Devereaux ("Decedent") was married to Diana K. Devereaux ("Diana"). During their marri~.ge they acquired the subject real estate. In 2007, the co-owners borrowed funds from PNC Bank and granted mortgages on the subject real estate to PNC Bank as follows: Mortgage #1: $ 15,064.50 -dated May 24, 2007, recorded on June 6, 2007, in Cumberland County in Record Book 1995, Page 0192. Mortaa~e #2: $134,264.50 -dated May 24, 2007, recorded on June 6, 2007, in Cumberlanjd County in Record Book 1995, Page 0195. The parties were divorced on October 26, 2007. As part of the divorce settlement, Diana conveyed Her interest in the subject property by deed dated January 22, 2008 and recorded in Cumberlanld County as Instrument Number 200802759, thus vesting full ownership of the subject pro erty in Decedent. Decedent became delinquent in various obligations resulting in monetary lens at or about date of death as follows: A. Mortgage #l : see letter from Mortgagee to the Decedent $ 15,516.39 attached hereto. B. Mortgage #2: see letter from Mortgagee's attorney to the Administrator attached hereto. $136,865.88 C. (Real Estate Taxes: see notice of Lien from Cumberland County Tax Claim Bureau attached hereto. $ 3,040.72 D. 'Real Estate Taxes: see notice of Lien from Cumberland County Tax Claim Bureau attached hereto. $ 2,957.82 Total $158,380.81 Thy, Administrator is unaware of any payments having been made on any of the above obligations! since the above amounts were computed. In fact all obligations have increased because of interest and costs. Th~~ Administrator sought to determine whether any equity existed in the property and secured an appraisal indicating market value of $144,000 as of January 14, 2010 (approximately one month after Decedent's death); see copy of appraisal attached hereto. Beiing without means to payoff the approximate $14,000 differential, the Administrator abandoned'any further intent in liquidating the real estate. Thel~ Mortgagee in Mortgage #2 initiated foreclosure proceedings an March 19, 2010 in Cumberland County by action docketed to No. 10-1978 Civil Term based upon on obligation of $136,768.0'7, which action remains pending with Sheriff's sale anticipated in the near future. I, A public tax sale by the Cumberland County Tax Claim Bureau in the summer of 2010 failed to prpduce any bids for the upset price of $6,479.40 (see Notice of Public Sale, 7/O1J2010).
