Please be advised that this firm represents the estate of Bruce L. Holtry who passed away
on June 18, 2010. Mr. Holtry's Last Will and Testament was entered for probate on July 9,
2010, by petition prepared and filed by his spouse, Naomi M. Holtry. Apparently there
was some confusion regarding what assets were to be reported on the petition, and Mrs.
Holtry entered all assets jointly owned by her husband, Bruce L. Holtry, and herself,
totaling $185,000. Of course, none of these assets should have been included on the
petition. However, there was one asset, a bank account, that was solely owned by Bruce L.
Holtry at the time of his passing, with a date of death value of approximately $7,762. This
is the only asset that should have been reported on the petition.
The probate fee that Mrs. Holtry paid on the $185,000 totaled $260, while the probate fee
on $7,762 totals $40. Therefore, we are requesting a refund of probate fees in the amount
of $220. This is one of those classic lay person situations where the family goes to the
bank to close out a decedent's bank account and is advised that they need a "short
certificate." When asked where a "short certificate" can be obtained, the answer is, "the
courthouse." When the family arrived at your office, the staff properly gave them a
petition for letters to be completed and properly stated that no legal advice could be given.
Hence our problem.
