The Petition of the undersigned respectfully represents that: Your Petitioner is 18 years of age or older and is the Executor named in Paragraph 6 of the last Will of the above decedent, dated August 24, 1995. Decedent was domiciled at death in Cumberland County, Pennsylvania, with his last address at 239 N. 25th Street, Camp Hill, PA 17011. This is in the Borough of Camp Hill, PA. Decedent, then 94 years of age, died August 19, 2002, at Holy Spirit Hospital, East Pennsboro Township, Cumberland County, PA. Decedent did not marry, was not divorced and did not have a child born or adopted after execution of the Will offered for probate, was not the victim of a killing and was never adjudicated incompetent. Decedent at death owned property with estimated values as follows: All personal property $ 880,000.00 2. Value of real estate in Pennsylvania $ 175,000.00 The Pennsylvania real estate is located in the Borough of Camp Hill, PA. I give, bequeath and devise all of my estate whatever nature and wherever situate unto my son, THOMAS F. LEEDY, or his issue, per stirpes. 2. Should my son, THOMAS F. LEEDY, predecease me without issue, I give, bequeath and devise all of my estate of whatever nature and wherever situate unto my daughter-in-law, KATHRYN O. LEEDY, providing she shall not at that time have remarried. 3. If my said daughter-in-law, KATHRYN O. LEEDY, shall predecease me, or shall have been remarried prior to my death, then, and in either of such events, I give, bequeath and devise all of my estate, of whatever nature and wherever situate, unto the following named charitable institutions, in the respective percentages indicated: a. 10~ to The Peace Church located at the juncture of St. Johns Road and Trindle Road, Mechanicsburg, Pennsylvania, 17055. b. 20~ to The Cathedral Church of St. Peter and 5t. Paul, in the city and diocese of Washington, (The Washington Cathedral), Mt. I appoint my son, THOMAS F . LEEDY, as the Executor of this Will. Should he be unable to act or to continue to act in such capacity, I appoint in his stead with the same powers and duties my daughter-in-law, KATHRYN O. LEEDY, and should she be unable to act or to continue to act for whatever reason, I appoint in her stead with the same powers and duties MELLON BANK, or its successor banking institution. I specifically direct that no fiduciary acting hereunder shall be required to enter bond or post security in any jurisdiction for the faithful performance of his or her duties. Seller hereby agrees to sell and convey to Buyer, who hereby agrees to purchase ALL THAT CERTAIN lot or piece of ground, together with improvements and buildings thereon erected, situate in the Borough of Camp Hill, Cumberland County, Pennsylvania, located at 239 North 25th Street, Camp Hill, PA 17011 and more fully described in Attachment A hereto, for the sum of Two Hundred Forty-Nine Thousand and Fifty Dollars ($249,050.00) which shall be paid to the Seller by the Buyer as follows: Cash at the signing of this Agreement $ 5,000.00. All plumbing, heating and lighting fixtures and systems appurtenant thereto, and forming a part thereof, as well as all ranges, laundry tubs, dishwashers, TV antennas, and other permanent fixtures, together with screens, storm sash and/or doors, shades, awnings, venetian blinds, valances, curtain rods or traverse rods, radiator covers, and all trees, shrubbery and plantings now in or on the property, unless specifically excepted in this Agreement, are to become the property of the Buyer and are included in the purchase price of the real estate. Mortgage Contingency. TIlls sale is contingent upon Buyer securing a commitment for a mortgage loan in the maximum amount of $275,000, with a minimum term of fifteen (IS) years from a responsible lending institution. The author's works were titled Practical Research: Planning and Design and How to Read and Understand Research. At his death, the Paul D. Leedy and Ormrod, Inc. (the Author and a co-author) had a publishing agreement with Pearson Education, Inc. (the Publisher) publishing as Prentice-Hall, Inc. The Author Agreement, see attached, between the parties provided for royalties to be based on 15% of net cash received by the Publisher on sales of the Author's work - Practical Research, Seventh Edition. As provided in the Author Agreement, all royalties and any other sums payable to the Author would be paid to the Author as follows: . On the Seventh Edition: 75% to Paul D. Leedy and 25% to Ormrod, Inc. . On the Eighth