1. Petitioner is the Cumberland County Tax Claim Bureau (hereinafter called
"Bureau") created under the provisions of the Real Estate Tax Sale Law of the
Commonwealth of Pennsylvania Act of July 7, 1947, P.L. 1368, as amended 72
P. S. § 5860.101 et sic.
2. On September 16, 2010 the Bureau held an Upset Tax Sale listing one hundred
thirty-one (131) properties for the collection of delinquent real estate taxes. Of
the properties offered, six (6) received bids equal to or higher than the fixed upset
price, sixty (60) properties received no bid, two (2) properties were stayed and
sixty-three properties were continued to the December 15, 2010 Upset Sale. A
list of said properties is hereto attached as Exhibit "A".
3. Notices of the Sale were sent by certified mail, restricted delivery, returned receipt
requested to each reputed owner as listed in Exhibit "A".
4. For properties where a return receipt was not received from each owner or
reputed owner at least ten (10) days before date of Upset Sale, similar notice of
the sale was sent, to each owner who failed to acknowledge the first notice, by
United States first class mail.
5. In accordance with the Real Estate Tax Sale Law, advertisement of the Upset
Tax Sale was made at least thirty (30) days prior to the original scheduled sale

date in at least two newspapers of general circulation and the Cumberland Law
Journal. Proofs of publication are attached hereto as Exhibit "B".
6. Personal service by the Cumberland County Sheriffs Office was served on the
owner occupied properties as defined in Section 102 of the Pennsylvania Real
Estate Tax Sale Law.
7. The properties listed by tax parcel in Exhibit "A" were duly posted by the
Cumberland County Sheriffs Office or the County Assessment staff.
8. For properties that were sold, a notice that the properly was sold was sent via
certified mail, restricted delivery, return receipt and also regular U.S. mail to each
owner at his or her last known mailing address by the Bureau within thirty (30)
days following the sale.
9. Your petitioner respectfully requests that the Court's Confirmation Nisi provide
that a consolidated notice regarding properties sold on September 16, 2010 be
published once in the Cumberland Law Journal, and The Patriot News within ten
(10) days of the date of the Confirmation Nisi, and that any exceptions or
objections thereto be filed within thirty (30) days of the Court's order.
WHEREFORE the Bureau respectfully requests your Honorable Court to enter an
Order Confirmation Nisi in accordance with this Petition.

. SETTLEMENT AGREEMENT
WHEREAS, the parties listed hereunder are all parties to a certain upset tax sales of Cumberland
County Tax Parcel 23-32-2336-110, a parcel of residential real estate owned by Donn L and Tracy L
Griffie in Mount Holly Springs, Cumberland County, Pennsylvania, known as 7 E Orange Street, Mount
Holly Springs, Pennsylvania (the "parcel") on September 16, 2010.
WHEREAS, the parties desire to settle the legal issues created by Sam Hill Properties bid and
purchase of the Parcel at the said upset tax sale,
NOW THEREFORE, the parties hereto, in consideration of the mutual promises herein set forth
and intending to be legally bound hereby, agree as follows:
1. Donn L and Tracy L Griffie agree to pay to Sam Hill Properties, Purchaser, the sum of
five thousand nine hundred fifty-seven dollars and eighty-two cents ($5957.82) at the
signing of this agreement.
2. In consideration of the above, the Purchaser hereby releases and discharges any and all
right, title and interest in and to the Parcel to Donn L and Tracy L Griffie under the
unique facts of this case only, to set aside the said upset tax sale of the Parcel, ab initio,
so that good and marketable title, without cloud or objection, was , is and remains in
Donn L and Tracy L Griffie as if the said tax upset sale had never taken place forever.
The Tax Claim Bureau agrees to accept payment in full of the 2008 County/municipal,
2008/09 School, 2009 County/municipal, 2009/10 School real estate taxes, a municipal
lien together with the Bureau costs and expenses to wit: Three thousand, nine hundred
fifty-seven dollars and eighty-two cents ($3,957.82), from the purchase price paid by
Purchaser on the day of upset tax sale and the Bureau agrees to refund the balance of said
purchase price to Purchaser, to wit: One thousand, eight hundred thirty-six dollars and
seventy-five cents ($1,836.75), all in Settlement under the unique conditions hereinabove
set forth. No refund will be made until the Bureau receives this agreement signed by all
parties.

1. Petitioner is the Cumberland County Tax Claim Bureau (hereinafter called
"Bureau") created under the provisions of the Real Estate Tax Sale Law of the
Commonwealth of Pennsylvania, Act 542 of July 7, 1947, P.L. 1368, as amended
72 P.S. § 5860.101 et sic.
2. On September 16, 2010 the Bureau held an Upset Tax Sale and successfully sold
a parcel of real estate owned by Frank D Aungst, located at 1806 Letchworth Drive,
Lower Allen Township, Cumberland County, Pennsylvania, known as Lot 26D, PB
B4, PG 100 in Book 2007, Page 32498.
3. At said Upset Sale, the property of Frank D Aungst, known as parcel number 13-
23-0547-210 was sold for $20,000.00 a price in excess of the minimum bid
acceptable to the Bureau, to Sam Hill Properties, 721 Sam Hill Lane, Dauphin,
Pennsylvania who paid said purchase price to the Bureau at time of sale.
4. Currently there are delinquent real estate taxes, interest and costs on said property
due to the Tax Claim Bureau in the amount of $4,011.90. A tax lien certificate is
attached hereto as Exhibit "A".

