BOX 557 208 RIDGE HILL ROAD NEW CUMBERLAND, PA 17070-0557 DEFENDANT IN THE COURT OF COMMON PLEAS OF CUMBERLAND COUNTY CIVIL DIVISION DOCKET NO.: COMPLAINT NOW COMES, the Plaintiff by and through its Attorney, Robert M. Cohen, Esquire and hereby complains as follows: 1. The Plaintiff is AMERICAN CREDIT & COLLECTIONS, LLC, a Pennsylvania Limited Liability Company with a mailing address located at P.O. Box 264, Taylor, Lackawanna County, Pennsylvania and offices located at 921 Oak Street, Scranton, Lackawanna County, Pennsylvania. 2. The Defendant is Christopher Mummert, an adult individual, who currently resides at 208 Ridge Hill Road, in New Cumberland, Cumberland County, Pennsylvania, 17070. COUNTI-CONTRACT 3. Defendant applied for and received a credit card with CHASE, USA NA bearing the account number (5401683042853959), on or about May 15, 2003. 4. Defendant made use of said credit card, thus accepting the offer of credit, and has a current balance due of Twenty Seven Thousand Nine Hundred Thirty Seven Dollars and Seventy Cents ($27,937.70) as October 14, 2010. See Cardmember Agreement, the writing governing the terms of the extension of credit, attached as Exhibit "A" and monthly statements, collectively attached as Exhibit "B". 5. Defendant is in default of aforesaid Agreement, as of January 20, 2008, by failing to make required monthly payments when due. As such, the entire balance is immediately due and payable to Plaintiff, pursuant to said agreement. 6. Plaintiff purchased the Defendant's debt on January 22, 2010. See Plaintiff's Bill of Sale and Chain of title, collectively attached as Exhibit "C". 7. Plaintiff is entitled to the addition of interest pursuant to Exhibit "A", at the conservative rate of 19.99% per annum on the unpaid balance as pre judgment interest from the date of default of January 20, 2008, up to the date of judgment. 8. Although repeatedly requested to do so by Plaintiff, Defendant has willfully failed and/or refused to pay the balance due to Plaintiff, thus damaging Plaintiff. Wherefore, the Plaintiff, AMERICAN CREDIT & COLLECTIONS, LLC, prays for judgment in its favor and against Defendant, Christopher Mummert, individually, in the amount of $27,937.70, with continuing pre judgment interest thereon at the rate of 19.99% per annum from October 14, 2010 up to date of judgment, plus subsequent 6% interest on the judgment obtained, plus costs. COUNT II - ACCOUNT STATED 9. Paragraphs 1-8 are incorporated herein. 10. Defendant received aforesaid monthly statements, and did not timely dispute the charges therein. 11. Defendant made partial payments on the balances then due. 12. The account stated was impliedly accepted by Defendant. Wherefore, the Plaintiff, AMERICAN CREDIT & COLLECTIONS, LLC, prays for judgment in its favor and against Defendant, Christopher Mummert, individually, in the amount of $27,937.70, with continuing pre judgment interest thereon at the rate of 19.99% per annum from October 14, 2010 up to date of judgment, plus subsequent 6% interest on the judgment obtained, plus costs. COUNT III - UNJUST ENRICHMENT 13. Paragraphs 1-12 are incorporated by reference. 14. Alternatively, monetary benefits, with which Defendant purchased goods and services, have been conferred by Plaintiff on Defendant, as stated herein. 15. Defendant has appreciated said benefits, as stated herein. 16. The acceptance and retention of such benefits under these circumstances by Defendant would be inequitable without the payment of value for same. Services of This Account. This Account may be used for purchases from any Salter that accepts the Card and for Advances. 3. To Use Your Card. You must sign the panel on ft back of your Card. Authorized Users of any -additional Card(s) should sign their names on the panel on the back of those Cards. For Purchases, you will have to sign a safes slip that has your name, the Sellers name, and your Accxxrnt number on it, unless you let the Seller complete the sales slip for you. 4. Your Responsf6iotfes forThls Account. You beoorne responsible for Purchases when we receive any type of notice that you or an Authorized User have used the Account. You are respon- sible for all amounts owed on this Account. Authorized Users may be required to repay tics amount owed for the charges they make. 5. Your Credit line. Your credit line is the most you may owe on your Account at any time. You will be told the amount of your crack[ line. You may not use your Account in any way that would cause you to go over your credit line. You may also be asked to immediately pay for any amount over your credit One. We may change your creditfika or separate the amount of your credit line into available credit for Purchases and Advances. If the credit line is changed or limited, you will be ootBed. 