Edition: 50% to Paul D. Leedy and 50% to Ormrod, Inc. . On the Ninth Edition: 25% to Paul D. Leedy and 75% to Ormrod, Inc. . On the Tenth Edition: 0% to Paul D. Leedy and 100% to Ormrod, Inc. In determining a value for the copyright, the method used calls for determining the present value of future earnings stream from royalties. With regards to the second text book How to Read and Understand Research, this text book is out of print and no longer being published. Revenue per year from this text book is less than $100 per year and is considered immaterial for this valuation. Accordingly, the following factors and assumptions were considered: 1. The existing royalty agreement was reviewed and analyzed. 2. Historical sales of the publication and associated royalty payments were reviewed and analyzed for Editions 5 and 6, covering a period from November 1992 through June 2000. 3. Total net unit sold were averaged for Editions 5 and 6. 4. The anticipated royalty income was projected for Editions 7, 8 and 9 based on average net units sold for Editions 5 and 6. 5. The average sale price per net unit sold to date for Edition 7 was used in pricing the estimated future remaining units unsold. 6. The present value of the future projected royalty stream was calculated using an appropriate discount rate. 7. The risks involved for this type of publication were considered in determining the appropriate discount factor. The supporting schedules and computations for the future royalty stream are on pages 3 through 7 of this report. It is projected that the future royalty stream remaining for Edition 7 and all of Editions 8 and 9 will total $169,952. However, there are many contingencies which probably cannot be foreseen at the time of the valuation, and as Page 1 of6 such, the valuation of a copyright for estate tax purposes is an inexact science. It is for this very reason that a risk factor must be used in the valuation process. Justification for a Valuation Discount of 45% of Future Sales for Practical Research by Paul D. Leedy. Paul D. Leedy authored a college text book Practical Research: Planning and Design (Prentice Hall College Division, # ISBN: 0139603603). The book went through seven editions when the author passed away in August 2002. A 45% discount of future revenue stream for this copyright is justified because of the following reason: .:. Since the original author is no longer living, there is no guarantee that the text will go to future editions. The seventh edition of the text has a co-author (Jeanne Ellis Ormrod) trading as Ormrod, Inc.; however, it is unclear if the co-author will seek additional revisions of the book or if her talents will be diverted to some more fruitful project. At present, we have no documents that state that the book will be taken to future editions. .:. The subject matter contained in the text is quickly becoming outdated. The topic of Practical Research deals with teaching students basic research methodology and scientific method. However, the book deals with the use of libraries, various printed catalogs, and traditional information sources in printed form. Modern research makes use of computer methods and the information on the Internet for rapid accession of information. Although some attempt was made to address these methods, the focus of the text is not on modern research methods. .:. Competition from newer texts will quickly displace Practical Research. The subject of how to perform research is rapidly evolving from libraries and books to on-line methods. A brief survey of textbooks suitable for college-level study show that at least 30 books deal with the subject of finding and organizing information using multiple sources; most of these make extensive reference to on- line methods. Examples include: Find it Online: The Complete Guide to Online Research, by Alan M. Schlein; Researching Online for Dummies, by Reva Basch; Doing Internet Research: Critical Issues and Methodsfor Examining the Net, by Steve Jones; Marketing Research: The Impact of the Internet by Carl McDaniel; etc. It is believed that the new texts on research methods will quickly replace the older books on the subject. As a result of the high degree of uncertainty for the above reasons, a discount of 45% has been applied against the present value ofthe projected earnings remaining for all editions. The current value of this copyright after applying the 45% discount and rounded to the nearest hundred is ninety-three thousand five hundred dollars.
