STIPULATION AGAINST LIENS
THIS AGREEMENT made this Z8 day of 2010, by
and between Tamanini Homes, LLC, hereinafter referred to as
Contractor,
AND
R.G. Azizkhan and Helga M. Azizkhan,hereinafter referred to as
owner, whereby the contractor undertook and agreed to erected and
construct a dwelling on the certain lot of ground situate in Monroe
Township, Cumberland County, Commonwealth of Pennsylvania, and more
fully described in Exhibit "A" which is attached hereto and made a
part hereof known as Lot #14 836 Tamanini Way, Mechanicsburg, PA
17050.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar to
Contractor in hand paid by owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their subcontractors, and all parties acting through or under
them, covenant and agree that no mechanic's liens or claims shall
be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under them,
hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said buildings
or any of them, and agree that this instrument, waiving the right
of lien, shall be an independent covenant.

ALL TIIAT CERTAIN tract of land situated in Monroe Township, Cumberland County,
Pennsylvania, being Tax Parcel 22-09-0541-015 known as Trindle Station as depicted on the
Final Subdivision as depicted on the Final Subdivision Plan for Section 1 of Trindle Station
- Phase 2 prepared by Alpha Consulting Engineers, Inc. having Instrument Number
200801802 assigned in the Cumberland County Recorder of Deeds office, being more
particularly described as follows:
BEGINNING at an iron pin on the northern right of way line of Tamanini Way at the
dividing line of Lot 14 herein conveyed and Lot 13 as shown on the aforementioned
subdivision plan; thence along Lot 13 North 59 degrees 00 minutes 50 seconds West a
distance of 105.82 feet to an iron pin at the dividing line of Lot 9; thence along Lot 9 and
Lot 8 North 31 degrees 42 minutes 36 seconds East a distance of 105.04 feet to an iron pin at
the dividing line of Lot 15; thence along Lot 15 South 59 degrees 00 minutes 50 seconds East
a distance of 104.49 feet to an iron pin on said northern right of way of Tamanini Way;
thence along the northern right of way line of Tamanini Way South 30 degrees 59 minutes
10 seconds West a distance of 105.04 feet to an iron pin, the Place of BEGINNING.
CONTAINING an area of 11,044.45 square feet (0.254 acres) and being Lot 14 on the Final
Subdivision Plan for Section 1 of Trindle Station - Phase 2.
BEING part of the same premises which Trindle Station, LLC by deed dated 3/15/07 and
recorded 3/16/07 in Deed Book 279, Page 752, granted and conveyed unto Trindle Station,
LLC.
