COMPLAINT
NOW come the plaintiffs, by their attorney, Harold S. Irwin, III, and file this
complaint against the defendants, representing as follows:
1. Plaintiffs JAMES RAUDABAUGH and CYNTHIA RAUDABAUGH, his
wife, are adult individuals and the parents and natural guardians of SAMANTHA
RAUDABUGH, a minor, residing at 1381 Enola Road, Carlisle, Cumberland County,
Pennsylvania 17013.
2. Plaintiff TRACEY HOLLEY is the parent and natural guardian of XAVIER
SHOLLEY, a minor, residing at 86 Country Drive, Leola, Pennsylvania 17540.
3. Defendants JARRETT BROCK and PATRICIA McCALLISTER, are adult
individuals residing at 1431 Enola Road, Carlisle, Cumberland County, Pennsylvania
17013.
4. Defendant HENRY THOMPSON is an adult individual whose current
address is unknown, but who is believed to be currently residing in prison.

5. On or about Sunday, March 21,2004, at approximately 6:30 p.m., and at
all times relevant hereto, Thompson was the owner of a dog, specifically a Mastiff,
answering to the name of JoJo.
6. At said time and at all times relevant to this matter, the Brooks owned the
premises at 1431 Enola Road, on which they were maintaining possession and control
of said dog for Mr. Thompson.
7. At said time and place, Samantha Raudabaugh and Xavier Sholley, minor
children as aforesaid, were playing with other children in the Raudabaughs' neighbor's
yard, swinging in a hammock.
8. At said time and place, the dog, JoJo, jumped out of his fenced enclosure,
immediately ran over to the children, tipped the hammock and viciously attacked the
children, biting and injuring Samantha and Xavier, as well as another child.
9. At said time and place, the children were not trespassing on the Brocks'
property, threatening or intimidating the dog or in any other way instigating the attack by
the dog.
10. The attack of the dog, which caused personal injuries to the children, as
well as other physical and financial damages, was solely the direct result of the
carelessness, recklessness and negligence of the defendants, including but not limited
to the following:
A In harboring a known dangerous and vicious dog;
B. In failing to maintain the known dangerous and vicious dog under
proper supervision and control;

C. In failing to maintain a proper enclosure for the known dangerous
and vicious dog that would prevent the dog from escaping and attacking the
plaintiffs' children;
D. In failing to insure that the dog had received his proper inoculations
for rabies and other dangerous diseases; and
E. In otherwise failing to exercise appropriate care and caution in the
maintenance of a known dangerous and vicious dog.
11. As the direct result of the defendants' negligence and carelessness as
aforesaid and the incident that resulted therefrom, plaintiffs suffered property damages
to the children's clothing when the dog viciously bit the children.
11. As the direct result of the defendants' negligence and carelessness as
aforesaid and the incident that resulted therefrom, the children suffered serious
personal injuries, including, but not limited to puncture wounds, lacerations and other
bruises.
12. As the direct result of the defendants' negligence and carelessness as
aforesaid and the incident and injuries that resulted therefrom, the children underwent a
variety of medical treatment including, but not limited to repair of their puncture wounds
and lacerations.
13. As the direct result of the defendants' negligence and carelessness as
aforesaid and the incident and injuries that resulted therefrom, the children retain
permanent scarring at the site of the puncture wounds.
14. As the direct result of defendants' negligence and carelessness as
aforesaid and the incident that resulted therefrom, plaintiffs incurred substantial medical

expenses for evaluation and treatment of the children's injuries and may again in the
future incur medical expenses due to such injuries.
15. As the direct result of defendants' negligence and carelessness as
aforesaid and the incident and injuries that resulted therefrom, plaintiffs suffered loss of
income of income during the period of time in which they were attending to their
children's injuries and taking them for medical treatment.
16. As the direct result of defendants' negligence and carelessness as
aforesaid and the incident and the injuries that resulted therefrom, the children suffered
serious pain, suffering and discomfort, inability to perform their normal household and
personal activities and a loss of life's pleasures during the time of their recuperation.
17. As the direct result of defendants' negligence and carelessness as
aforesaid and the incident and the injuries that resulted therefrom, the Raudabaughs
witnessed portions of the vicious attack of the dog and suffered emotional trauma as the
result.
WHEREFORE, plaintiffs demand judgment against the defendants in an amount
in excess of Twenty-five Thousand and no/100 ($25,000.00) Dollars, plus costs of this
action and delay damages.

Pursuant to Pa.R.C.P. 1037 (b)(1), please enter judgment in favor of plaintiffs and
against the defendants, JARRETT BROCK and PATRICIA McCALLISTER only, for
failure to file an answer to plaintiffs' complaint within twenty (20) days of service thereof.
Enter judgment in favor of the plaintiffs and against these defendants as to all of the
allegations of plaintiffs' complaint such that the trial to be held in this case be limited to
the amount of damages to be assessed against therse defendants.
Pursuant to Pa.R.C.P. 237.1, it is certified that on August 5,2004, a written notice of
