Plaintiff is Cory Cormany, an adult individual residing in Carlisle, Cumberland County, Pennsylvania. 2. Defendants Karen Finkenbinder and Honorable District Justice Paula Correal are adult individuals res/ding in the Cumberland County area, Pennsylvania. 3. Defendants Shane Cohick, Joseph Hogarth, W/Il/am M/Iler and Jeffery Kurtz are adult individuals residing in the Cumberland County area, Pennsylvania. 4. Plaintiff Cory Cormany is an adult individual employed with Ames Dept. Stores and Allen Distribution posting the matters herein, Carlisle, Pennsylvania. The Plaintiff is a taxpayer, a registered voter and a citizen of Middleton Pennsylvania State University. the United States of America. Plaintiff Cory Co,many is a high school graduate in attending South School District. He is also academically achieved through the 6. On December 1st, of the year 1988, Plaintiff Cory Cormany was wed before Defendant Honorable District Justice Paula Correal. 7. On December 9th, of the year 1993, Plaintiff Cory Cormany addressed a letter to the Chief of Police of the Carlisle Police Department. 8. On February 20th, of the year 1994, Plaintiff Cory CosJiiany addressed a letter to the State Representative of the 86th Legislative District. 9. On April 5th, of the year 1994, Plaintiff Cory Cormany filed a civil/crkninal complaint against the Defendant Karen Finkenbinder of the Carlisle Police Departmem in the Court of Common Pleas Cumberland Cotmty, Pennsylvania, Case Number 94-1679. 10. On April 1 l th, of the year 1994, Plaintiff Cory Cormany addressed a letter to the Family Law Clinic concerning a narcotics offender convicted in the Common Pleas Court of Cumberland County, Pennsylvania. l 1. On May 30th, of the year 1995, Plahatiff Cory Cormany filed a civil/criminal complaint against Defendant Karen Finkenbinder of the Carlisle Police Depeuh~tent in the United State District Court, Pennsylvania, Case Number 1 :CV-95-0844. 12. Prior herein and set forth hereto Plaintiff Cory Cormany was convicted of summary offenses in the Court of Common Pleas Cumberland County, Pennsylvania, case files 93-I078, 93-1079, 94-0973, 94-0974, 95-0027, 96-1584, 97-1449, 97-1450, 97-1451, 97-1452, 97-1504 and 97-1701, No Docket memos. 13. On October 17th, of the year 1995, Plaintiff Coty Cormany filed a civil complaint against Defendant Honorable District Justice Paula Correal in the Court of Common Pleas Cumberland County, Pennsylvania, Case Number 95- 5222. 14. On October 30th, of the year 1995, Plaintiff Coty Cormany filed a petition for expungment in the Court of Common Pleas Cumberland County, Pennsylvania, Case Number 95-0310 15. In and about the month of November, of the year 1995, the Pennsylvania Supreme Court did enter a Praecipe of Appearance on behalf of Defendant Honorable District Justice Paula Correal in the Court of Common Pleas Cumberland County, Pennsylvania, No determination of Judgment at this Time. 16. On February 14th, of the year 1996, Plaintiff Coty Cormany filed a petition for relief amending a civil complaint, case files 94-1222, 95-0375, 95- 0376 and 95-5222, No argument Contended. 17. On April 3rd, of the year 1996, Plaintiff Coty Cormany filed a c/v/l/criminal complaint against Cumberland County Prison Officers in the Court of Common Pleas Cumberland County, Pennsylvania, Case Numbers in question, and proceeded 96-1730. 18. Prior thereto and set forth within Plaintiff Cory Comiany filed a motion for joinder regarding Cumberland County Prison Officers tn the United States District Court, Pennsylvania, Case Number 1 :CV-95-0844. 19. On April 10th, of the year 1996, Plaintiff Cory Cormany filed a civil/criminal complaint against Cumberland County Prison Officers in the Court of Commun Pleas Cumberland County, Pennsylvania, Case Number 96-1969. 20. On August 8th, of the year 1996, Plaintiff Cory Connany filed a civil complaint against a Cumberland County Housing Official in the Court of Common Pleas Cumberland County, Pennsylvania, Case Number 96-4435. 21. On December 3rd, of the year 1996, Defendant Honorable District Justice Paula Correal did proceed a hearing regarding Cumberland County Prison Officers, Docket Numbers NT-0000726-96 and NT-0000727-96. 22. On April 25th, of the year 1997, Plaintiff Cory Cormany proceeded a common pleas affirmation to the Superior Court of Pennsylvania, adjudication files NT-0000726-96 and NT-0000727-96, Case Number 97-0174. 23. On June 21st, of the year 1997, Defendants Karen Finkenbinder, Joseph Hogarth and Shane Cohick of the Carlisle Police Department did proceed criminal incident against Plaintiff Cory Cormany. 24. On June 22nd, of the year 1997, Defendants Karen Finkenbinder, Joseph Hogarth and Shane Cohick of the Carlisle Police Department did secure a warrant causing the issuance ora surety bond. 25. On August 13th, of the year 1997, Defendant Honorable District Justice Paula Correal did proceed a hearing regarding Defendants Karen Finkenbinder, Joseph Hogarth and Shane Cohick of the Carlisle Police Department, Case Number 97-1504. 