Varner, mother, on behalf of Aiden Grant Serkis, by and through her attorney, Stacy B. Wolf, Esquire, hereby presents this petition requesting that this Court order a change of Aiden Grant Serkis' name, pursuant to 54 Pa. C.S. § 701 et seq., and in support thereof makes the following averments: 1. Petitioner, Rhonda J. Varner, is the mother of the minor child, Aiden Grant Serkis, who is the subject of the instant petition. 2. Petitioner has been a resident of Cumberland County continuously for the past year. 3. Aiden Grant Serkis was born on August 16, 2007. 4. During the five years preceding the filing of this petition (since his birth) down to and including the date thereof, Aiden Grant Serkis has resided continuously at the following locations: (a) 433 North Hanover Street #7, Carlisle, Pennsylvania - November 2009 to Present; (b) 1049 Grahams Wood Road, Newville, Pennsylvania - October 2008 to November 2009; and (c) 759 Hamilton Court, Carlisle, Pennsylvania - birth to October 2008. 6' 'V9011 Petitioner was not married to Ryan W. Serkis, the person named as father on the child's Birth Certificate. 6. Petitioner has always been the child's primary caretaker and because of her very close relationship with the child desires for the child to have her last name of Varner. 7. The child has had significantly less contact with Father than with Mother and has no contact with Father's family. 8. When the child starts school, the proper name for the child will have significant impacts as he develops relationships with other children. 9. The granting of the instant relief would enable the child to avoid unnecessary embarrassment and confusion as to whose name he bears. 10. Petitioner requests that the child's name be changed from Aiden Grant Serkis to Aiden Grant Varner. 11. The reason for the requested change of name is the following: (a) The child has always had the most contact with his Mother, Rhonda J. Varner, as she has been his primary caretaker. (b) Ryan W. Serkis is the child's natural father and does consent to the name change. WHEREFORE, Petitioner, Rhonda J. Varner, respectfully prays that this Honorable Court enter an order fixing a time for a hearing on the instant petition before this Court, no less than one month, nor more than three months from the filing of the instant petition, and that after hearing, that this Honorable Court issue an Order authorizing the change of the child's name to Aiden Grant Varner along with any additional relief that the Court may deem appropriate and just.
