On August 27, 2009 Judge Kevin Hess appointed the Cumberland County ~~ and •• ~ ~_,
Community Services as the permanent Plenary Guardian of Estate for William ~ '~'
Gallagher. Subsequently the Agency became Mr. Gallagher's Representative Payee for
his social security.
At the time of the guardianship, Mr. Gallagher had an account at Fulton Bank. A
guardianship account was opened at M&T Bank and when all the direct deposits were
changed to the M&T account, the. Fulton Bank account was closed. This action was
taken because the nearest branch of Fulton Bank was in Mechanicsburg.
Currently Mr. Gallagher's income is $1900.26 from his federal pension and $203.00
from Social Security.
Mr. Gallagher's payment to the Forest Park is presently $2013.95 a month. In addition,
the Cumberland County Aging and Community receives $100 .00 a month for
compensation for guardianship services as allowed by the rules and regulations set
forth by Medical Assistance and as directed in the guardianship court order
During this year, Mr. Gallagher experienced some problems with the Internal Revenue
Service. At one point we received notification that funds from his federal pension and
Social Security were being withheld. After a lengthy investigation and filing of fiduciary
forms we were finally advised they were being withheld because he had under-reported
his 2004 income taxes. We were also advised that he under-reported his 2007 income
taxes and they were threatening to again levy his income. They also advised that he
failed to file his 2005, 2006 and 2008 income taxes and that we should do this but at
this point in time without any payment. These were sent via certified mail on August 19,
2010. The matter has yet to be resolved. We are hoping they will place him in the
category of being unable to pay.
Attached is a financial summary of William Gallagher's income and expenses. Also
attached is a spread sheet representing his checking account register.
