonders' aforesaid joint and
several negligence and carelessness, and was due in no manner whatsoever to an act or
failure to act on the part of Plaintiff.
Wherefore, Plaintiffs respectfully request that this Honorable Court enter judgment
against Defendant Liliane E. Wonders, jointly and severally, in an amount in excess of
$50,000.00, according to proof at trial, together with delay damages, interest, costs of suit,
and such other relief as this Court deems just and proper.
COUNT V
Michael Frey vs. Foremost Insurance Group

At the time of the September 15, 2008 accident, Plaintiff had in full force and
effect insurance on Plaintiff's motorcycle under Defendant Foremost's Policy # 276-
0071334033, which provided underinsured motorist coverage as to the subject accident
with Underinsured Motorist limits of $100,000 per person/$300,000 per accident.

Plaintiffs have what Defendant Foremost has represented to be a certified full, true,
correct and complete copy of the said Foremost insurance policy. A true and correct copy
of said represented policy and declarations are collectively served and filed herewith as
Exhibit "A".

As a result of the subject accident, Plaintiff sustained myriad injuries and damages
as aforesaid and as according to proof at trial, all as a direct and proximate result of
Defendants Wells', Deitch's, Liliane E. Wonders' and Bradley Wonders' aforesaid joint
and several negligence and carelessness.

Plaintiff hereby makes an underinsured motorist claim with respect to the
September 15, 2008 accident, and accordingly seeks benefits to which he is entitled
according to proof at trial.
Wherefore, Plaintiffs respectfully request that this Honorable Court enter judgment
against Defendant Foremost in an amount in excess of $50,000.00, plus delay damages,
costs, interest and such other and further relief as allowed by law.
