Coy, spouse of decedent, is named as primary executrix in Paragraph Sixth of the last will and testament of decedent dated April 12, 1972; however, she predeceased decedent. Victorio J. Mozingo, a surviving daughter of decedent, is named as successor executrix in Paragraph Sixth of the last will and testament of decedent; however, she has executed a renunciation dated September 20, 2010, in favor of petitioner. Dennis Coy, surviving son of decedent, has also executed a renunciation dated September 20, 2010, in favor of petitioner. 'there are no other surviving children of decedent. There is rno codicil to the last will and testament of decedent. Except as follows, Decedent did not marry, was not divorced, and did not have a child bom or adopted after execution of the intstrument offered for probate, was not the victim of a killing and was never adjudicated an incapcita#ed person: None applicable.