26. On October 29th, of the year 1997, Plaintiff Cory Cormany was committed to Cumberland County Prison preceding a forma pauperis matter and proceeding a sentence implemented by Defendant Honorable District Justice Paula Correal, no dockets served, Case Numbers 97-1443, 97-1444, 97-1445, 97-1446, 97-1447 and 97-1448. 27. On December llth, of the year 1997, Plaintiff Cory Cormany proceeded a common pleas affn'mation to the Superior Court of Pennsylvania, Case Numbers 97-1443, 97-1444, 97-1445, 97-1446, 9%1447 and 97-1448. 28. On December 17th, of the year 1997, Defendant Honorable District Justice Paula Correal did proceed a hearing, the Plaintiff was not extradited from the Cumberland County Prison to attend, Docket Numbers NT-0001411-97, NT- 0001412-97 and NT-0001424-97. 29. On January 2nd, of the year 1998, Plaintiff Cory Cormany was committed to the Commonwealth of Pennsylvania Department of Corrections pending the solicitation and conspiratorial actions taken by Defendants Karen Finkenbinder, Joseph Hogarth, Shane Cohick of the Carlisle Police Department and Honorable District Justice Paula Correal, Case Number 97-1504. 30. On February 25th, of the year 1998, Plaintiff Cory Cormany, by his Attorney, proceeded a common pleas affirmation to the Superior Court of Pennsylvania, case file 97-1504, Docket Number 00296HBG98. 31. On September 23rd, of the year 1998, Plaintiff Cory Cormany filed a petition for relief along with a criminal complaint against Defendants Karen Finkenbinder, Joseph Hogarth and Shane Cohick of the Carlisle Police Department, an Attorney was appointed, Case Number 97-1504. 32. On December 29th, of the year 1999, Plaintiff Cory Cormany was released from the Commonwealth of Pennsylvania Department of Corrections. 33. On April 18th, of the year 2000, Defendant Honorable District Justice Paula Correal did proceed a hearing regarding Defendant Jeffery Kurtz, Docket Number CR-0000089-00. 34. On May 3rd, of the year 2000, Defendant Honorable District Justice Paula Correal did issue a warrant for arrest committing the Plaintiff Cory Cormany to Cumberland County Prison and proceeding the docket files NT- 0001411-97, NT-0001412-97, NT-0001424-97, NT. O000189-O0, NT-O000190- 00, NT-0000187-00, NT-0000188-00 and NT-0000205-00, No Case Number. 35. On May 10th, of the year 2000, Defendant Honorable District Justice Paula Correal did reschedule a hearing, after releasing the Plaintiff from Cumberland County Prison involving allegations as stated in part, docket files NT-0001411-97, NT-0001412-97, NT-0001424-97, NT-0000189-00, NT- 0000190-00, NT-0000187-00, NT-0000188-00 and NT-O000205-O0, No Case Number. 36. On July 5th, of the year 2000, Defendant Honorable District Justice Paula Correal did reschedule hearings regarding Defendants William Miller and Jeffery Kurtz of the Carlisle Police Department, announcing an additional Carlisle Police Officer, to July 7th, of the year 2000, Docket Numbers NT-0000189-00, NT-0000190-00, NT-0000187-00, NT-0000188-00, NT-0000205-00, NT- 0000770-00, NT.0000748-00 and NT-0000839-00. 37. On July 29th, of the year 2000, Plaintiff Cory Cormany proceeded a notice of appeal in the Court of Common Pleas Cumberland County, Pennsylvania, regard'rog the docket file CR-0000089-00, No Case Number. 38. On July 31st, of the year 2000, Defendant Honorable District Justice Paula Correal did reschedule hearings regarding Defendants William Miller, Jeffery Kurtz and Officer Guido of the Carlisle Police Depamnent to October 1 lth, of the year 2000, Docket Numbers NT-0000189-00, NT-0000190-00, NT- 0000187-00, NT-0000188-00, NT-0000205-00, NT-0000770-00, NT-0000748-00 and NT-0000839-00. 39. On September 19th, of the year 2000, Defendant Honorable District Justice Paula Correal did reschedule hearings regarding Defendants William Miller, Jeffery Kurtz and Officer Guido of the Carlisle Police Department to December 20th, of the year 2000, Docket Numbers NT-0000189-00, NT- 0000190-00, NT-0000187-00, NT-0000188-00, NT-0000205-00, NT-0000770- 00, NT-0000748-00 and NT-0000839-00. 40. On January llth, of the year 2001, Defendant Honorable District Justice Paula Correal did reschedule hearings regarding Defendants William Miller, Jeffery Kurtz and Officer Guido of the Carlisle Police Department to March 15th, of the year 2001, Docket Numbers NT-0000189-00, NT-0000190- 00, NT-0000187-00, NT-0000188-00, NT-0000205-00, NT-0000770-00, NT- 0000748-00 and NT-0000839-00. 41. On January l lth, of the year 2001, Plaintiff Cory Comtany proceeded a notice of appeals in the Court of Common Pleas Cumberland County, Pennsylvania, regarding the docket files NT-0000189-00, NT-0000190-00, NT- 0000187-00, NT-0000188-00, NT-0000205-00, NT-0000770-00, NT-0000748-00 and NT-0000839-00, No Case Number. 42. On January 1 lth, of the year 2001, Defendant Honorable District Justice Paula Correal did reschedule hearings regarding Defendants William Miller, Jeffery Kurtz and Officer Guido of the Carlisle Police Department to March 22nd, of the year 2001, Docket Numbers NT-0000190-00, NT-0000187- 00, NT-O000188-O0, NT-0000205-00, NT-O000770-O0, NT-0000748-00 and NT- 0000839-00. 