COMPLAINT IN CONFESSED JUDGMENT
L Plaintiff, Szel~s Real Estate Development Company, L.P. d/b/a Steles Properties
(hereinafter "Steles"), is a limited partnership incorporated and doing business under the laws of the
State of Delaware, with its principal place of business located,at 945 East Park Drive, Suite 201,
Harrisburg, Pennsylvania 17111-2804..
2. Defendant, Heritage Wealth Advisors, LLC (hereinafter "Heritage") is a
Pennsylvania limited liability company with an address of 635 North 12t" Street, Lemoyne,
Pennsylvania 17043.
3. This matter is an action to confess judgment for damages arising out of Heritage's
default under the terms of a commercial lease agreement (hereinafter the "Lease Agreement")
ehtered into between Steles and Heritage on December 15, 2008. A true and correct copy of said
Lease Agreement is attached hereto and incorporated herein, as Exhibit "A".
4. The Warrant of Attorney is contained in paragraph 35 of the Lease Agreement.
5. Heritage has defaulted under the terms of the Lease Agreement by failing to pay for
rent and late charges pursuant to the terms of the Lease Agreement.
6. Heritage currently owes Szeles $63,233.60 for past due rent and late charges
pursuant to the'Lease Agreement through November 2010.
7. Under the terms of the. default provision of the Lease Agreement, specifically
paragraph 35 of the Lease Agreement, upon Heritage's default for failure to pay, Szeles is entitled
to costs, expenses, interest,. and an attorney's commission of 5% or $500.00, whichever is greater.
The total balance due including rent and late charges, as of the filing of tthis
Complaint is as follows:
Past due rent through November 2010* $ 41,168.82
Late fees as authorized by the Lease* $ 22,064.78
Attorney fees commission of 5% $ 3,158.95
Filing Fee $ 27.50
Sheriff's Service Fee $ 100 00
*continues' to accrue until paid
Total: $ 66,520.05
9. Post judgment interest accrues at the legal rate of 6% per annum on the amount due.
10. The Lease Agreement under which judgment is being confessed has not been
assigned.
11. Judgment is not being entered by confession bf judgment against a natural person in
connection with a consumer credit transaction.
12. Judgment upon the Lease Agreement has not been entered. in any other jurisdiction.
13. A confession of judgment for possession of real property under the Lease Agreement
has been entered in Cumberland County concurrently with this confessed judgment for monetary
damages.

14. Judgment is demanded as authorized by the. Warrant of Attorney contained in the
Lease Agreement, attached as Exhibit "A", in the amount of $ 66,520.05.
15. The Warrant of Attorney appearing in the attached Lease Agreement is less than
twenty (20) years old.
16. Szeles has taken all actions or complied with all conditions precedent to the filing of
this action.
WHEREFORE, Plaintiff Szeles Real Estate Development Company, L.P. d/b/a Szeles
1?roperties demands judgment against Defendant Heritage Wealth Advisors, LLC in the: amount of
66,520.05. plus interest, which continues to accrue in the amount of $10.92 per day from November
11, 2010 forward, as authorized by Pennsylvania law, together with costs of suit.

PENNSYLVANIA RULE OF CIVIL PROCEDURE. 2959 `
STRIKING OFF OR OPENING JUDGMENT; PLEADINGS AND PROCEDURE
(a)(1) Relief from a judgment by confession shall be sought by petition.. Except as
provided in subparagraph (2), all grounds for relief whether to strike off the judgment or to open
it must be asserted in a single petition. The petition may be filed in the county in which the
judgment was originally entered, in any county. to which the judgment has been transferred or in
any other county in which the sheriff has received a writ of execution. directed to the sheriff to
enforce the judgment.
(2) The ground that the waiver of the due process rights of notice and hearing was not
voluntary, intelligent and knowing shall be raised only
(i) in support of a further request for a stay of execution where the court has
not stayed execution despite the timely filing of a petition for relief from
the judgment and the presentation of prima facie evidence of a defense;
and
(ii) as provided by Rule 2958.3 or Rule 2973.3.
(3) If a written notice is served upon the .petitioner pursuant to Rule 2959.1(c)(2) or
EZule 2973.1(c), then petition shall be filed within thirty days after such service.. Unless the
defendant can. 'demonstrate that there were compelling reasons for the delay, a petition not timely
:Filed shall be denied.
(b) If the petition. states prima facie grounds for relief,: the court shall issue a rule to
Show cause and may grant a stay of proceedings. After being served with a copy of the petition
the plaintiff shall. file an answer on or before the return day of the rule. The return day of the rule
shall be fixed' by the court by local rule or special order.
(c) A party waives all defenses and objections which are not included in the petition
or answer.
(d) The petition and the rule to show cause and the answer shall be served as provided
in Rule 440.
(e) 'the court shall dispose of the rule on petition and answer, and. on any testimony,
depositions, admissions and other evidence. The court for cause shown may stay proceedings on
the petition insofar as it seeks to open the judgment pending disposition of the application to
strike off the judgment. If evidence is produced which in a jury trial would require the issues to
be submitted to the jury, the court shall open the judgment.
(f) The lien of the judgment of or any levy or attachment shall be preserved. while the
proceedings to strike off or open the judgment are pending.
