AND NOW, this ~Uday of October, 2010, the appointment of Mark Bayley, Esquire,
counsel for Viola Rose Whitley, is hereby VACATED.
Michael A. Scherer, Esquire, shall select a qualified evaluator near Ruffin, North
Carolina to perform the evaluation. The selection of the evaluator shall occur on or before
October 25, 2010 and the evaluation shall occur within ninety (90) days of this Order. All
parties responsible for the care, custody and control of Viola Rose Whitley are directed to make
Viola Rose Whitley available for such evaluation.
