Contractor IN THE COURT OF COMMON PLEAS OF CUMBERLAND COUNTY, PENNSYLVANIA WHEREAS, Craig A. Sibert and Michelle H. Sibert of Mt. Holly Springs, Cumberland County, Pennsylvania (herein "Owner") is about to execute contemporaneous, ly herewith, a contract, with Millwood Builders, Inc., of q Cumberland County, Pennsylvania (herein "Contractor"), for the erection of a building(s) upon ALL THAT CERTAIN Lot or tract of land as set forth on Exhibit "A" attached hereto and incorporated herein by reference. NOW, 47~./._ ~1:::> ,2004, at thc time of and immediately before the execution of the principal contract, and before any authority has been given by the said Owner to the said Contractor to commence work on the said building(s), or purchase materials for the same in consideration of the making of the said contract with Owner and the further consideration of ONE ($1.00) Dollar in hand paid to Contractor by Owner, receipt of which is hereby acknowledged, it is agreed that no lien shall be filed against the building(s) by the Contractor, or any sub-contractor, nor by any of the material-men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building(s), the right to file such liens being expressly waived. WlTNES~!&TT~..~T: WITNESS/ATTEST: OWNER: By: CONTRACTOR: EXHIBIT A ALL that certain tract of land situate in South Middleton Township, Cumberland County, Pennsylvania, bounded and described as Lot No. 4 of the survey entitled Phase One - The Plan of Netherby, as prepared by Dawood Engineering, Inc., dated April 24, 2003 and recorded on August 27, 2003 in Cumberland County Plan Book 87, Page 105, being more fully described as follows, to wit: BEGINNING at a point along the eastern right-of-way line of 32-foot wide Netherby Lane at the dividing line between Lot No. 4 and 5 of said Plan; thence along said dividing line North 62 degrees 52 minutes 47 seconds East 235.23 feet to a point; thence along the dividing line of said Lot No. 4 and lands now or formerly of Thomas R. Benjey, South 25 degrees 53 minutes 06 seconds East 130.55 feet to a point along the dividing line between Lot 3 and 4 of said Plan; thence along said dividing line South 74 degrees 22 minutes 38 seconds West 245.55 feet to a point along the eastern right-of-way line of said Netherby Lane; thence along said right-of-way line of Netherby Lane by a curve to the left having a radius of 409.25 feet, an arc length of 82.12 feet, a chord beating of North 21 degrees 22 minutes 18 seconds West, and a chord length of 81.99 feet to a point, the place of BEGINNING. CONTAINING 25,254.00 square feet and being Lot No. 4 as set forth on the hereinabove referenced plan.
