MECHANIC'S LIEN CLAIM STATEMENT OF MECHANIC'S LIEN Now comes Charles E. Brake Company, Inc., by its attorneys, Kirkpatrick & Lockhart LLP, and files the following Statement of Mechanic's Lien as contractor pursuant to the Mechanics' Lien Law of 1963, 49 P.S. 91101, et seq., against the premises herein described, for the payment of $209,971.53, together with interest from December 29,2000: I. Claimant is Charles E. Brake Company, Inc. ("Brake"). Brake is a Pennsylvania corporation with its principal place of business located at 6450 Lincoln Way West, St. Thomas, Pennsylvania. 2. The owner or reputed owner is Community Refuse Service, Inc. Community Refuse Service, Inc. is a Pennsylvania corporation with its prineipal place of business located at 142 Vaughn Road, Shippensburg, Pennsylvania. Community Refuse Service does business pursuant to the fictitious name Cumberland County Landfill (collectively referred to as "CRS"). 3. Documents of record also suggest that Waste Systems International, Inc. ("WSI") may have an ownership interest in the property herein described and this mechanic's lien claim is intended to place a lien on whatever interest WSI may have. WSI is a Massachusetts corporation with its principal place of business located at 420 Bedford Street, Lexington, Massachusetts. HA-103352 vI 4. This claim results from work performed and materials supplied by Brake upon and in connection with property known as Cumberland County Landfill, located in Hopewell and North Newton Townships on State Route 31, including, but not necessarily limited to, all of the real estate described in the Commercial Open-End Mortgage between Community Refuse Service, Inc. and The Howard Bank, N.A., which is recorded in the Office of Recorder of Deeds of Cumberland County, Pennsylvania in Mortgage Record Book 1559 at Page 1069 and all of the real estate described in the following deeds of acquisition of Community Refuse Service, Inc. (hereinafter the "Landfill"): a. deed from Robert H. Grove, recorded on June 7,1985, in Cumberland County Deed Book H, Volume 31, Page 476. b. deed from Billie A. Myers and Linda D. Myers, his wife, recorded on May 29,1986, in Cumberland County Deed Book X, Volume 31, Page 419. c. deed from Mark E. Negley and Darlene M. Negley, his wife, recorded on February 27,1987, in Cumberland County Deed Book M, Volume 32, Page 1067. d. deed from Marlin E. Johnson, alk/a/ Marlin E. Johnson, Sr., widower, recorded on December 3, 1987, in Cumberland County Deed Book B, Volume 33, Page 850. e. deed from Walter H. Stevick and Jean E. Stevick, his wife, recorded on May 27,1988, in Cumberland County Deed Book J, Volume 33, Page 207. f. deed from Walter M. Fickes and Dauphin Deposit Bank and Trust Company, Executors of the Estate of Walter M. Fickes, deceased, recorded on August 8, 1989, in Cumberland County Deed Book C, Volume 34, Page 286. g. deed from Robert H. Grove and Esther L. Grove, his wife; Michael R. Grove and Jenine Grove, his wife; Robin Grove Vink, formerly known as Robin L. Grove, and Gary G. Vink, her husband; and Joseph D. Grove, single person, recorded on October 5, 1989, in Cumberland County Deed Book F, Volume 34, Page 59. h. deed from Paul D. Rockwell, a single man, recorded on April I 0, 1992, in Cumberland County Deed Book P, Volume 35, Page 517. 1. deed from Joyce E. Wagner, recorded on June 30,1998, in Cumberland County Deed Book 180, Page 409. J. deed from Barbara B. Townsend, single, recorded on October 25, 1989, in Cumberland County Deed Book F, Volume 34, Page 1031. 2 k. deed from Odette B. Flanagan, single, recorded on April 12, 1988, in Cumberland County Deed Book G, Volume 33, Page 895. 1. deed from Mike F. Zemencik, single, recorded on March 3, 1989, in Cumberland County Deed Book V, Volume 33, Page 277. m. deed from J. Robert Snyder and Helen T. Snyder, husband and wife, recorded on September 5, 2000, in Cumberland County Deed Book No. 228, Volume I, Page 574. n. deed from 1. Robert Snyder and Helen T. Snyder, husband and wife, recorded on September 15, 2000, in Cumberland County Deed Book No. 229, Page 187. The Commercial Open-End Mortgage between Community Refuse Service, Inc. and The Howard Bank, N.A and the above-described deeds are incorporated herein by reference. 