Plaintiff, CACH, LLC, is a Colorado limited liability company doing business at 4340 South Monaco Street 2nd Floor, Denver, CO 80237. 2. Defendant, ANDREW SOUTER, is an individual residing at 3019 BEVERLY RD, CAMP HILL, PA 17011. 3. The claims raised in the complaint are subject to an agreement to submit these claims to arbitration. <Exhibit C> 4. Defendant, ANDREW SOUTER, is indebted to MBNA on an account stated by and between them in the amount of $6,220.59 which balance was due and unpaid as of November 30, 2009, for credit card account number 4264290997592274. <Exhibit A> 5. On or about December 22, 2009, MBNA sold the debt for good and valuable consideration to plaintiff, CACH, LLC <Exhibit B> 6. The Defendant, Andrew Souter, last tendered a payment on November 16, 2009. 7. A copy of the credit card agreement is attached hereto. <Exhibit C> 8. Plaintiff is entitled to charge-off account finance charges of $0.00. <Exhibit A> 9. Plaintiff is entitled to pre-litigation charge-off interest of $4.3442 per day from the default date ( 25.490% annual percentage rate x $6,220.59 / 365 days) or $4.3442 x 294 days = $1,277.19; which is accrued interest through the date of filing. <Exhibit A> Plus an award of late fees 0.00, court costs $192.00 and reasonable attorneys fees of $1,244.12 as stated in the Cardholder Agreement attached hereto as <Exhibit C>. 10. The defendant, being indebted to the plaintiff in the sum of $8,933.90 upon the account stated by and between them did promise to pay said sums upon demand. Demand has been made for payment of $8,933.90 and the defendant has failed to remit payment.
