PETITION ON APPEAL FROM ASSESSED VALUATION Off' REAL PROPERTY
AND NOW, comes Appellant, CT Rehabilitation, LP (hereinafter "Appellant"), by and
through its counsel, Serratelli, Schiffman & Brown, P.C. and hereby appeals from the Decision
of the Cumberland County Board of Assessment Appeals, docketed to parcel Identifier No. 13-
25-0008-462 through Parcel Identifier No. 13-25-008-530 and mailed October 14, 2010, with
regard to the properties known as The Falls of Beacon Hills, New Cumberland, Lower Allen
Township, Cumberland County, Pennsylvania, and in support of such appeal, avers as follows:
1. Appellant is a registered Pennsylvania limited partnership having its principal
place of business located at 5351 Jaycee Avenue, Harrisburg, PA 17112.
2. Appellee is the Cumberland County Board of Assessment Appeals, having its
offices located at 1 Courthouse Square, Carlisle, Pennsylvania 17013.
3. Appellant is the owner of certain tracts or parcels of im?roved real property
commonly known as the Falls of Beacon Hills New Cumberland, PA 117070 and bearing Tax

Map Identification No. 13-25-0008-462 through Tax Map Identification No. 13-25-0008-530. A
spreadsheet specifically identifying each Tax Parcel Number, Location, Cumberland County's
2010 Assessment and the Board's Decision Assessed Value which are collectively the subject of
this appeal is attached hereto as Exhibit "A".
4. Appellant has previously filed timely appeals with the Board of Assessment with
respect to the assessments of the subject property.
5. A hearing of the Board of Assessment was held on or about October 8, 2010.
6. By notice mailed October 14, 2010, the Board of Assessment determined to raise
the assessment of the subject properties to $125,000.00. True and correct copies of the Board's
Notice of its Determination are attached hereto and are marked as Exhibit "B."
7. The Decision of the Board of Assessment was in error and/or was an abuse of
discretion for the following reasons:
a. The assessments were based upon an erroneous determination of the
fair market value of Appellant's properties;
b. Upon information and belief, the Board of Assessment failed to properly
and lawfully establish the fair market value of each Property based upon
the actual and restricted use of the buildings on the property and instead
based the value of the buildings on a hypothetical highest and best use
valuation.
C. The Board of Assessment failed to properly and lawfully establish
the fair market value of each Property using the comparable sales
approach to valuation; and
d. The assessments lack uniformity as required under Pennsylvania
law and the United States Constitution, and is th?refore
discriminatory, and otherwise unjust, inequitable, improper and
inaccurate.

Appellant is aggrieved by the action of the Board of Assessment.
WHEREFORE, Appellant respectfully requests that this Honorable Court hear and
determine this appeal and to make such changes in the aforesaid assessments as may be proper
and just based upon all of the evidence presented, and further award Appellant all such other
relief as is proper and just.

