Pursuant to Amendments of Supreme Orphans' Court Rules laTO~ 103 , in
ON
regard to the existence/status of a Decedent's Estate, I, MelissaJane,S~e~nk, widow
and personal representative in this case, supply the following Declar~a on~
My husband, M. Robert Shenk, died Intestate on August 28th, '~ fi. He left
No Will for disbursal of his Real or Personal Property because he had~~ nt~ne.
Prior to and at the time of his death, the extent of his possessibn~ (excepting
clothing) were of sentimental value only.
He was diagnosed with Terminal Cancer in December 2006. His (immediate
family (his mother, half-brother, and his three daughters) were made aav~are of his
medical condition at that time. Although he had been estranged from, h~s family,
I encouraged and arranged for aReunion/ Union, and Hospitably "Neutr~l" location
and "circumstance/surrounding" fora 3 to 4 day Hotel/Motel Suite at '~th~ newest
Best Western in New Cumberland, during the dates of May 28,29,30 ~n~ 318t., 2007.
My husband was still able to "meet and greet" guests (on a sch~d ed basis)
in the suite (directly below our owl we provuded. He was visited by b ~ one of his
daughters, the eldest, Stephanie, on the 29th of May 2007. She broughlt ex young
(his grandchildren) children with her. She only visited once. ICI

His youngest daughter, LeighAnn Shenk, (approximate age- 36 years at that'. time) did
contact him by telephone, in our suite, for a brief conversation on or about Maly 30th,2007.
His "middle daughter" Christine, refused to make any contact with him during this time,
(according to his eldest daughter, Stephanie, and his mother, Winnie Grissing~er).
During his visit with Stephanie, my husbandlher father, explained ~h~t although
he had "No Assets nor Real Property to Bequeath", he assured her that she ico~µld convey to
her sisters that none of "them" would be burdened with any unpaid debts aicx~ued by him.
I am not an attorney. I consulted with an attorney about a separate ~n~t~er to this
and was advised to "Create an Estate " in the name of " M. Robert Shenk", for Probate
"purposes". My husband and I discussed the "LACK" of any Assets he had ~n~l would have

at the time of his death. Unskilled in the Law, but guided by common sense'` vde~ decided
that only a properly notarized, Durable, General and Specific "Power of Attgr~ey", with
which I could execute his wishes (while he was still able to decide his affairs) ~CVOUId be
sufficient. He was very clear in his authorization, for me to handle any "final o~ unforeseen
affairs. He and I were "of one mind and intent" regarding any matters after ~~ demise.
The attorney, with whom I consulted, was not apprised about the Lack c}f Assets
possessed by my husband prior to his death. ~~
It is my belief that any "Estate" representation of my husband, M. Ro~e~t Shenk,
would have and should have been authorized "final" as of the date he died or u~on the
Grant of Letters, which has been entered for the record, on or about Novemtber~ lOtb,2008.
In as much as I have, prior to and since his demise, demonstrated andl e~eacted all
possible efforts to emend, amend, and vigorously accomplish any and all satislfa~tory means
to establish any semblance of positive familial communication in goodwill and u~ity, I
regret to acknowledge failure.

THEREFORE I request this matter concluded, according
to the Laws of the Commonwealth of Pennsylvania ~a~d the
Duly Legislated Rules of Court approved thereof, by ley sworn
statement, that Mr. M. Robert Shenk, even having did
"Intestate", had no assets to bequeath at the time al~d~ date of

his demise and therefore owes no burden relative to'd~.~bursal.
