THIS AGREEMENT made the /~..~¢a~ day of March, 2001, by and between YANEK
CUSTOM HOMES, INC., hereinafter referred to as Contractor', and BARTH W. SWEENEY and
MARYANN SWEENEY, hereinafter referred to as Owner, whereby the former undertook and
agreed to erect and construct a custom built home on that certain lot of ground situate at Lot No. 97,
Seneca Circle, Dickinson Township, Cumberland County, Pennsylvania, more fully described in
Exhibit "A" attached hereto and made a part hereof.
NOW THEREFORE, WITNESSETH: That the said Contractor, for and in consideration of
the sum of ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves
and their subcontractors, and all parties acting through or under them, covenant and agree that no
mechanic's liens or claims shall be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards, in, or about the
erection and construction of the said buildings on the lot above described, and the said Contractor,
for themselves, their subcontractors and others under them hereby expressly waive and relinquish
the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any
of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant.

ALL that certain tract of land with the improvements thereon erected, situate in Dickinson
Township, Cumberland County, Pennsylvania, bounded and de. scribed as follows, to wit:
BEGINNING at a point on the southern dedicated right-of-way line of Seneca Circle at the dividing
line between Lots 97 and 98 as set forth on the hereinafter mentioned Final Subdivision Plan; thence
along said dividing line South 08 degrees 39 minutes 19 second.,; East 280.77 feet to a point; thence
along line of lands now or formerly of Steven B. and Tracey L. Patience and lands now or formerly
of Robert J. and Jeanette C. Lewis, South 63 degrees 59 minutes 21 seconds West 157.89 feet to a
point; thence along the dividing line between Lots 96 and 97 as set forth on the hereinafter
mentioned Final Subdivision Plan, North 13 degrees 18 minuets 43 seconds West 268.76 feet to a
point; thence along the southern right-of-way line of Seneca Circle North 51 degrees 12 minutes 47
seconds East 72.40 feet to a point; thence continuing along the same along a curve to the right
having a radius of 175.00 feet and an arc length of 92.03 feet to a point; thence continuing along the
same North 81 degrees 20 minutes 41 seconds East 22.05 feet to a point, the Place of BEGINNING.
CONTAINING a total area of 46,799 square feet and being Lot No. 97 on a Final Subdivision Phase
Number Two of Callapatscink, recorded in the Office of the Recorder of Deeds in and for
Cumberland County in Plan Book 74, Page 141.