43. On March.2J~2~ of the year 2001, Plaintiff Cory Cormany filed a criminal complaint against Defendants William Miller, Jeffery Kurtz and Officer Guido of the Carlisle Police Department in the District Attorney's Office of Cumberland County, Pennsylvania. 44. On March 22nd, of the year 2001, Defendant Honorable District Justice Paula Correal did proceed a hearing regarding Defendants William Miller, Jeffery Kurtz and Officer Guido of the Carlisle Police Depmi~nent, docket flies NT-0000189-00, NT-0000190-00, NT-0000187-00, NT-0000188-00, NT- 0000205-00, NT-0000770-00, NT-0000748-00 and NT-0000839-00, No Case Number. 45. The Plaintiff Cory Cormany has suffered public humiliation as caused by the defamation of his character as a result of the Defendant's prejudicial and unconstitutional actions. 46. The Plaintiff Cory Cormany has suffered mental anguish, emotional distress and imprisonment as a result of the Defendant's prejudicial and unconstitutional actions. 47. The Plaintiff Cory Cormany has suffered viral exposure, pain and physical injury as a result of the Defendant's prejudicial and unconstitutional actions. 48. The Plaintiff Cory Cormany has suffered lost wages, benefits, fees and property in the amount and/or in excess of One Hundred Thousand and 00 Dollars (100,000.00) as result of the Defendant's prejudicial and unconstitutional actions. COUNT ONE, CORY A. CORMANY V. KAREN FINKENBINDER CIVIL ACTION - LAW PREJUDICIAL ERROR 49. The averments set forth in Paragraphs one through forty eight (1-48) of the Complaint are incorporated by reference as if set forth at length. 50. The prejudicial issues and crimes are serious as having happened in the Borough of Carlisle, Pennsylvania, respectfully submitted exhibits: A-III 51. Through and about and preceding June 21 st, of the year 1997, and set forth herein the Defendant Karen Finkenbinder did conspire and commit unconstitutional acts against the Plaintiff Cory Cormany. 52. The Pla'mtiff Cory Cormany did suffer pain for injuries felt and sustained, mental anguish, public humiliation, emotional distress, loss of employment and property, confinement and incarceration. 53. By reason of the aforesaid matter, Plaintiff Cory Comiany has suffered pain, injury, mental anguish, public humiliation, emotional distress, loss of employment and property, confinement and incarceration. WHEREFORE, the Plaintiff Cory Cormany, claims from the Defendant in an amount in excess of One Hundred Thousand and 00 Dollars (100,000.00) plus cost of suit. COUNT TWO CORY A. CORMANY V. SHANE COHICK CIVIL ACTION - LAW PREJUDICIAL ERROR 54. The averments set forth in Paragraphs one through forty eight (1-48) of the Complaint are incorporated by reference as if set forth at length. 55. The prejudicial issues and crimes are serious as having happened in the Borough of Carlisle, Pennsylvania, respectfully submitted exhibits: A-III 56. Through and about and proceeding June 21st, of the year 1997, and set forth herein the Defendant Shane Cohick did conspire and commit unconstitutional acts against the Plaintiff Cory Cormany. 57. The Plaintiff Cory Cormany did suffer pain for injuries felt and sustained, mental anguish, public humiliation, emotional distress, loss of employment and property, confinement and incarceration. 58. By reason of the aforesaid matter, Plaintiff Cory Cormany has suffered pain, injury, mental anguish, public humiliation, emotional distress, loss of employment and property, confinement and incarceration. WHEREFORE, the Plaintiff Cory Cormany, claims from the Defendant in an amount in excess of One Hundred Thousand and 00 Dollars (100,000.00) plus cost of suit. COUNT THREE CORY A. CORMANY V. JOSEPH HOGARTH CIVIL ACTION - LAW PREJUDICIAL ERROR 59, The averments set forth in Paragraphs one through forty eight (1-48) of the Complaint are incorporated by reference as if set forth at length. 60. The prejudicial issues and crimes are serious as having happened in the Borough of Carlisle, Pennsylvania, respectfully submitted exhibits: A-III 61. Through and about and proceeding June 21st, of the year 1997, and set forth herein the Defendant Joseph Hogarth did conspire and commit unconstitutional acts against the PlaintiffCory Cormany. 62. The Plaintiff Cory Cormany did suffer pain for injuries felt and sustained, mental anguish, public humiliation, emotional distress, loss of employment and property, confinement and incarceration. 63. By reason of the aforesaid matter, Plaintiff Cory Cormany has suffered pain, injury, mental anguish, public humiliation, emotional distress, loss of employment and property, confinement and incarceration. WHEREFORE, the Plaintiff Cory Cormany, claims fi.om the Defendant in an amount in excess of One Hundred Thousand and 00 Dollars (100,000.00) plus cost of suit. COUNT FOUR CORY A. CORMANY V. WILLIAM MII,LER CIVIL ACTION - LAW PREJUDICIAL ERROR 64. The averments set forth in Paragraphs one through forty eight (1-48) of the Complaint are incorporated by reference as if set forth at length. 