5. As outlined on the Schedule of Distribution attached as Exhibit "B" and a lien
search attached as Exhibit "C", there are other liens as follows:
a. Current year county and municipal real estate taxes in the amount of
$ 1,697.06 due and payable to Bonnie K. Miller, Lower Allen Township
Collector. If said taxes are not paid to tax collector by December 31, 2010,
said taxes will be turned over to Tax Claim Bureau.
b. Outstanding Refuse and Street Light in the amount of $273.05 due to Lower
Allen Township Authority.
c. Judgment to Lower Allen Township Authority, in the amount of $361.00
entered October 27, 2010, docket number 2010-6864.
6. Distribution of sale proceeds by the Bureau is controlled by 72 P.S. §5860.205(d)
according to the following priority:
(1) First, to the Commonwealth, by payment to the State Treasurer through the
Department of Revenue, for satisfaction of tax liens of the Commonwealth
only if the total amount of such liens or such portion thereof have been included
in the purchase price and paid by the purchaser or the property is sold at judicial
sale pursuant to this act.
(2) Second, to the respective taxing districts in proportion to the taxes due
them.
(3) Third, to taxing districts or municipal authorities for satisfaction of
municipal claims.
(4) Fourth, to mortgagees and other lien holders, in order of their priority,
for satisfaction of mortgages and liens as they may appear of record,
whether or not discharged by sale.
(5) Fifth, to the owner of the property.
7. As outlined on the Schedule of Distribution attached hereto as Exhibit B,
commission is due to the Tax Claim Bureau in the amount of $682.85 which is
5% of the excess monies after taxes collected at time of sale as referenced in
72 P.S.§5860.205(c).
8. Petitioner proposes that the $20,000.00 of net proceeds of this Upset Sale; after
recording fees included in the sale price be distributed as follows:

a) $ 4,011.90 to the Cumberland County Tax Claim Bureau for delinquent
taxes.
b) $ 682.85 to the Cumberland County Tax Claim Bureau for commission.
c) $ 1,697.06 to Bonnie K. Miller, Tax Collector for the current year county and
municipal taxes.
d) $ 273.05 to Lower Allen Township Authority for Refuse and Street Lights.
e) $ 361.00 to Lower Allen Township Authority for Municipal Lien 2010-6864.
f) $ 12,974.14 to Frank D Aungst.
9. Section 205(e) of the Real Estate Tax Sale Law (72 P.S. §5860.101 et. seq.)
provides as follows:
Prior to the actual distribution required by subsection (d), the bureau shall
petition the court of common pleas for a confirmation of distribution. The
petition shall set forth a proposed schedule of distribution for each
account and shall request the court to issue a rule to show cause on each
distributee why the court should not confirm the distribution as proposed.
The rule to show cause and a copy of the petition shall be served by first
class mail upon each distributee and upon the purchaser, with proof of mailing
to the last residence or place of business of the distributee known to the
bureau and to the purchaser at the address given to the bureau. If the
rule to show cause is not returned by any distributee or purchaser on or
before the time set for its return, the court shall forthwith confirm the
distribution absolutely. If any distributee or purchaser makes a return
of the rule within the time set by the court, the court shall forthwith hear
any objections and exceptions to the proposed distribution and thereafter
adjust the schedule of distribution as it deems just and equitable according
to law and confirm the distribution absolutely as adjusted. An absolute
confirmation of distribution by the court shall be final and nonappealable
with respect to all distributees listed in the petition.
10. Your petitioner respectfully requests that the Rule be Returnable on or after
January 14, 2011 in order to allow service thereof.
11. Your Petitioner further requests that a copy of the Court's Rule to Show
Cause also be served upon the following by United States first class mail by

PETITION FOR DISTRIBUTION OF SALE PROCEEDS
1. Petitioner is the Cumberland County Tax Claim Bureau (hereinafter called
"Bureau") created under the provisions of the Real Estate Tax Sale Law of the
Commonwealth of Pennsylvania, Act 542 of July 7, 1947, P.L. 1368, as amended
72 P.S. § 5860.101 et sic.
2. On September 16, 2010 the Bureau held an Upset Tax Sale and successfully sold
a parcel of real estate owned by Columbia Bank, formerly Shaull's Choice
Development, located at 765 E Lisburn Road, Upper Allen Township, Cumberland
County, Pennsylvania, known in Book 2010, Page 20911.
3. At said Upset Sale, the property of Columbia Bank, formerly Shaull's Choice,
known as parcel number 42-11-0272-140 was sold for $250,000.00 a price in
excess of the minimum bid acceptable to the Bureau, to Moyer and Pletcher
Development LLC, 156 Creekside Drive, Enola, Pennsylvania who paid said
purchase price to the Bureau at time of sale.
4. On November 1, 2010 the Purchaser, Moyer & Pletcher Development Group LLC,
assigned their bid to The Columbia Bank. Said assignment was filed November 1,
2010 to the above captioned case number.

