HomeMy WebLinkAbout01-1571Stipulationvliens/realestate/CLN STIPULATION AGAI~IST LIENS GUS KOKOS and CONSTANCE KOKOS, Owner Vo CARLSON CONSTRUCTION, INC., Contractor : IN THE COURT OF COMMON PLEAS : OF CUMBERLAND COUNTY, PENNSYLVANIA WHEREAS, GUS KOKOS and CONSTANCE KOKOS, of 205 Ewe Road, Mechanicsburg, Cumberland County, Pennsylvania 17055, Owner, are about to contemporaneously herewith execute a contract with CARLSON CONSTRUCTION, 1NC., Contractor, with a principal place of business located at 1085 Country Club Road, Camp Hill, Cumberland County, Pennsylvania 17011, for the erection/renovations upon a lot of land situate and known as Lot K.-11 Saratoga Place, East Pennsboro Township, Cumberland County, Pennsylvania, and which is more particularly described on Exhibit "A" attached hereto and made a part hereof. NOW, this 16th day of March, 2001, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said Owner to the said Contractor, to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with the Contractor and the further consideration of One ($1.00) Dollar and other valuable considerations, receipt of which is hereby acknowledged, to the Contractor paid by the Owner, it is agreed that no lien shall be filed against the building by the Contractor, or any sub-Contractor nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection/renovations to said building, the right to file such liens being expressly waived. CARLSON, Authorized Crfficer ALL THAT CERTAIN piece or parcel of ground situate in East Pennsboro Township, Cumberland County, Pennsylvania, more particularly bounded and described as follows, to wit: BEGINNiNG at a point on the northern side of Saratoga Place at the southwestern corner of lands now or formerly ofNorma J. Gotwalt on the hereinafter mentioned Plan of Lots; thence along the western line of said same lands, North 16 degrees 00 minutes 10 seconds West, a distance of 169.02 feet to a point at the lands now or formerly of Russell C. Goodling; thence along those same said lands South 71 degrees 15 minutes 00 seconds West, a distance of 86.50 feet to a point at the northeastern corner of Lot No. K-10 on the hereinafter mentioned Plan of Lots; thence along the eastern side of Lot No. K-10, South 10 degrees 17 minutes 25 seconds East, a distance of 160.71 feet to a point on the northern side of Saratoga Place; thence along the northern side of Saratoga Place by a curve to the right having a radius of 1,000.00 feet and an arc length of 15.71 feet to a point, the point and place of BEGINNING. CONTAINING 15,618.954 square feet, more or less. BEING Lot No. Kol 1 on the Final Subdivision Plan of Floribunda Heights, Phase II, Sections K & H, dated October 5, 1999, prepared by Melham Associates, PC, and recorded in the Office of the Recorder of Deeds of Cumberland County, Pennsylvania in Plan Book 80, Page 45 and revised on February t7, 2000 and re-recorded in Plan Book 80, Page 104. UNDER AND SUBJECT, NEVERTHELESS, to all easements, restrictions, encumbrances and other matters of record or that which a physical inspection or survey of the premises would reveal. Exhibit "A"
