GARY D. SMITH and MARILYN G. SMITH, of Shiremanstown, Cumberland County, Pennsylvania,
hereinafter individually and collectively called "Owner", are about to execute contemporaneously herewith, a
contract with W. LEE ROLAND, of Mechanicsburg, Cumberland County, Pennsylvania, heminaiter called
-Contractor", for construction of a single family residence upon land of Owner situate; Upper Allen Township,
Cumberland County, Pennsylvania, being more particularly bounded and described on Exhibit "A," attached
hereto and made part hereof-
NOW, March .,~Z , 2001, before any authority has been given by the said Owner to the said
Contractor to commence work on the said improvements or purchase materials for the same, in consideration
of the making of the said contract with Owner and the further consideration of One Dollar ($1.00), to Contractor
by Owner, it is agreed'that no lien shall be filed against said single family residence or the property by the
Contractor, or any sub~contrect°r, nor by any of the material men or workmen or any other person for any
labor, or materials purchased, or extra labor or materials purchased for the construction of said single family

LEGAL DESCRIPTION
ALL THAT CERTAIN parcel of land situate in Upper Allen Township,
Cumberland County and Commonwealth of Pennsylvania, more
particularly bounded and described as follows:
BEGINNING at a point on the southeastern right-of-way of windrush
Lane of the Final Development Plan for Witnsy Ridge, Planned
Residential Development, Phase I, prepared by Dawood Engineering,
Inc. dated September 17, 1999 and'latest revision dated October 13,
northernmost corner of Lot No. 26

right-of-way of Windrush Lane by a curve to the left having a
radius of 275.00 feet and an arc length of 64.17 feet with a chord
bearing of North 32 degrees 18 minutes .15 seconds East and a chord
distance of 64.02 feet to a point at the southwestern corner of Lot
No. 28 of the aforesaid Witney Ridge Final Development plan;
THENCE along said Lot No. 28 South 64 degrees 22 minutes 49
seconds East a distance of 138.79.feet to a point on Lot No.4
(known as Kingham SanctUary) of the aforesaid Witney Ridge Final
Development Plan; THENCE along said Lot No. 4 (known aS Kingham
Sanctuary) South 44 degrees 27 minutes 23 seconds West a distance
of 96.11 feet to a point on the easternmost corner of the above
mentioned Lot No. 26; THENCE along said Lot No. 26 North 51
degrees 00 minutes 41 seconds west a distance of 118.42 feet to a
point on the southeastern right-of-way of Windrush Lane at the
