FAMILY SETTLEMENT AGREEMENT ~`~
THIS AGREEMENT, made and executed this dt4c* day of ~~p~-~~+ , 2010, by and
between Donald Mark Hess, individually and as Co-Executor of the Last Will and Testament of Laura B.
Hess, a/k/a Laura Belle Hess, a/k/a Laurabelle Hess, of 919 Mount Vernon Avenue, Huntingdon, PA
16652; Linda M. Stolte, individually and as Co-Executrix of the Last Will and Testament of Laura B.
Hess, a/k/a Laura Belle Hess, a/k/a Laurabelle Hess, of 46 Jamestown Road, Shippensburg, Pennsylvania
17257.
WHEREAS, Laura B. Hess, a/k/a Laura Belle Hess, a/k/a Laurabelle Hess, died on December
26, 2009, a resident of Shippensburg Borough, Cumberland County, Pennsylvania, first having made her
Last Will and Testament dated March 22, 2005, wherein she appointed Donald Mark Hess and Linda M.
Stolte as Co-Executors thereof; and
WHEREAS, Letters Testamentary on the Estate of Laura B. Hess, a/k/a Laura Belle Hess, a/k/a
Laurabelle Hess, were issued to the said Donald Mark Hess and Linda M. Stolte by the Register of Wills
of Cumberland County on January 15, 2010; and
WHEREAS, the said Co-Executors have fully administered the Estate of Laura B. Hess, a/k/a
Laura Belle Hess, a/k/a Laurabelle Hess, and have prepared a First and Final Account and Schedule of
Proposed Distribution, true and correct copies of which are annexed hereto and made a part hereof; and
WHEREAS, by the terms of Paragraph Second of Decedent's Last Will and Testament, the
entire residue of Decedent's Estate was bequeathed in equal shares to her children, Donald Mark Hess
and Linda M. Stolte, who are the parties to this Agreement.
NOW, THEREFORE, WITNESSETH, that the parties hereto, intending to be legally bound
hereby, covenant and agree as follows:
Each of the parties hereby acknowledges that he or she has fully and carefully examined
the First and Final Account and Schedule of Proposed Distribution of Donald Mark Hess and Linda M.
Stolte, Co-Executors of the Last Will and Testament of Laura B. Hess, a/k/a Laura Belle Hess,. a/k/a
Laurabelle Hess, and each approves such document. Each of the parties hereto acknowledges that he or
she has received true and correct copies of this Agreement and the First and Final Account and Schedule
of Proposed Distribution.
2. In consideration of the receipt by each of the parties from Donald Mark Hess and Linda
M. Stolte, Co-Executors, of the funds awarded to them in the Schedule of Proposed Distribution, in full
satisfaction and payment of all such charges, each of the parties hereto does, by these presents, remise,
release, quit-claim and forever discharge the said Donald Mark Hess and Linda M. Stolte, Co-:Executors,
and Thomas E. McDowell, Esquire, and BMZ Law, their heirs, executors, administrators, successors and
assigns, of and from all actions, suits, payments, accounts, reckonings, claims and demands whatsoever,
for or by reason thereof, or of any other action, matter, cause or thing whatsoever.
3. This Agreement is a full and final Family Settlement Agreement by and between the
parties hereto, both fiduciary and individuals, having been arrived at, concluded and executed after a full
and complete disclosure of the assets of the said Estate and the rights of the parties hereto, and each of
the parties agrees to abide by the terms hereof.
4. All of the parties hereto do agree that they will at all times in the future and whenever
necessary appropriate, make, execute and deliver to Donald Mark Hess and Linda M. Stolte, Co-
Executors, or their successors, any and all instruments, documents, conveyances, deeds, releases or other
instruments necessary or convenient to carry out the intention of this Agreement and/or to permit, assist
and enable the said Co-Executors to fulfill their duties as Co-Executors.
5. Each of the parties hereto agrees if the Estate of Laura B. Hess, a/k/a Laura Belle Hess,
a/k/a Laurabelle Hess, or Donald Mark Hess or Linda M. Stolte, Co-Executors, should become liable for
the payment of any obligation, charge, tax or other debt, either before or after distribution of the funds
indicated herein, each such party shall reimburse the said Co-Executors his or her prorata share of such
charge.
6. This Agreement constitutes the entire understanding between the parties hereto and each
of them acknowledges that no representations or statements of any kind, written or oral, have been made
to them or any of them prior hereto by the Co-Executors or any other person or party on their behalf.
IN WITNESS WHEREOF, the parties have hereunto set their hands and affixed their seals the
day and year first above written.
