Enclosed, please find a copy of the First and Final Account and the Petition for
Adjudication of the Estate of Janet W. Bender, which was filed with the Court today on behalf of
William and Erma Heiser, the executors of the estate.
As you will see, there were not sufficient funds to provide for a distribution to you, because
there were no funds left after the costs of administration of the estate were paid. Even the claims of
the various creditors were unpaid because there were not sufficient funds.
Nevertheless, as a potential beneficiary of the estate it is my duty as your counsel for the
executors of the estate, to provide you with notice of the filing of the Account and the Petition so
that any objections to the account maybe raised.
I am also providing notice to you in accordance with the Pennsylvania Rules of Orphans'
Court concerning the request being made to the Court for a reserve amount for counsel fees to be
paid to my office in the amount of $300.00. Please note that you do have the opportunity to object
to any reserves requested or other distributions proposed until the schedule of distribution and the
account submitted for the estate is confirmed on January 11, 2011.
Please take note that the Account will be presented for confirmation in Courtroom No. 1 of
the Cumberland County Courthouse, Carlisle, Pennsylvania at 9:30 a.m. on Tuesday, January 11,
2011. Objections to the Account must be filed in writing at the Office of the Register of Wills,
Cumberland County Courthouse, PA not later than 9:00 a.m. on Tuesday, January 11, 2011, with a
copy served upon me.
In the absence of Objections, the Account will be confirmed on January 11, 2011 and the
Estate will be closed with the Court approving the proposed zero distribution to you as set forth
herein.
