STIPULATION AGAINST LIENS
WHEREAS, MARK E. DEJA and PAUL E. RABON, the OWNER of the real estate described below, has or is
about to execute a contract wJth MILLWOOD CONSTRUCTION, whose principal business address is 13 MOUNT
ALLEN DRIVE, MECHANICSBURG, PA 17055, to construct a single family dwelling upon lands situate at LOT 8,
WELLGATE LANE, MECHANICSBURG, CUMBERLAND COUNTY, PENNSYLVANIA, and more particularly
bounded and described on Exhibit "A" attached hereto and made a part hereof; and,
NOW, THEREFORE, this ~ day ofJ ~ (Ax/ , 2004, before any authority had been given by
MILLWOOD CONSTRUCTION to commence work on said facilities, or purchase materials for same, in
consideration of making of the above-described Contract with MARK E. DEJA and PAUL E. RABON, Owner, and
in further consideration of One ($1.00) Dollar paid to the general contractor by MARK E. DEJA and PAUL E.
RABON, Owner, the receipt whereof is hereby acknowledged, it is agreed that no liens or claims shall be filed or
maintained against the Owner's facilities and the land above-described, or upon MARK E. DEJA and PAUL E.
RABON, the Owner, by the general contractor, or any of its subcontractors, or by any of the materialmen or
workmen, or any other person acting through or under them, for or on account of any labor, or materials
purchased, or extra labor or materials purchased for, towards, in or about the erection, construction, design and
improvement of said facilities, under said contract or otherwise, the right to have, file and maintain such liens or
claims against the facilities, the land above-described, and MARK E. DEJA and PAUL E. RABON, the Owner,
being hereby expressly waived by the general contractor for itself, its subcontractors, all materialmen, or workmen
and other acting through or under them.
IN WITNESS WHEREOF, each of t~.~ parties by.their duly authorized representatives have hereunto

ALL THAT CERTAIN tract or parcel of land situate in the Township of Lower Allen, County of
Cumberland, Commonwealth of Pennsylvania, more particularly bounded and described as
follows to wit:
BEGINNING at a point on the eastern right-of-way line of Wellgate Lane (60 feet wide) at the
dividing line between Lots Nos. 7 and 8 as shown on the hereinafter mentioned plan;
THENCE afong the eastern right-of-way line of Wellgate Lane, North 04 degrees 45 minutes
00 seconds East a distance of 130.42 feet to a point; THENCE by a curve, curving to the right
having a radius of 15.00 feet and an arc length of 12.09 feet to a point; THENCE along the
eastern right-of-way line of Wellgate Lane cul-de-sac by a curve, curving to the left having a
radius of 50.00 feet and an arc length of 49.91 feet to a point; THENCE along the dividing line
between Lots Nos. 8 and 9, North 83 degrees 44 minutes 22 seconds East a distance of
199.60 feet to a point on the western line of lands now or late of Gordon E. and Lois J.
Deckman; THENCE along the western line of lands now or late of Gordon E. Deckman and
Lois J. Deckman and lands now or late of Samuel F. Deckman, South 04 degrees 45 minutes
O0 seconds West a distance of 225.00 feet to a point; THENCE along the dividing line
between Lots Nos. 7 and 8, North 85 degrees 15 minutes 00 seconds West a distance of
215.00 feet to a point on the eastern right-of-way line of Wellgate Lane, said point being the
place of BEGINNING.
CONTAINING 43,160.98 square feet.
BEING Lot No. 8 as shown on the Final Subdivision Plan of Allen Estates. Said Plan being
recorded in Plan Book 72, Page 125.
UNDER AND SUBJECT, nevertheless, to easements, restrictions, reservations, conditions
and rights-of-way of record or visible upon inspection of premises,
