DICKENS, Defendants IN THE COURT OF COMMON PLEAS OF CUMBERLAND COUNTY, PENNSYLVANIA : NO. 2010 - CIVIL TERM COMPLAINT Plaintiff, MEMBERS 1St FEDERAL CREDIT UNION, by and through its attorneys, MARTSON DEARDORFF WILLIAMS OTTO GILROY & FALLER, hereby files this Complaint against WILLIAM M. DICKENS and VIRGINIA KRISTA a/k/a VIRGINIA K. DICKENS, and in support thereof, avers the following: 1. Plaintiff, Members 1St Federal Credit Union, ("Plaintiff') is a federally chartered credit union located at 5000 Louise Drive, Mechanicsburg, Pennsylvania 17055. 2. Defendant, William M. Dickens, is an adult individual residing at 406 Keller Street, Mechanicsburg, Cumberland County, Pennsylvania 17055. 3. Defendant, Virginia Krista, a/k/a Virginia K. Dickens, is an adult individual residing at 406 Keller Street, Mechanicsburg, Cumberland County, Pennsylvania 17055. 4. On or about December 14, 2004, Defendants completed an application with Plaintiff to obtain a Visa credit card. A true and correct copy of the application is attached hereto and incorporated as Exhibit "A." 5. Plaintiff issued a Visa credit card to Defendant. Count I - Breach of Contract 6. Paragraphs 1 through 5 are incorporated herein by reference. 7. As part of its Application with Plaintiff, Defendants agreed to pay the balance on the Visa credit card. 8. As of August 4, 2010, the unpaid, overdue balance on Defendants' Visa credit card was $18,133.11. 9. As of the date of this Complaint, the entire balance remains unpaid. 10. Plaintiff has requested payment of the balance. 11. Defendants have failed and refused to pay the balance. WHEREFORE, Plaintiff demands judgment against Defendants in the amount of $18,133.11, plus interest, costs of suit, attorneys' fees, and any other relief that this Court deems appropriate. Count II - Unjust Enrichment 12. Paragraphs 1 through 11 are incorporated herein by reference. 13. Defendants have received a financial benefit in the amount of $18,133.11 from the use of the Visa credit card issued by Plaintiff. 14. Defendants have accepted and retained benefits from the use of the Visa credit card issued by Plaintiff without payment to Plaintiff. 15. It was and continues to be inequitable and unjust for Defendants to receive benefits from the use of the Visa credit card without payment to Plaintiff. WHEREFORE, Plaintiff demands judgment against Defendants in the amount of $18,133.11, plus interest, costs of suit, attorneys' fees, and any other relief that this Court deems appropriate.
