DECEASED AGREEMENT AMONG HEIRS TO ESTATE THIS AGREEMENT is made the year and date written below by and among the children of Charlotte Koser, deceased. WHEREAS, Charlotte Koser died intestate on June 6, 2010 in Harrisburg, Dauphin County, Pennsylvania; and, WHEREAS, the sole heirs of the decedent are the children of Charlotte loser, who are: James Koser, Jerry Kennedy, Tina Toombs, Paul Weigle and Tara Jo ~ es; and, ~, WHEREAS, the\children of Charlotte Koser have agreed that Tina Toom~s shall serve as the sole Executrix of the Estate of Charlotte Koser; and, WHEREAS, the children of Charlotte Koser wish to carry out what they believe to be their mother's intentions regarding her estate, even though the deceden of ~. ~, 00 tea m ,.~.~ ..` ~ ` have an opportunity to execute her Last Will and Testament; and, ~ c ~ ~ v ~: Cia WHEREAS, Charlotte Koser owned real estate situatle at 116 Elm S ,,. r O 3 ~ --n Carlisle, Pennsylvania, at the time of her death; and, ~ I _ ~ ";~ ' , o WHEREAS, Tara Jones is presently afull-time student who lived with Koser prior to Charlotte Koser's death; and WHEREAS, Tara Jones assumed a lot of the responsibility for the care of her mother; and, WHEREAS, Charlotte Koser maintained a deposit account at Members Federal Credit Union at the time of her death, which the heirs understand to contain the sum of $5,000.00 which is the property of Charlotte's sister, Darlene Hockenberr~ and I Barbara Zimmerman. _i NOW, THEREFORE, the children of Charlotte Koser, intending to be legally bound hereby, do covenant and agree as follows: 1. The assets of the estate shall be reduced to cash and deposited estate account bearing the name of Charlotte Koser. 2. The sum of $5,000.00 shall be paid equally to Darlene Barbara Zimmerman from the estate checking. account as a reimbursement to decedent owed to her sisters. 3. The expenses of administration shall be paid from the estate account. 4. Tara Jones shall be permitted to reside in Charlotte Koser's house at 116 Elm Street, Carlisle, for a period of nine months from June 6, 2010. 5. Tara Jones shall be required to keep the property clean and safe shall protect the other children's interest in the property while Tara Jones fives tF 6. During Tara's occupation of the property the estate shah pay the an and the located estate taxes, maintenance and property insurance on the residence. In addition, the estate shall pay the reasonable expenses to supply electric and heat within the hpme 7. On or before March 6, 2011, Tara Jones shall be required to vacat~ the Property 8. At such time as Tara Jones vacates the property, the property shall be sold and the proceeds deposited into the estate checking account. 9. Tara Jones shall not be required to reimburse the estate for the mo ies the estate pays under paragraph five of this agreement. ~i, 14 The sum of money in the estate checking account at the conclusicpn of the administration of the estate shall be divided equally among the five children of Charlotte Koser.
