WHEREAS, Lawrence M. Della Noce and Gloria A. DellaNoce of 30 Deer Run, Dux~lry=~llA d:;'.
02332, is about to execute contemporaneously herewith, a contract, with Hoffman's Custom
Contracting, Inc. of 35 Chelsea Lane, Carlisle, PA 17015, for the erection of a building upon
premises commonly known as 210 Parker Street, Borough Carlisle, Cumberland County,
Pennsylvania, as set forth in the deed dated 10129/10, recorded at Instrument Number
201031786, in the Recorder's OfFce for Cumberland County, Pennsylvania, as more

NiJW, , at the time of and immediately before the execution of the principal contract, and
before any authority has been given by the said Owner to the said Con#rac#or to commence
work on the said building, or purchase materials far the same in consideration of the making
of the said contract with Contractor and the further consideration of One Dollar ($1.00), to
contractor paid- by Owner, it is agreed that no lien shall be filed against the building by the
Contractor, or any subcontractor, nor by any of the materialmen or workmen or any other
person for any labor, or materials purchased, or extra labor or materials purchased for the
erection of said building, the right to file such liens being expressly waived.
WITNESS, our hands and seals the day and year aforesaid.

ALL that certain tract land situate in the Third Ward of the Borough of Carlisle, Cumberland
County, Pennsylvania, being Lot No. 13 as shown on the Final Subdivision and Land Development
Plan for Mooreland Mews prepared by Brehm-Lebo Engineering, Inc. dated June 18, 2007 and
revised October 1, 2007 and recorded in the Office of the Cumberland County Recorder of Deeds as
Instrument No. 200739383, more particularly bounded and described as follows:
BEGINNING at an iron pin (set) on the western right of way line of Pazker Street (60 feet wide) at
the common comer for Lot No. 12 and Lot No. l 3 as shown on the aforementioned final subdivision
and land development plan ;thence, along the western right of way line of Parker Street South 15
degrees, 15 minutes, 00 seconds West a distance of 60.00 feet to an iron pin (set); thence, along the
northern line of Lot No. 14 North 74 degrees, 45 minutes, 00 seconds West a distance of 118.00 feet
to an iron pin (set) on the eastern line of Phillips Avenue (a 20 foot -wide private right of way);
thence, along the eastern line of Phillips Avenue North 15 degrees, 15 minutes, 00 seconds East a
distance 60.00 feet to an iron pin (set); thence, along the southern line of Lot No. 12 South 74
degrees, 45 minutes, 00 seconds East a distance of 118.00 feet to an iron pin (set), the point of
