MOTION TO MAKE RULE ABSOLUTE
AND NOW, this ~~day of September 2010 comes Petitioner, Mary K. Wagner, by her
counsel at the law firm of Salzmann Hughes, P.C., and files this Petition to Make Rule Absolute
averring the following in support of this Petition:
1. Eva A. Kuykendall died testate on November 14, 2008.
2. On or about June 14, 2010, Petitioner filed a Petition Under Section 3102 of the Probate,
Estates and Fiduciary code for the Settlement of Small Estate with this Court.
3. On or about June 29, 2010, this Court issued a Rule to Show Cause why the Petition should
not be granted, said rule to be returnable within twenty-one (21) days after the date of the Order.
A true and correct copy of the Rule to Show Cause together with this Court's Amendment to that
Order revising the date of the Rule to Show Cause are attached hereto as Exhibit "A" and
incorporated herein by this reference.
4. On July 7, 2010 and on August 2, 2010 Petitioner served copies of the Rule to Show Cause
upon all interested parties. A Certificate of Service is attached hereto as Exhibit "B" and
incorporated herein by this reference.
5. As of the date of this Motion, no reply to the Rule to Show Cause has been filed with the
Register of Wills.
WHEREFORE, Respondent respectfully requests that this Honorable Court make the
Rule Absolute and grant Respondent's Petition Under Section 3102 of the Probate, Estates and
Fiduciary code for the Settlement of Small Estate with this Court.