5. The work for which this claim is made was begun on August 23,2000, and completed on December 29, 2000. 6. On or about August 22, 2000, CRS accepted Brake's proposal dated July 11,2000, to complete the placement of 660' of 36" Class III RCP pipe and two structures as per Community Refuse Service, Newton Expansion Drawings dated November 1992 (the "storm water project contract"), including (I) strip and stockpile topsoil; (2) remove excess excavation to another location on the landfill; and (3) supply and place piptl. Pursuant to the accepted proposal, CRS agreed to pay Brake a lump sum price of $98,000.00. A copy of the storm water project contract is attached hereto as Exhibit "A" and incorporated herein by reference. 7. The general nature of the labor performed and the materials supplied upon and in connection with the storm water project contract is as follows: Description of Work Scheduled Value mobilization $500.00 construction layout $1,000.00 furnish pipe and inlets $46,000.00 excavate and stockpile overburden $17,500.00 install pipe and inlets $33,000.00 3 8. On December 5, 2000, Brake submitted to WSI an Application and Certificate for Payment for work it did on the storm water project contract. The amount requested by Brake for the work it performed on the storm water project contract, as shown by the Application and Certificate for Payment, was $98,000.00. To date, WSI has failed and refused to pay the $98,000.00 due and owing Brake for the work it performed on the storm water project contract. A copy of the December 5, 2000 Application and Certificate for Payment is attached hereto as Exhibit "B" and incorporated herein by reference 9. On or about August 22,2000, CRS accepted Brake's proposal dated July 14,2000, to furnish all material and complete all work shown on Martin & Martin drawings "Wetwell #1, Site Plan & Profile" and" Wetwell #1 - Pump Station" dated May, 2000 (the "wet well #1 reconstruction project contract"). Pursuant to the accepted proposal, CRS agreed to pay Brake a lump sum price of$73,500.00. A copy of the wet well # I reconstruction project contract is attached hereto as Exhibit "C" and incorporated herein by reference. 10. The general nature of the labor performed and th,~ materials supplied upon and in connection with the wet well #1 reconstruction project contract is as follows: Description of Work Scheduled Value mobilization $500.00 construction layout $1,000.00 furnish pumps $21,500.00 furnish HDPE wet well and vault $17,500.00 excavation of wet well and vault $4,500.00 installation of wet well, vault and pumps $11,500.00 backfill wet well and vault $8,000.00 II. On December 29, 2000, Brake submitted to WSI an Application and Certificate for Payment for work it did on the wet well #1 reconstruction project contract. The amount requested by Brake for the work it performed on the wet well #1 reconstruction project, as shown by the Application and Certificate for Payment, was $64,500.00. To date, WSI has failed and refused to pay the $64,500.00 due and owing Brake for the work it performed on the wet well #1 4 reconstruction project contract. A copy of the December 29,2000 Application and Certificate for Payment is attached hereto as Exhibit "D" and incorporated herein by reference. 12. The total amount asserted by Brake to be due and owing for labor performed and materials supplied upon and in connection with the Landfill is $209,971.53, together with interest from December 29, 2000. 14. Brake performed its work in a good and workmanlike manner. 15. The land against which this lien is claimed is the property owned or reputedly owned by Community Refuse Service, Inc. and/or Waste Systems International, Inc. and described above in Paragraphs 2-4.
