CIVIL ACTION/MORTGAGE FORECLOSURE -
1. Plaintiff is Wells Fargo Bank, N.A., a corporation duly organized and doing business at the
above captioned address.
2. The Defendant is Timothy L. Gerwig, who is the mortgagor and real owner of the mortgaged
property hereinafter described, and his/her last-known address is 112 South Market Street, Mechanicsburg,
Pennsylvania 17055.
The Defendant is Paul C. Marra, who is the mortgagor and real owner of the mortgaged
property hereinafter described, and his/her last-known address is 112 South Market Street, Mechanicsburg,
Pennsylvania 17055.
4. On July 22, 2005, Timothy L. Gerwig and Paul C. Marra made, executed and delivered a
mortgage upon the premises hereinafter described to Wells Fargo Bank, N.A. which mortgage is recorded
in the Office of the Recorder of Cumberland County in Mortgage Book 1916, Page 3479.
The premises subject to said mortgage is described in the legal description attached as Exhibit
"A" and is known as 112 South Market Street, Mechanicsburg, Pennsylvania 17055.
6. The mortgage is in default because monthly payments of principal and interest upon said
mortgage due March 20, 2010 and each month thereafter are due and unpaid, and by the terms of said
mortgage, upon default in such payments for a period of one month, the entire principal balance and all
interest due thereon are collectible forthwith.
The following amounts are due on the mortgage:
Principal Balance $ 51,591.24
Interest through September 27, 2010 $ 1,437.64
(Plus $6.54 per diem thereafter)
Attorney's Fee $ 1,250.00
GRAND TOTAL $ 54,278.88
8. Notice of Intention to Foreclose as required by Act 6 of 1974 (41 P.S. §403) and notice
required by the Emergency Mortgage Assistance Act of 1983 as amended under 12 PA Code Chapter 13, et
seq., commonly known as the Combined Notice of Delinquency has been sent to Defendants by regular mail
with a certificate of mailing and by certified mail, return receipt requested.
WHEREFORE, Plaintiff demands an in rem Judgment against the Defendants in the sum of
$54,278.88, together with interest at the rate of $6.54 per diem and other costs and charges collectible under
the mortgage and for the foreclosure and sale of the mortgaged property.

Commonwealth of Pennsylvania, being on South Market Street, and bounded and described as follows, to wit:
BEGINNING at a point in the curb line on South Market Street aforesaid; thence in a westerly direction by lot formerly of
Samuel F. Hauck 86 feet 3 inches; thence by lot of same on present line dividing the two lots 69 feet 2 1/2 inches to an alley;
thence along said alley 38 feet 3 inches to lot formerly of R.G. Young, now of Elwood G. Swanger and wife; thence along
said lot 155 feet to Market Street on the Curb line; thence along curb line 39 feet 5 (erroneously stated as 56 inches in prior
deed) inches to line of lot formerly of Samuel F. Hauck, the place of BEGINNING.
SUBJECT, however, to the reservations and restrictions contained in prior deeds.
Being the same property acquired by Timothy L. Gerwig and Paul C. Marra, by Deed recorded 09/15/2004, of record in Deed

and inquiry for the within named defendant to wit: Timothy L. Gerwig, but was unable to locate him in his
bailiwick. He therefore returns the within Complaint in Mortgage Foreclosure as not found as to the
defendant Timothy L. Gerwig. Request for service at 112 S. Market Street, Mechanicsburg, Pennsylvania
17055 is vacant. To date The Mechanicsburg Postmaster has been unable to provide a good forwarding
address for Timothy L. Gerwig.
