Distribution of Personal Effects FIRST: All my remaining personal effects, clothing, furniture, furnishings, jewelry, automobiles, other tangible personal property of every kind and insurance thereon, I give to my parents, Leonard D. Arcadipane and Bertha M. Arcadipane. Distribution of Residue SECOND: I give the rest of my estate to my parents, Leonard D. Arcadipane and Bertha M. Arcadipane, if either survives me for a period of thirty days. !f my mother does not so survive me, I give all my jewelry to Kaylee Arcadipane, my niece. If both my parents, Leonard D. Arcadipane and Bertha M. Arcadipane shall not so survive me, I give the rest of my estate to my brother, Lee R. To manage, operate, repair, alter or improve real estate or other property, and to lease real estate and other property upon such terms and for such period as my executor and trustee deem advisable even for more than five years and beyond the duration of any trust. To deduct administration expenses upon either the estate tax return or fiduciary income tax return, with or without adjustment as between principal and income, as my executor shall determine. K. Protection of Beneficiaries FIFTH: No interest in income or principal shall be assignable by a beneficiary or available to anyone having a claim against a beneficiary before actual payment to the beneficiary. Page 4 of 6 Payment of Death Taxes SIXTH: All estate, inheritance or other death taxes, together with interest and penalties payable with respect to property or interest subject to taxation key reason of my death and whether passing under my will or any codicil, or otherwise, including jointly held and other non-testamentary property, shall be paid out of the principal of my residuary estate without apportionment. Appointment of Executor and Trustee SEVENTH: I appoint my parents, Leonard D. Arcadipane and Bertha M. Arcadipane, co-executors of my will. If my parents, Leonard D. Arcadipane and Bertha M. Arcadipane, are unable or unwilling to qualify as co-executors, or having qualified are unable or unwilling to continue to act, I appoint my brother, Lee R. Arcadipane, as executor. I further direct that my executor shall not be required to furnish security in any jurisdiction. EIGHTH: Any corporate fiduciary shall be compensated as such in accordance with its schedule of fees in effect from time to time when such services are rendered. The compensation of any other individual fiduciary shall be five percent 1'5%) of the compensation of the corporate fiduciary, such compensation to be in addition to the compensation of the corporate fiduciary.