65. The prejudicial issues and crimes are serious as having happened in the Borough of Carlisle, Pennsylvania, respectfully submitted exhibits: A-III 66. Through and about and preceding Febmmy 5th, of the year 2000, and set forth herein the Defendant William Miller did conspire and commit unconstitutional acts against the Plaintiff Cory Cormany. 67. The Plaintiff Cory Cormany did suffer pain for injuries felt and sustained, mental anguish, public humiliation, emotional distress, loss of employment and property, confmement and incarceration. 68. By reason of the aforesaid matter, Plaintiff Cory Cormany has suffered pain, injury, mental anguish, public humiliation, emotional distress, loss of employment and property, confinemem and incarceration. WHEREFORE, the Plaintiff Cory Cormany, claims from the Defendant in an amount in excess of One Hundred Thousand and 00 Dollars (100,000.00) plus cost of suit. COUNT FIVE CORY A. CORMANY V. WILLIAM MILLER CIVIL ACTION - LAW PREJUDICIAL ERROR 69. The averments set forth in Paragraphs one through forty eight (1-48) of the Complaint are incorporated by reference as if set forth at length. 70. The prejudicial issues and crimes are serious as having happened in the Borough of Carlisle, Pennsylvania, respectfully submitted exhibits: A-III 71. Through and about and preceding February 19th, of the year 2000, and set forth herein the Defendant William Miller did conspire and commit unconstitutional acts against the Plaintiff Cory Cormany. 72. The Plaintiff Cory Cormany did suffer pain for injuries felt and sustained, mental anguish, public humiliation, emotional distress, loss of employment and property, confinement and incarceration. 73. By reason of the aforesaid matter, Plaintiff Cory Commny has suffered pain, injury, mental anguish, public humiliation, emotional distress, loss of employment and property, confinement and incarceration. WHEREFORE, the Plaintiff Cory Cormany, claims from the Defendant in an amount in excess of One Hundred Thousand and 00 Dollars (100,000.00) plus cost of suit. COUNT SIX CORY A. CORMANY V. JEFFERY KURTZ CIVIL ACTION - LAW PREJUDICIAL ERROR 74. The averments set forth in Paragraphs one through forty eight (1-48) of the Complaint are incorporated by reference as if set forth at length. 75. The prejudicial issues and crimes are serious as having happened in the Borough of Carlisle, Pennsylvania, respectfully submitted exhibits: A-III 76. Through and about and preceding February 5th, of the year 2000, conspire and commit and set forth herein the Defendant Jeffery Kurtz did unconstitutional acts against the Plaintiff Cory Cormany. 77. sustained, mental anguish, public humiliation, emotional employment and property, confinement and incarceration. 78. JEFFERY KURTZ CIVIL ACTION - LAW PREJUDICIAL ERROR 79. The averments set forth in Paragraphs one through forty eight (1-48) of the Complaint are incorporated by reference as if set forth at length. 80. The prejudicial issues and crimes are serious as having happened in the Borough of Carlisle, Pennsylvania, respectfully submitted exhibits: A-III 81. Through and about and preceding February 27th, of the year 2000, and set forth herein the Defendant Jeffery Kurtz did conspire and commit unconstitutional acts against the Plaintiff Cory Cormany. 82. The Plaintiff Cory Cormany did suffer pain for injuries felt and sustained, mental anguish, public humiliation, emotional distress, loss of employment and property, confinement and incarceration. 83. By reason of the aforesaid matter, Plaintiff Cory Cormany has suffered pain, injury, mental anguish, public humiliation, emotional distress, loss of employment and property, confinement and incarceration. WHEREFORE, the Plaintiff Cory Cormany, claims fi.om the Defendant in an amount in excess of One Hundred Thousand and 00 Dollars (100,000.00) plus cost of suit. COUNT EIGHT CORY A. CORMANY V. JEFFERY KURTZ CIVIL ACTION - LAW PREJUDICIAL ERROR 84. The avemtents set forth in Paragraphs one through forty eight (1-48) of the Complaint are incorporated by reference as if set forth at length. 85. The prejudicial issues and crimes are serious as having happened in the Borough of Carlisle, Pennsylvania, respectfully submitted exhibits: A-III 86. Through and about and preceding May 18th, of the year 2000, and set forth herein the Defendant Jeffery Kurtz did consp/re and commit unconstitutional acts against the Pla'mtiff Cory Cormany. 87. The Plaintiff Cory Cormany did suffer pain for injuries felt and sustained, mental anguish, public humiliation, emotional distress, loss of employment and property, confinement and incarceration. 88. By reason of the aforesaid matter, Plaintiff Cory Cormany has suffered pain, injury, mental anguish, public humiliation, emotional distress, loss of employment and property, confinement and incarceration. WHEREFORE, the Plaintiff Cory Cormany, claims from the Defendant in an amount in excess of One Hundred Thousand and 00 Dollars (100,000.00) plus cost of suit. COUNT NINE CORY A. CORMANY V. PAULA CORREAL CIVIL ACTION - LAW PREJUDICIAL ERROR 89. The averments set forth in Paragraphs one through forty eight (1-48) of the Complaint are incorporated by reference as if set forth at length. 