STIPULATION AGAINST LIENS

THIS AGREEMENT made this day of r') r--41--,. 2010, by
and between Tamanini Homes, L C, hereinafter referred to as
Contractor,
AND
William M. Jordan and Phyllis M. Nye,hereinafter referred to as
owner, whereby the contractor undertook and agreed to erected and
construct a dwelling on the certain lot of ground situate in Monroe
Township, Cumberland County, Commonwealth of Pennsylvania, and more
fully described in Exhibit "A" which is attached hereto and made a
part hereof known as Lot #98 839 Tamanini Way, Mechanicsburg, PA
17050.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar to
Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their subcontractors, and all parties acting through or under
them, covenant and agree that no mechanic's liens or claims shall
be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under them,
hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said buildings
or any of them, and agree that this instrument, waiving the right
of lien, shall be an independent covenant.

ALL THAT CERTAIN tract of land situated in Monroe Township, Cumberland County,
Pennsylvania, being LOT 98 as described on a plan titled "Final Subdivision Plan for Lots
95-98 Trindle Station, Section 1, Phase H," dated November 19, 2009, last raevised April 14,
2010 by Alpha Consulting Engineers, Inc. and recorded in Cumberland County
Courthouse, Instrument Number 201014380, more particularly described as follows:
BEGINNING at a point at Lots 97 and 98 of the aforementioned Plan and along the eastern
right of way of Tamanini Way, said point being South 11 degrees 20 minutes 34 seconds
East a distance of 74.25 feet from a point at Lots 12 and 13 and along the western right of
way of Tamanini Way; thence along Lot 97 South 59 degrees 00 minutes 50 seconds East a
distance of 120.00 feet to a point at lands now or formerly of Trindle Station, LLC; thence
along lands now or formerly of Trindle Station LLC South 30 degrees 59 minutes 10
seconds West a distance of 107.89 feet to a point; thence along the same North 57 degrees 33
minutes 57 seconds West a distance of 124.73 feet to a point at the eastern right of way of
Tamanini Way; thence along the eastern right of way of Tamanini Way by a curve to the
left with a radius of 228.48 feet, an arc length of 58.63 feet with a chord bearing of North 35
degrees 35 minutes 14 seconds East, a chord distance of 58.46 feet to a point; thence along
the same North 30 degrees 59 minutes 10 seconds East a distance of 46.46 feet to a point,
being the place of BEGINNING.
CONTAINING an area of 12,828 square feet (0.29 acre).
BEING part of the same premises which Trindle Station, LLC by deed dated 5/27/10 and
recorded 6/2/10 in Instrument #201014382 granted and conveyed unto Trindle Station,
LLC, Grantor herein.
