MOTION TO MAKE RULE ABSOLUTE
AND NOW, comes counsel for the Estate of Allen L. Weikel, GERBER &
ASSOCIATES, and files the within Motion and, in support thereof, sets forth the following:
1. Counsel for the Estate, GERBER & ASSOCIATES, filed a Petition to Withdraw
pursuant to Pa.R.C.P. 1012(d).
2. On October 15, 2010, this Court entered a Rule to Show Cause upon Respondents
as to why GERBER & ASSOCIATES should not be allowed to withdraw from this matter and
ordered Respondents to file an answer, if any, within twenty (20) days of service, a copy of
which is attached hereto, incorporated herein, and mazked as Exhibit "A".
3. The Orphans' Court served the Rule to Show Cause on Respondents on or
immediately after October 15, 2010.
4. More than twenty (20) days have elapsed since the Rule was entered.
WHEREFORE, GERBER & ASSOCIATES respectfully requests that this Court make
the Rule absolute and allow it to withdraw by filing a praecipe with the Orphans' Court.

RULE TO SHOW CAUSE
AND NOW, this ~ day of

of the foregoing Petition to Withdrawal as Counsel, it is hereby ordered that:

1. a rule is issued upon Respondents to show cause why Petitioner, GERBER &
ASSOCIATES, is not entitled to the relief requested;
2. Respondents shall file an answer to the petition within twenty (20) days of service
upon Defendant /Respondent or an order will be entered allowing withdrawal..of counsel;

3. the petition shall be decided under Pa.R.C.P. No. 206.7; and
4. Notice of the entry of this order shall be provided to all parties by Petitioner,