90. The prejudicial issues and crimes are serious as having happened in the Borough of Carlisle, Pennsylvania, respectfully submitted exhibits: A-III 91. Through and about and proceeding December 1st, of the year 1988, and set forth herein the Defendant Honorable District Justice Paula Correal did solicit untrue facts and events conspiring to commit unconstitutional acts against the Plaintiff Cory Cormany. 92. The Plaintiff Cory Cormany did suffer pain for injuries felt and sustained, mental anguish, public humiliation, emotional distress, loss of employment and property, confinement and incarceration. 93. By reason of the aforesaid matter, Plaintiff Cory Cormany has suffered pain, injury, mental anguish, public humiliation, emotional distress, loss of employment and property, confinement and incarceration. WHEREFORE, the Plaintiff Cory Cormany, claims from the Defendant in an amount in excess of One Hundred Thousand and 00 Dollars (100,000.00) plus cost of suit. COUNT TEN CORY A. CORMANY V. PAULA CORREAL CIVIL ACTION - LAW PREJUDICIAL ERROR 97. sustained, mental anguish, public humiliation, emotional employment and property, confinement and incarceration. 94. The prejudicial issues and crimes are serious as having happened in the Borough of Carlisle, Pennsylvania, respectfully submitted exhibits: A-III 96. On and about July 24th, of the year 2000, and foregoing March 22nd, of the year 2001, and set forth at length October 17th, of the year 1995, the Defendant Honorable District Justice Paula Correal did continue and adjudicate statutory ramifications with malice and deliberate prejudicial intent to commit crime against the Plaintiff Cory Cormany. The Plaintiff Cory Cormany did suffer pain for injuries felt and distress, loss of 98. On or about June 21st, at approximately 7:00 PM, the Plaintiff, Cory Cormany, was in the Elwood Gardens Apartment Complex emptying a small amount of garbage into a trash dispenser. 2. At or about the aforesaid date and time, the Plaintiff was abruptly and forcibly approached, assaulted and bondaged by the Defendant Michael Cohick. He did ask a question, "What's the problem sir?' 3. The Defendant Cohick did bondage the Plaintiff, pushing him towards and into the trash dispenser, then harshly and rudely into the back of an automobile, twisting and folding his arms and shoulders up behind his back while telling him quote, ~Everything wilt be alright.' 4. At or about June 21st at approximately 7:10 PM, the Defendant Cohick, along with several unidentified individuals did grapple and pummel the Plaintiff out of the automobile while then somewhat carrying him down a flight of stairs into a building. 5. At or about the aforesaid date and time, the Defendant Cohick, along with several unidentified individuals, did beat and force the Plaintiff Cormany onto the floor and over an adjacent table, exercising applied protracted holds until the Plaintiff did spit up and vomit. 6. Prior to the aforesaid incident a_nd about the aforesaid time the Defendant Karen Finkenbinder did give orders to the Defendant Cohick announcing several verbal obscenities. She did say, "I know how to deal with him. We'll put him in a strait jacket.' 7. The Plaintiff was continually bondaged and beaten and forced into protracted situations and was also gagged and probed repeatedly until he was taken to the Cumberland County Prison. 8. The Plaintiff Cormany did sustain and suffer numerous bumps and bruises and a bloody lip and nose. He was suffocated to a degree with adhesive tape and gauze over his mouth and nose. 9. SWORN STATEMENT 1. On or about February 5th, at approximately 3:00 AM, the Plaintiff, Cory Cormany, was walking swiftly home down lrvin Row in the Borough of Carlisle. 2. Prior to the said date and time the Plaintiff was thrown down on the sidewalk along South Hanover Street in the Borough of Carlisle, whereby his head was repeatedly banged off of the sidewalk by an unidentified individual later identified in a contrary and somewhat untrue report as Wayne Zeigler. 3. At or about February 5th, at approximately 3:15 AM, the Plaintiff Cory Cormany was grappled and pummeled in and out of an automobile by several additional unidentified individuals and then forced into a building identified at 52 West South Street. 4. At or about the aforesaid date and time one of the unidentified individuals did assert that the Plaintiff should have medical attention and he was taken by ambulance to the Carlisle Hospital. 5. At or about February 5th, at approximately 3:30 AM, the Defendant Jeffery Kurtz did verbally aggress a series of questions and statements by which the Plaintiff could not accurately comprehend or respond to. 6. Proceeding treatment at the Carlisle Hospital the Plaintiff was again pummeled and grappled and forced in and out of an automobile and then taken back to the 52 West South Street address at which he was stripped of his belongings. 