HomeMy WebLinkAbout11-22-10FINAL RELEASE OF HEIRS/EXECUTRIX OF ESTATE OF MARY SI3AFF~R FOIE .- ~' ESTATE FUNDS HELD IN RESERVE ~° ~° `J-. -~~'~ c . , ESTATE N0.21-08-1099, CUMBERLAND COUNT~~ ~ ~ ~_ PENNSYLVANIA ,.--,o-~-~ -~ - _~ ; ~_,7 iV. ~ ~ 'ice' ~ ~ KNOW ALL MEN BY THESE PRESENTS THAT WHEREAS MARY SHAFFER, late of 905 Lisburn Road, Camp Hill (Lower Allen Township, Cumberland County, Pennsylvania, deceased died testate on October 23, 2008; and WHEREAS, the last will and testament of the decedent Mary Shaffer, dated November 4, 2000 was filed for probate in the Office of the Register of Wills of Cumberland County, Pennsylvania on November 7, 2008; and WHEREAS, by the terms of Items I of the said will, the decedent's three children Vernon J. Shaffer II, Eugenia L Barley, and Scott Alan Shaffer, are her residuary beneficiaries entitled to equal shares of his residuary estate, and WHEREAS, by a family settlement agreement executed by the decedent's residuary heirs and filed in the Office of the Register of Wills of Cumberland County, Pennsylvania, the said heirs agreed to and accepted the equal distribution of $380,365.71 in estate and jointly held assets, and released, quitclaimed and forever discharged Eugenia L. Barley, executrix of the said estate of Mary Shaffer, her heirs, executors, administrators and assigns, of and from the said estate and from all actions, suits, payments, accounts, reckonings, claims and demands whatsoever for or by reason thereof, or for any other use, matter, cause or thing whatsoever, touching upon the estate of the said decedent, and her deeds as executrix of the said estate; and WHEREAS, the said executrix held $5,000.00 in reserve to cover any unforeseen expenses that might arise during the one year period following the above mentioned distribution; and WHEREAS, no further claims or expenses have arisen, no further expense are expected, and sufficient time has elapsed since the advertisement of letters to cut off any possible claims against the estate; and WHEREAS, the executrix therefore wishes to distribute the balance of the reserve fund. NOW THEREFORE KNOW YE THAT we, Vernon J. Shaffer II, Eugenia L. Barley, and Scott Alan Shaffer, the sole beneficiaries of the said estate under the decedent's last will and testament, do hereby release and discharge the executrix from any further cause or ~~ thing touching upon the said reserve funds and acknowledge that we have this day received from the aforesaid executrix, in full satisfaction and payment of all remaining sum or sums of money held in reserve by the said executrix as of the date of this instrument under the said last will and testament and the amount of any additional interest accumulating on that reserve fund or any other estate funds, which amount we have received as follows: $5,643.54 -Current Reserve Fund $12.00 -Payment of Final PA Fiduciary Income Tax $5.00 -Payment for Filing Release with Register of WiIIs leaving $5,626.54 Available Reserve Funds Schedule of Distribution Vernon J. Shaffer II 51,875.51 Eugenia L. Barley $1,875.51 Scott Alaa Shaffer $1,875.51 thus exhausting the funds available for distribution from the reserve fund. AND the parties further agree that this agreement may be executed in any number of counterparts, and each executed counterpart shall have the same force and effect as the original instrument and as if all the parties to all the counterparts had signed the same instrument.