5. Currently there are delinquent real estate taxes, interest and costs on said property
due to the Tax Claim Bureau in the amount of $14,070.61. A tax lien certificate is
attached hereto as Exhibit "A".
6. As outlined on the Schedule of Distribution attached as Exhibit "B" and a lien
search attached as Exhibit "C", there are other liens as follows:
a. Current year county and municipal real estate taxes in the amount of
$7,501.71 due and payable to Dennis Zerbe, Upper Allen Township
Collector. If said taxes are not paid to tax collector by December 31, 2010,
said taxes will be turned over to Tax Claim Bureau.
b. Mortgage to Columbia Bank in the amount of $1,969,500.00 recorded June
5, 2006 in Book 1953, Page 1684. Subject to and together with rights set
forth in Subordination Agreement with Chesapeake Fifth Avenue Partners,
LLC recorded June 5, 2006 in Book 727, Page 3302.
c. Mortgage to Chesapeake Fifth Avenue Partners, LLC in the amount of
$3,850,000.00 recorded June 5, 2006 in Book 1953, Page 1721. Subject to
and together with rights set forth in Subordination Agreement with
Chesapeake Fifth Avenue Partners, LLC recorded June 5, 2006 in Book
727, Page 3302.
d. Judgment entered by Mary Holder Holtzman, ET AL in the amount of
$505,000.00 and recorded July 1, 2008 to docket number 2008-02251.
e. Foreclosure judgment entered by The Columbia Bank in the amount of
$2,305,834.92 and recorded November 24, 2009 to docket number 2009-
8159. (Liens listed under b, c & d divested by foreclosure action)
f. Corporation Taxes due to the Commonwealth of PA Bureau of Compliance
in the amount of $712.00 filed under box number 2315221.
7. Distribution of sale proceeds by the Bureau is controlled by 72 P.S. §5860.205(d)
according to the following priority:
(1) First, to the Commonwealth, by payment to the State Treasurer through the
Department of Revenue, for satisfaction of tax liens of the Commonwealth
only if the total amount of such liens or such portion thereof have been included
in the purchase price and paid by the purchaser or the property is sold at judicial
sale pursuant to this act.

(2) Second, to the respective taxing districts in proportion to the taxes due
them.
(3) Third, to taxing districts or municipal authorities for satisfaction of
municipal claims.
(4) Fourth, to mortgagees and other lien holders, in order of their priority,
for satisfaction of mortgages and liens as they may appear of record,
whether or not discharged by sale.
(5) Fifth, to the owner of the property.
8. As outlined on the Schedule of Distribution attached hereto as Exhibit B,
commission is due to the Tax Claim Bureau in the amount of $11,842.10 which is
5% of the excess monies after taxes collected at time of sale as referenced in
72 P.S.§5860.205(c).
8. Petitioner proposes that the $259,126.50 of net proceeds of this Upset Sale be
distributed as follows:
a) $ 712.00 PA Department of Revenue, Bureau of Compliance.
b) $14,070.61 to the Cumberland County Tax Claim Bureau for delinquent real
estate taxes.
c) $11,842.10 to the Cumberland County Tax Claim Bureau for commission.
d) $7,501.71 to Dennis Zerbe, Tax Collector for the current year real estate
taxes if not yet returned to the Bureau. If so returned, $7,501.71 to the
Cumberland County Tax Claim Bureau.
e) $225,000.08 to The Columbia Bank, owner of the property as of the day of
tax sale.
9. Section 205(e) of the Real Estate Tax Sale Law (72 P.S. §5860.101 et. seq.)
provides as follows:
Prior to the actual distribution required by subsection (d), the bureau shall
petition the court of common pleas for a confirmation of distribution. The
petition shall set forth a proposed schedule of distribution for each
account and shall request the court to issue a rule to show cause on each
distributee why the court should not confirm the distribution as proposed.
The rule to show cause and a copy of the petition shall be served by first
class mail upon each distributee and upon the purchaser, with proof of mailing
to the last residence or place of business of the distributee known to the
bureau and to the purchaser at the address given to the bureau. If the
rule to show cause is not returned by any distributee or purchaser on or
before the time set for its return, the court shall forthwith confirm the
distribution absolutely. If any distributee or purchaser makes a return
of the rule within the time set by the court, the court shall forthwith hear
any objections and exceptions to the proposed distribution and thereafter

adjust the schedule of distribution as it deems just and equitable according
to law and confirm the distribution absolutely as adjusted. An absolute
confirmation of distribution by the court shall be final and nonappealable
with respect to all distributees listed in the petition.

January 1f2011 in order to allow service thereof.