7. The Plaintiff Cory Cormany did remain in a prison cell for an indefinite time period of approximately twelve (12) hours after which time he was freed to leave. 8. On or about February 27th, at approximately 12:30 AM, the Plaintiff, Cory Corm,any, was walking peacefully home along Spring Road in the Borough of Carlisle. 9. At or about the aforesaid date and time the Plaintiff was aggressed upon by the Defendant Jeffery Kurtz while he was holding his hand along side of a firearm. 10. On or about February 27th, at approximately 12:35 AM, the Plaintiff Cory Cormany did turn in fear and proceeded to hurry away from the Defendant. 11. At or about the aforesaid date and time the Plaintiff did hear several loud bangs and did fall to the ground face down covering his head with his hands. 12. On or about February 27th, at approximately 12:40 AM, the Plaintiff Cory Cormany did get back to his feet and not seeing any perpetrators did proceed across the Masland Field relatively quickly. 13. Proceeding hereto several unidentified individuals did approach the Plaintiff from a right angle and did tackle him to the ground and did bondage and grabble him while kicking him in the abdomen and back area. 14. At or about the aforesaid date and time the Defendant Jeffery Kurtz, along with the several unidentified individuals, did forcibly and somewhat did carry the Plaintiff across the Masland Field twisting his arms up behind him and then did put him into the back of an automobile. 15. On or about February 27th, at approximately 1:00 AM, the Plaintiff Cory Cormany was pummeled and grappled out of the automobile and then taken into a building identified at 52 West South Street where he was stripped of his belongings and maneuvered into a prison cell. 16. The Haintiff did remain in a prison cell fbr an indefinite time period of approximately twelve (12) hours after which time another unidentified individual said he was allowed to leave. 17. On or about May 18th, at approximately 9:00 PM, the Plaintiff, Cory Cormany was walking tiredly through the High Street area home from his place of employment. 18. At or about the aforesaid date and time the Plaintiff was verbally aggressed upon by an unidentified individual at which point he took a seat on a park bench in the first block of West High Street. 19. On or about May 18th, at approximately 9:10 PM, the unidentified individual did cease to yell verbal obscenities at the Plaintiff and did pass him while he was seated on the park bench. 20. Proceeding hereto the unidentified individual did continue down along the sidewalk and did perpendicularly cross the High Street meeting a couple other. unidentified individuals. 21. At or about the aforesaid date and time the Plaintiff did get up from the park bench and did proceed the opposite way down the sidewalk away from the suspicious perpetrators. 22. On or about May 18th, at approximately 9:15 PM, the unidentified individuals did grab the Plaintiff Cory Cormany by the shirt tearing it from his shoulders and knocking him to the ground. 23. At or about the aforesaid date and time the perpetrators did jump ontop of the Plaintiff pummeling and grabbling him while the original unidentified individual did again begin to yell obscenities. 24. Proceeding thereto the Plaintiff did push the unidentified individuals off of him and then did quickly proceed down the sidewalk and onto an adjacent street where none of them did seem to proceed to follow. 25. On or about May 18th, at approximately 9:10 PM, the Plaintiff Cory Cormany was trianglulatedly stopped by the Defendant Jeffery Kurtz and several other unidentified individuals. 26. At or about the aforesaid date and time one of the unidentified individuals did assert that the Plaintiff should have medical attention. 5. At or about February 5th, at approximately 3:45 AM, the Plaintiff Cory Cormany was admitted to the Carlisle Hospital for a head injury. 6. Proceeding treatment at the Carlisle Hospital the Plaintiff was again aggressed upon and forced into bondage then taken back to the 52 West South Street address at which he was stripped of his belongings. 7. The Plaintiff Cory Cormany did remain in a prison cell for an indefinite time period of approximately twelve (12) hours after which time he was freed to leave. 8. On or about February 19th, at approximately 11:00 PM, the Plaintiff, Cory Cormany, was walking casually down the sidewalk in the Louther Street area in the Borough of Carlisle, 9. At or about the aforesaid date and time the Plaintiff was ambushed, forcibly bondaged, then pushed into an ambulance. 10. At or about February 19th, at approximately 1 l: 10 PM, the Defendant William Miller removed the Plaintiff from the ambulance and pushed him into an antomobile cresting his forehead in an aggressive manner. 