6. Ovedimit Fee. It your Account balance (inducing any Fna6e Charges and any fees and charges owed on your Account) is over your crock line at the end of a billing cycle, there will be an Ovedimit Fee as disclosed in Box 10,This fee willbe imposed only once during the biting cycle, but wig be krhposed in each billing cycle that you are over your credit line even if we authorize the trans- action which causes your credit line to be exceeded. 7. Default and Collection Costs. TERMS FOR PURCHASES This Agreement and the General Terms apply to Purchases. You may use your Account to purchase or lease goods and services or for lodging services when making guaranteed reservations or advance deposits. TERMS FOR BALANCEiTRANSFE<RS, ADVANCES AND PURCHASES t. Calculation of the Finance Charge for Balance Transfers, Advances and Purchases. That portion of the Finance Charge which is determined by using the daily Pertocli Rate is calcu- lated separately for BalanceTransfers, Advances and Purchases, but using the same method (gen- erally known as the'average daily balance, Including new transardionernetfwd). Separate average daily balances (which may be referred to as "Finance Charge Balances') are calculated for Balance Transfers, Advances and Purchases, and each stud! balance is nwitiphed by the applicable daily Periodic Rate. Finance Charges accrue beginning on the date the transaction occurs or on the first day"of the billing cycle R is received by us (Michever is later). The Finance Charge on Advances taken with Checks. how+evor, is computed from the day It is added 5o your Account. To determine the .dais balances, for each day in the billing cycle we take the beginning balance to Balance Transfers, Advances and Purchases, add any new Balance Transfers, Advances, Purchases or debits to the appropriate balance, and subtract any payments and credits from the appropriate balance as of that day. For Shell MasterCard accounts only, we will not add to the daily Purchase balance calculation described above any current SHELL gasoline transactions if in the previous billing cycle you paid the amount shown in the box on the front of the statement entitled 'Shell Gasoline No Finance Charge Option' We then add all of the daily balances separately for Balance Transfers, Advances and Purchases (excluding days which end with a credit balance), and divids each sum by the number of days In the billing cycle. This gives us the average daily balance for each. All tees charged 10 your Account are added to the appropriate purchase balance, except for the Service Chargs?ransaction Fee for Advances which is added to the appropriate Advance balance. The daily Periodic Hate and Annual Percentage Rate are disclosed in the appli- cable portion of the Pricing Sdnedule, as may be amended from time to time. These FINANCE CHARGES determined by Periodic Rate for Balance Transfers, Advances and Purchases are added to the Service ChargaIrransacti n Fee for Advances (if any) to get the combined amount of FINANCE CHARGE shown on your statement. For Purchases only, there is a minimum FINANCE CHARGE of fifty cents ($.50) if a Penance Charge for Purchases is imposed. There will not be a Finance Charge on Purchases if you pay at least the 'New Balance shown on your monthly statement less any Advance balance by the "Payment Due Dale'showm on the statement. (This is known as the "grace period:) You may avoid a Finance Charge for Purchases for the first billing cycle in which they are posted to your Aooou nt if that cycle began with a previous balance of zero or is reduced to zero during that cycle by pay- ments or credits. There is no grace period for Transferred Balances (for new accounts only) Balance Transfers (for existing accounts only) unless the terms of the Balance Transfer offer slat( there will be a grace period, and for Advances. 2. Periodic Rate. The daily Periodic Rates applied to the Purchases and Advances average daily balances and the owasponding ANNUAL PERCENTAGE RATES are in the Pridnf Schedule. Where the Pricing Schedule includes "Variable Raii$ Index and Margin' information for i particular rate that applies to your Account, that rate is a variable rate and the disclosures bolos regarding variable rates apply for that rate.