STIPULATION AND JOINT MOTION FOR AGREED ORDER
AND NOW, this 1 1 th day of may 2012, it is hereby Agreed and
Stipulated by and between the Appellant, CT Rehabilitation, L.P., by Paige Macdonald _.
Matthes Esquire; and Appellee, Cumberland County Board of Assessment Appeals, by
Stephen D. Tiley, Esquire, Assistant Cumberland County Solicitor for Tax Matters; and
Interested Party, Lower Allen Township, by Steven P. Miner, Esquire; and Interested
Party, West Shore School District, by Mark S. Cappuccio, Esquire, as follows:
1. Appellant filed a "Petition on Appeal from Assessed Valuation of Real
Property' on November :?010. The Court, by Honorable Albert H. Masland, entered an
Order on November 9, 2010 setting a hearing date for April 1, 2011. By Order dated
March 7, 2011, the April 1, 2011 hearing was cancelled and rescheduled for June 1, 2011.
By Order dated June 2, 2011, the hearing scheduled for June 1, 2011 was cancelled and
rescheduled for September 9, 2011. By Order dated September 7, 2011 the hearing
scheduled for September 8 and 9, 2011 was cancelled and rescheduled for December 29
& 30, 20 11. Thereafter, the December 29, 2011 date was converted to a pre-trial
conference. By Order dated December 29, 2011 the hearing scheduled to commence on
December 30, 2011 was cancelled and rescheduled to commence on February 21, 2012
and continue on March 14, 2012, if necessary. The parties have now settled this case.
2. This assessment appeal relates to market value as of June 14, 2010, the
date the appeal was originally filed before the Board of Assessment Appeals, and year
2011 taxes. The appeal emanates from the year 2010 Cumberland County, Countywide,
reassessment. The said reassessment value is applicable to taxes imposed on or after
January 1, 2011.
3. The properties that are the subject of this appeal consist of 69 separate
townhouses, each on a separate lot or parcel known as Cumberland County Tax Parcels
13-25-0008-462 through., and including, -530. Appellant is the owner of all 69 parcels.
Appellant operates the parcels as an apartment complex known as "The Falls at Beacon
Hills." "The 69 townhouses are along Quincy, Edinburg, and Brockton Roads, which are
off of Beacon Hill Road in Lower Allen Township, Cumberland County, Pennsylvania.
4. The parties stipulate that the total fair market value of the properties as of
the date the original appeal was filed before the Board of Assessment Appeals, to wit:
June 14, 2010, is $105,000 per parcel. The parties stipulate that the total fair market
value remained the same on June 14, 2011.
5(a). As a result of the year 2010 Cumberland Countywide reassessment, the
predetermined ratio for the year 2010 Countywide reassessment value is 100% of year
2010 value. There is no Common Level Ratio applicable to the year 2010 Countywide
reassessment. value. The parties stipulate that for the year 201.0 Countywide reassessment
value, first applicable for taxes beginning in year 2011, the fair market value of the
properties is $105,000 per parcel, and the assessment for each of the 69 separate tax
parcels shall be $105,000, each. The assessments shall continue in this amount, for each
parcel, for future years, until changed as provided by law (including any Countywide
reassessment), or as provided by paragraph 5(b) of this Stipulation,
(b) Absent a change in the physical structure of any of the 69 townhouses
which are the subject of this appeal, either by addition, new construction, reconstruction,
or demolition, the $105,000 assessment for each parcel shall continue unchanged, unless
a Countywide reassessment shall be implemented, until February 1, 2014. The parties
acknowledge that the fair market value, and assessed value, of the parcels has been
impacted by the "Prepayment Premium" to which all 69 parcels are subject as a result of
the blanket mortgage covering all 69 parcels, and recorded at Cumberland County
Mortgage Book 1560, Page 403. The parties stipulate that the Appellee's willingness to
consider the impact of that Prepayment Premium applies only to the present litigation for
this property, as a result of this Settlement Stipulation. No part of this Settlement
Stipulation may be used in any future litigation concerning these properties, or any other
properties. The parties further stipulate and agree that upon the Prepayment Premium
applicable to Mortgage Book 1560, Page 403 no longer being a term of the said
Mortgage, or the Note accompanying it, or no longer being applicable for any reason, that
the Cumberland County Assessment Office shall have the right to reassess the 69 parcels.
In the event of such a reassessment, change of assessment notices will be sent to the
Appellant (or then current owner of record) and the owner will have its full rights to
appeal as provided by law. The Prepayment Premium is scheduled to expire, by its
terms. on February 1, 2014, and the Assessment Office shall have the right to reassess the
properties on and after that date. The Assessment Office may have the right to reassess
the properties earlier than February 1, 2014 if the prepayment penalty is eliminated such
as by satisfaction of the Mortgage recorded at Cumberland County Book 1560, Page 403.
6. For each parcel, the Cumberland County Assessment Office shall allocate
the total assessment between land and improvements as provided by law and the
procedures of the Cumberland County Assessment Office.
7. For each parcel, the year 2010 Countywide reassessment value of
$105,000 per parcel, and the assessment in that amount, shall be implemented beginning
with year 2011 County and municipal taxes, and beginning with 2011/12 School Real
Estate Taxes. The said year 2010 Countywide reassessment value of $105,000 for each
of the 69 parcels shall be effective for tax years beginning on and after.January 1, 2011,
and shall continue thereafter unless and until changed as otherwise provided by law.
8. The Cumberland County Assessment Office shall promptly notify the
appropriate taxing bodies of the change in assessment, and instruct the taxing bodies to
make appropriate refunds within 60 days of the entry of the Order accompanying this
Stipulation. A spreadsheet showing the refunds to be issued for year 2011 County and
Municipal taxes, and year 2011/12 School taxes is attached hereto as Exhibit "A." Year
2012 County and Municipal taxes will be billed at the higher pre-settlement assessments.
Credit notices will be sent to the tax collector at the beginning of May. If the owner
desires to take advantage of the discount period for year 2012 County and Municipal
taxes it will need to pay those taxes as billed, during the discount period, and then obtain
a refund from the tax col}Lector. In the alternative, the owner may wait until the face
period, when the tax collector should be able to receive paying in the net amount due.
9. Each party to this appeal shall bear its own costs. The Court is requested
to enter the proposed Order attached hereto. The undersigned Attorneys each hereby
warrant to the other, and to the parties, and to the Court, that he/she has reviewed this
Settlement Stipulation with his/her client or clients and that he/she has specifically been
authorized to enter into this Settlement Stipulation by his/her client: or clients.

AND NOW, this H 07 day ofl-4a 2012, upon Stipulation and Joint Motion for
Agreed Order, it is Decreed and Ordered that the fair market value of each of the 69 parcels
which are the subject of this appeal, as of the date the original Petition to the Cumberland County
Board of Assessment Appeals was filed, to wit: June 14, 2010, is $105,000 per parcel. The
within appeal is applicable to the year 2010 Cumberland Countywide reassessment. The
predetermined ratio applicable to the year 2010 Cumberland Countywide reassessment is 100%
of year 2010 fair market value. The Common Level Ratio is not applicable to the year 2010
Countywide reassessment. Therefore, the assessment of each of the 69 tax parcels for purposes
of the year 2010 Countywide reassessment shall be $105,000 per parcel. This assessment shall
be implemented beginning with year 2011 County and municipal taxes, and year 2011/12 School
Real Estate Taxes, and shall continue thereafter until revised in accordance with law, Provided,
However, that the Cumberland County Assessment Office may reassess the parcel on and after
February 1, 2014, or an earlier date if the Prepayment Premium is sooner eliminated, as
described in paragraph 5(b) of the parties' Stipulation and Joint Motion for Agreed Order.
The Cumberland County Assessment Officer shall allocate the said assessment between
land and improvements in accordance with the law and procedures of the Cumberland County
Assessment Office, and shall instruct the taxing bodies to make any appropriate refunds. The
taxing bodies shall make appropriate refunds within 60 days of the date of this Order. The said
Stipulation and Joint Motion for Agreed Order is incorporated herein, including its Exhibit "A"
setting forth the refunds to be issued for year 2011 County and Municipal real estate taxes and
year 2011/12 School real estate taxes.
