Rosenbers day of Inc. March , 2001 , Owner, whereby the former undertook and agreed to erect and construct a , hereinafter referred to as 2 story residential Dwelling on that certain lot of groun~ situate in See attached NOW THEREFORE, THIS AGREEMENT W1TNESSETH: That the said Contractor, for and in consideration of the sum of($I.00) Dollar to in hand paid by Owner, the receipt whereof is hereby acknowledged, and the fitrther consideration mentioned in the agreement aforesaid, for themselves and their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them ,ar any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for themselves, their subcontractors and other, under them hereby expressly waive and relinquish the right to have, file, and maintain any n echanic s liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. Rosenberg dated November 15, 2000 prepared by Hoover Engineering Services, Inc. and recorded in Plan Book , Page bounded and described as follows: BEGII~NING at an iron pin to be set as noted on said plan and further being the southeast corner of the herein described lot at the dedicated right-of-way line with Hunters Drive; thence south 75 degrees 35 minutes 16 seconds west a distance of 214.57 feet to a point; thence south 83 degrees 15 minutes 46 seconds west a distance of 332.36 feet to a proposed concrete monument and primary control point as shown'on the aforesaid plan; thence north 06 degrees 44 minutes 14 seconds west a distance of 353.351 feet to a proposed concrete monument; thence north 83 degrees 1.5 minutes 46 seconds east a distance of 111.63 feet to an iron pin to be set; thence north 55 degrees 31 minutes 52 seconds east a distance 156.32 pin to be set; thence north 83 degrees 15 minutes 46 feet to an iron d~stance of 295 feet to an iron pin to be set on the seconds east a dedicated right-of-way line. of Hunters Drive; thence south 06 degrees 44 minutes 14 seconds east along the dedicated right-of-way line of Hunters Drive 397.44 feet to the point and place of beginning. BEING known as Lot 3 as shown on the aforesaid s~bdivision plan. BEING part of the same premises which Earl E. Morrow and Mary D. Morrow, his wife, by deed dated November 5, 11958 and recorded in the CLunberland County Recorder of Deeds'~Office in Deed Book T-18, page 498, granted and conveyed unto Oliver Rosenberg and Mary E. Rosenberg, his wife. The said Oliver Rosenberg died on March 26, 1996, whereby title vested solely in Mary E. Rosenberg, the grantor herein, by operation of law.
