Masland,, F- I r LICENSING, `? Appellee MOTION TO CONTINUE LICENSE SUSPENSION APPEAL HEARING-" --? AND NOW comes the Appellant, Jeffrey Joseph Favoroso, by and through his attorney, Karl E. Rominger, Esquire, and avers the following: 1. A hearing is currently scheduled on Petitioner's Appeal from License Suspension for June 27, 2011. 2. Undersigned counsel previously subpoenaed Trooper Ronald C. Carey, with the Pennsylvania State Police and was informed by Sgt. Line that Trooper Carey was unavailable to attend as he was on previously scheduled vacation, and requested that the hearing be rescheduled to a Monday, Tuesday or Wednesday. 3. Undersigned counsel petitioned this court for a continuance and the Honorable Albert H. Masland granted undersigned counsels continuance and rescheduled the hearing for the above mentioned date. 4. Undersigned counsel served a second subpoena on Trooper Ronald C. Carey, with the Pennsylvania State Police and was informed by Sgt. Line that Trooper Carey was unavailable as he is scheduled for several preliminary hearings in front of Magistrate District Judge Harold Bender. 5. The Commonwealth was contacted by way of Philip Bricknell, Esquire and he concurs with this continuance request. WHEREFORE, Petitioner respectfully requests that this Honorable Court continue the hearing currently scheduled and direct that Trooper Ronald C. Carey be attached to the rescheduled date and time.