11. At or about the aforesaid date and time several unidentified individuals did grapple and pummel the Plaintiff out of the automobile while .somewhat dragging him into a building identified at 52 West South Street. 12. At or about February 19th, at approximately 11:30 PM, the Defendant William Miller along with several unidentified individuals did strip and threaten the Plaintiff with bodily harm then did push him into a prison ceil. 13. Correal, District Justice for Magisterial District 09-2-01, by her attorney, Howard M. Holmes, makes the following preliminary objections to plaintiff's complaint pursuant to Pennsylvania Rule of Civil Procedure No. Cory A. Cormany has filed a pro se civil suit relief and damages against District Justice Correal for acts allegedly taken in District Justice Correal's judicial capacity. Plaintiff also sues Karen Finkenbinder, Shane Cohick, Joseph Hogarth, William Miller and Jeffery Kurtz, identified as employed by the Carlisle Police Department (Complaint, ~2, 3, 9, 23, 36). 2. Plaintiff's complaint identifies civil and criminal complaints he has filed against various of the defendants in the past (Complaint, ~9, 11, 13, 31, 43), as well as other suits filed against persons not named as defendants herein. {Complaint, ~17-20). Plaintiff's complaint also recites a series of continuances plaintiff alleges were granted in criminal matter involving plaintiff over which District Justice Correal presided. (Complaint, 9435, 36, 38-40, 42). 4. Plaintiff's complaint also identifies cases in which he was tried and apparently found guilty of criminal offenses, some of them allegedly presided over by District Justice Correal. (Complaint, 4412, 21, 25-26, 28-29, 33-34, 44). 5. Plaintiff's complaint alleges a conspiracy among arresting officers and District Justice Correal (Complaint, 429). No facts of any kind are alleged in support of this allegation. 6. Plaintiff alleges he "has suffered public humiliation as caused by the defamation of his character .mental anguish, emotional distress and imprisonment" (Complaint, 4445-46), "viral exposure, pain and physical injury" (Complaint, 447) and "lost wages, benefits, fees and property in the amount and/or in excess of One Hundred Thousand and 00 Dollars" caused by "Defendant's prejudicial and unconstitutional actions." (Complaint, 448). 7. Two counts of the complaint are directed specifically against District Justice Correal. Count Nine, entitled "PREJUDICIAL ERROR" (Complaint, 4489-98) alleges that "Defendant Honorable District Justice Paula Correal did solicit untrue facts and events conspiring to commit unconstitutional acts against the Plaintiff Cory Cormany," causing plaintiff the various injuries he previously alleged. (Complaint, 4492-93). 8. Count Ten (Complaint, 44 94-98), likewise entitled 2 "PREJUDICIAL ERROR" and also specifically directed against District Justice Correal, alleges that "on or about July 24th, of the year 20000, and foregoing March 22nd, of the year 2001, and set forth at length October 17th, of the year 1995" the District Justice "did continue and adjudicate statutory ramifications with malice and deliberate prejudicial intent to commit crime against the Plaintiff Cory Cormany." (Complaint, 996). 9. Defendant, District Justice Paula P. Correal, objects to plaintiff's complaint and the claims against her pursuant to Pennsylvania Rule of Civil Procedure No. 1028(a) (1) and (4) on the following grounds: I. LACK OF JURISDICTION OVER THE SUBJECT MATTER OF THE COMPLAINT 10. The averments of paragraphs 1 through 9 above are realleged and incorporated herein by reference as if fully set forth. 11. The doctrines of judicial and official immunity are absolute jurisdictional bars to plaintiff's claim for damages against District Justice Correal. Wherefore, movant requests that plaintiff's claims against her be dismissed with prejudice pursuant to Pennsylvania Rule of Civil Procedure No. 1028(a) (1). II. INTRODUCTION 1. The present claim is brought pro se by plaintiff, Cory A. Cormany, against numerous defendants including several police officers of the Carlisle Police Department and District Justice Paula Correal. 2. Although plaintiffs Complaint is extremely vague, plaintiff seems to be alleging that defendants conspired against him resulting in numerous arrests, criminal charges and ultimately convictions from 1996 to the year 2000. There are absolutely no facts presented explaining the basis for these averments. II. PRELIMINARY OBJECTIONS A. DEMURRER-PLAINTIFF FAILS TO SET FORTH A CAUSE OF ACTION AGAINST DEFENDANTS 1. Defendants incorporate herein by reference each of the foregoing paragraphs as though set forth at length. 2. Plaintiff appears to assert claims for "conspiracy" and the commission of "unconstitutional acts" against Defendants Karen Finkenbinder, Shane Cohick, Joseph Hogarth, William Miller and Seffery Kurtz. 3. Rule 1028(a)(4) of the Pennsylvania Rules of Civil Procedure permits the filing of preliminary objections for "legal insufficiency of a pleading (demurrer)." -3- 4. Plaintiff fails to set forth a cause of action for conspiracy against defendants because plaintiffs Complaint fails to set forth any facts in support ora legal finding of conspiracy. 