WHEREAS, DARRICK GULA, A MARRIED MAN of 1474 TANGLEWOOD DRIVE, CRYSTAL LAKE,
ILLINOIS 60014, is about to execute contemporaneously herewith a contract with H & M ENTERPRISES of
, for the erection of a story building upon a lot of land situate
SEE EXHIBIT "A" ATTACHED HERETO AND MADE A PART HEREOF FOR ALL PURPOSES
NOW, JUNE 30, 2004, at the time of and immediately before the execution of the principal
contract, and before any authority has been given by the said OWNER to the said CONTRACTOR to
commence work on the said building, or purchase materials for the same in consideration of the making of
the said contract with OWNER and the further consideration of one Dollar, to CONTRACTOR paid by
OWNER it is agree that no lien shall be filed against the building by the contractor, or any subcontractor,
nor by any of the material men or workmen or any other person for any labor, or materiaJs purchased, or
extra labor or materials purchased for the erection of said building, the right to file such liens being
expressly waived.

LEGAL DESCRIPTION
ALL THAT CERTAIN unimproved tract of land situate in North Middleton Township, Cumberland
County, Pennsylvania, being more fully bounded and described according to a Final Subdivision Plan
for Phase I of Hillcrest Farms West, prepared by R.J. Fisher & Associates, Inc., being recorded in the
Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania, in Plan Book 86, Page
57, as follows:
BEGINNING at a point along the southern side of a 50 foot wide right-of-way known as Prickly Pear
Drive, along the dividing line between Lots Nos. 39 and 40 of the hereinafter mentioned subdivision
plan; thence continuing along said dividing line, South 51 degrees 58 minutes 30 seconds East, a
distance of 349.28 feet to a point along line of lands now or formerly of Carl W. Lehman; thence
continuing along same, South 11 degrees 48 minutes 34 seconds West, a distance of 275.28 feet to
a point along the dividing line between Lots Nos. 38 and 39 of the hereinafter mentioned subdivision
plan; thence continuing along said dividing line, North 33 degrees 52 minutes 54 seconds West, a
distance of 510.20 feet to a point along the southern side of said Prickly Pear Drive; thence
continuing along same by a curve to the Jeff, having a radius of 285.00 feet, an am length of 90.00
feet, with a chord bearing of North 47 degrees 04 minutes 18 seconds East, and a chord length of
89.63 feet to a point along the southern side of said Prickly Pear Drive, being the point and place of
BEGINNING.
CONTAINING 1.50 acres and being Lot No. 39 of the Final Subdivision Plan for Phase I of Hillcrest
Farms West, prepared by R.J. Fisher & Associates, Inc., being recorded in the Office of the Recorder
of Deeds in and for Cumberland County, Pennsylvania, in Plan Book 86, Page 57.
BEING the same premises which Don E. Backenstow and Anne R. Backenstow, by Deed dated and
recorded even date herewith, granted and conveyed unto Darrick L. Gula, Mortgagor herein.
