STIFVLATION AGAINST LIENS
THIS AGRnmaxT made this :20 day of Sebt--- , 2010, by
and between Fred A. Tiday Builders, Inc. a Pennsylvania
corporation, hereinafter referred to as Contractor,
AND
Corey L. Basehore and Lynn A. Basehore, husband and wife,
hereinafter referred to as Owners,' whereby the contractor
undertook and agreed to erected and construct a dwelling on the
certain lot of ground situate in Hampden Township, Cumberland
County, Commonwealth of Pennsylvania, and more fully described in
Exhibit °A" which is attached hereto and made a part hereof and
known as Lot 29 Eliza Way, Mechanicsburg Hampden Township,
Cumberland County, Pennsylvania.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar
to Contractor in hand paid by owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its,
his or their subcontractors, and all parties acting through or
under them, covenant and agree that no mechanic's liens or claims
shall be filed or maintained by. them or any of them against the
said buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under
them, hereby expressly waive and relinquish the right to have,
file, and maintain any mechanic's liens or claims against the said
buildings or any of them, and agree that this instrument, waiving
the right of lien, shall be an independent covenant.

acknowledged himself to be the President of Fred A. Tiday Builders, Inc. and

instrument for the purposes therein contained by signing the name of the said
Corporation by himself as such President.

ALL THAT CERTAIN tract of land situate in Hampden Township, Cumberland County,
Pennsylvania, in accordance with a plan entitled " Final Subdivision Plan for Watts
Tract" dated 8/19/99 and last revised 7/25/00 and designated as Unit 29, more
particularly bounded and described, as follows:
BEGINNING at an iron pin to be set located along the western right of way line of Eliza
Way at the dividing line between Unit 29 and Unit 30 as shown on the above said plan;
thence along Unit 30, North 84 degrees 13 minutes 18 seconds West, a distance of
184.79 feet to an iron pin to be set along lands now or formerly of James R. and
Melinda H. Ritz; thence along said lands of Ritz and also along lands now or formerly of
Barry T. and Cynthia A. Lyons, North 05 degrees 47 minutes 04 seconds East, a distance
of 285.52 feet to an iron pin to be set at the dividing line between Unit 28 and Unit 29;
thence along Unit 28, South 84 degrees 13 minutes 18 seconds East, a distance of
184.76 feet to an iron pin to be set along the western right of way line of Eliza Way;
thence along the western right of way line of Eliza Way, South 05 degrees 46 minutes
42 seconds West, a distance of 285.52 feet to an iron pin to be set at the dividing line
between Unit 29 and Unit 30, the Place of BEGINNING.
CONTAINING 1.211 acres or 52,758 square feet more or less.
UNDER AND SUBJECT to the Declaration of Pinehurst Hills, a Planned Community, dated
September 7, 2000 and recorded September 15, 2000 in Cumberland County Misc.
Book 654, Page 1002. Note in particular Paragraph 9.01( r) of the Declaration as it
pertains to certain lots.
UNDER AND SUBJECT to conditions set forth on Plan Book 81, Page 99 including but not
limited to setbacks and limitations as to areas of fill on Unit 7.
FURTHER UNDER AND SUBJECT to restrictions, reservations, easements and conditions of
record.