5. Alternatively, a more liberal reading of Plaintiffs Complaint may cause this Court to find that plaintiff appears to be pleading a claim for false arrest. 6. Assuming plaintiff has asserted such a claim, it would fail as a matter of law, as a person convicted of a crime is barred from asserting a claim of false arrest unless and until the conviction has been overturned on appeal.~ WHEREFORE, pursuant to Pa. R. Civ. P. 1028(a)(4), defendants respectfully request that plaintiffs Complaint be dismissed in its entirety with prejudice as against defendants Karen Finkenbinder, Shane Cohick, Joseph Hogarth, William Miller and Jeffery Kurtz, and that judgment be entered in their favor and against plaintiff, together with costs, disbursements, attorney's fees and any further relief deemed appropriate by this Court. ~ Presumably, the time for which plaintiff could have appealed most, if not all, of the convictions that form a basis for this action, have long since passed. Likewise, it is clear that plaintiffs claims are barred by Pennsylvania*s two year statute of limitations for tort actions, which include claims of false arrest and/or malicious prosecution. S~e 42 Pa.C.S.A. § 5524. Accordingly, plaintiffs claims additionally are time barred in whole or in part and should be dismissed. -4- B. PLAINTIFF'S COMPLAINT VIOLATES THE RULES OF THIS COURT I. Defendants incorporate herein by reference each of the foregoing paragraphs as though set forth at length. 2. Rule 1019(a) of the Pennsylvania Rules of Civil Procedure states that pleadings shall contain "the material facts in which a cause of action or defense is based." 3. Plaintiff's Complaint fails to set forth material facts upon which this purported claim for conspiracy and/or false arrest is based, in violation of Rule 1019(a). 4. Rule 1019(b) of the Pennsylvania Rules of Civil Procedure states, in pertinent part, that "averments of fraud or mistake shall be averred with particularity." 5. Plaintiffs claim, which appears to be alleging that defendants acted with fraud in conspiring as well as unjustly accusing and/or arresting plaintiff, contains no facts whatsoever to support such averments in violation of Rule 1019(b). 6. Accordingly, plaintiffs Complaint fails to comport with the rules of this Court. WHEREFORE, pursuant to Pa. R. Civ. P. 1028(a)(2), defendants respectfully request that plaintiffs Complaint be dismissed in its entirety with prejudice as against defendants Karen Finkenbinder, Shane Cohick, Joseph Hogarth, William Miller and Jeffery Kurtz, and that judgment be entered in their favor and against plaintiff, together with costs, disbursements, attorney's fees and any further relief deemed appropriate by this Court. -5- C. DEFENDANTS' MOTION TO STRIKE COMPLAINT FOR SCANDALOUS OR IMPERTINENT MATTERS 1. Defendants incorporate herein by reference each of thc foregoing paragraphs as though set forth at length. 2. Rule 1028(a)(2) of the Pennsylvania Rules of Civil Procedure permits the filing of preliminary objections for the "inclusion of scandalous or impertinent matter." 3. The averments in paragraphs 15 through 20 of plaintiffs Complaint contain scandalous and/or impertinent matters that are wholly irrelevant and immaterial to plaintiffs purported causes of action. 4. Accordingly, defendants move to strike paragraphs 15 through 20 of plaintiff's complaint for containing scandalous and/or impertinent matters. WHEREFORE, pursuant to Pa. R. Civ. P. 1028(a)(2), defendants respectfully request that plaintiff's Complaint be dismissed in its entirety with prejudice as against defendants Karen Finkenbinder, Shane Cohick, Joseph Hogarth, William Miller and Jeffery Kurtz, and that judgment be entered in their favor and against plaintiff, together with costs, disbursements, attorney's fees and any further relief deemed appropriate by this Court. -6- D. DEFENDANTS' MOTION FOR MORE SPECIFIC PLEADINGS 1. Defendants incorporate herein by reference each of the foregoing paragraphs as though set forth at length. 2. Pule 1028(a)(3) permits the filing of preliminary objections for "insufficient specificity in a pleading." 3. Plaintiffs Complaint fails to provide relevant facts to support averments of"conspiracy" and "unconstitutional acts," much less, inform defendants or this Court of specifically what it is defendants are alleged to have done. 4. Further, a cause of action based on "unconstitutional acts" is not specific enough to enable defendants to properly prepare responsive pleadings or defenses. 5. Accordingly, in the event that plaintiffs Complaint is not dismissed with prejudice, defendants respectfully request that this Court compel plaintiff to file a more specific pleading setting forth, in detail, sufficient facts to not only support a purported claim, but also to inform defendants of the nature of the claim and supporting facts asserted against them. WHEREFORE, pursuant to Pa. R. Civ.
