Sheibley, trading as and doing business as 206 DESIGN, by and through counsel of Andrew C. Sheely, Esquire, hereby files this Complaint, and respectfully states as follows: 1. Plaintiff, Gregg A. Sheibley, trading and doing business as "206 DESIGN", (hereinafter "206 DESIGN") operates a graphic design and printing business at 5264 East Trindle Road, Mechanicsburg, Cumberland County, Pennsylvania. 2. Defendant, William Georges, (hereinafter "Defendant Georges") is an adult individual residing at 607 Park Avenue, New Cumberland, Pennsylvania, operating under various business names and is engaged in the business of apparel design, manufacturing and sales doing business in the United States, including Cumberland County, Pennsylvania. 3. In September of 2009, Defendant Georges contacted 206 DESIGN requesting that 206 DESIGN prepare and print certain large formatting, including window perf, large canvas prints and fabric panels, for the benefit of Defendant Georges business operations. 4. In late October of 2009, 206 DESIGN completed the requested large formatting advertisements and issued invoice number 306 in the amount of One Thousand Seven Hundred Eight Dollars and Two Cents ($1,708.02). 5. All materials completed by 206 DESIGN were completed in a quality and workmanlike manner. 6. All materials completed by 206 DESIGN were obtained by Defendant Georges at the 206 DESIGN office in Mechanicsburg, Pennsylvania. 7. Plaintiff 206 DESIGN and Defendant Georges transacted business in the ordinary course of business for many years, including the transaction set forth herein. COUNT 1 -BREACH OF AGREEMENT 206 DESIGN v. WILLIAM GEORGES 8. Defendant Georges agreed to pay the invoice as described above and offered to pay 206 DESIGN a greater amount than billed due to the quality and timeliness of the services provided. 9. After repeated demands, Defendant Georges has refused to pay 206 DESIGN for services rendered as described above and Defendant Georges owes Plaintiff 206 Design an amount of One Thousand Seven Hundred Eight Dollars and Two Cents ($1,708.02). WHEREFORE, 206 DESIGN demands judgment against Defendant Georges in the amount of One Thousand Seven Hundred Eight Dollars and Two Cents ($1,708.02), together with costs, an amount requiring compulsory arbitration. 2 COUNT 2 -UNJUST ENRICHMENT 206 DESIGN v. The allegations contained in paragraph 13 of Defendant's New Matter are conclusions of law to which no response is necessary. To the extent a response is necessary, Plaintiff and Defendant were independent contractors and Plaintiff was contacted by Defendant to perform the graphic design services set forth in the underlying Complaint. 14. Admitted in Part/Denied in Part. It is admitted that Defendant operated a business and used several large worktables in association with his business. Plaintiff is without sufficient information to determine whether or not the tables were worth $300.00 each and therefore the allegations as to value are denied and strict proof demanded thereof at trial or hearing. 15. To the contrary, Defendant represented that his lease of commercial space in New Cumberland, Pennsylvania was being terminated and inquired if Plaintiff was interested in obtaining the tables as Defendant no longer had any use of the tables. 16. It is denied that Plaintiff agreed to complete work for Defendant in exchange for the tables and strict proof thereof demanded at hearing, trial or otherwise. 17. To the contrary, Plaintiff submitted a reasonable bill to the Defendant for the work completed by Plaintiff and for which the Defendant agreed to pay. 20. To the contrary, no agreement existed between Plaintiff and Defendant to accept the tables in lieu of work performed by Plaintiff.
