PETITION AND NOTICE OF APPEAL
TO THE HONORABLE JUDGES OF SAID COURT:
AND NOW comes, William R. Balaban and Robin E. Balaban, Appellants in the
captioned matter, by and through their attorneys, Elliott Greenleaf & Balaban, and respectfully
give notice of appeal and represent as follows:
1. Appellants herein are William R. Balaban and Robin E. Balaban; husband and wife, both
adult individuals who reside at 312 North 26t' Street, Camp Hill, Cumberland County,
PA 17011-3619.
2. Appellee herein is The Board of Assessment Appeals of Cumberland County, having
their office at One Courthouse Square, Carlisle, Cumberland County, PA 17013.
3. Appellee is the duly constituted entity created by law to hear and decide real estate tax
assessment appeals and was so acting at all times relevant hereto.
4. Appellants are the fee simple owners of certain real estate known as 312 North 26`h
Street, Camp Hill, PA 17011-3619 and identified as Tax Parcel No. 01-20-1852-244 as
shown on the Cumberland County Real Estate Tax Assessment records located in the
Borough of Camp Hill in Cumberland County, Pennsylvania (hereinafter referred to as
"Subject Real Estate").
5. On July 1, 2010, Appellee mailed its Notice of Change of Assessment to Appellant
owners increasing the Subject Real Estate assessed value by $160,410.00.
6. On August 10, 2010, Appellant owners filed an appeal from such assessment with the
Appellee contesting the amount of said assessment. The Appellee held a hearing on said
appeal in its appellate capacity on October 25, 2010.
7. Appellant owners agreed to have their October 25, 2010 hearing before a single Board
Member, William Toth, and signed an agreement permitting Mr. Toth to serve as a single
Board Member to hear their case.
8. At the October 25, 2010 hearing, Appellant owner, William R. Balaban, along with
Garrett Rothman, Esquire and Greg Rothman, MAI, CCIM, CPE presented Appellant
owners' case; and Lesa Stouffer, Cumberland County Real Estate Tax Assessor presented
Appellee's case.
9. Appellee single Board Member, William Toth, rendered its written decision on October
28, 2010, and said decision set the market value of the Subject Real Estate at
$690,000.00. A copy of said decision is attached hereto and marked Exhibit "A".
10. This Court has jurisdiction to hear and decide this matter pursuant to 72 P.S. § 5453.704
et. sea.
11. The decision aforesaid is erroneous for the following reasons:
a. The decision does not reflect the true market value of the Subject Real Estate, said
decision being excessive and above the true market value.
b. The decision is not based upon competent facts.
c. The decision is contrary to law.
d. The decision constitutes an abuse of discretion.
12. Appellants, William R. Balaban and Robin E. Balaban, therefore, aver that the market
value of the Subject Real Estate is substantially less than the fair market value of
$861,800.00 as set by the Cumberland County Assessment Office's July 1, 2010 Notice
of Change of Assessment which resulted from the countywide reassessment completed
earlier this year; as well as the fair market value of $690,000.00 as set by the Cumberland
County Board of Assessment Appeals as a result of the Appellant owners' appeal from
the Cumberland County July 1, 2010 Notice of Change of Assessment.
WHEREFORE, Appellants respectfully request this Honorable Court to accept this
appeal de novo and fix a hearing date thereon in accordance with law to find the fair market
value of the Subject Real Estate lower than what it is currently set, and to grant such other and
further relief as this Court deems appropriate.

STIPULATION AND JOINT MOTION FOR AGREED ORDER
AND NOW, this c?2 7 * day of , 2011, it is hereby Agreed and
Stipulated by and between the Appellants, William R. Balaban and Robin E, Balaban, by their
attorneys, Elliott Greenleaf & Balaban; and Appellee, Cumberland County Board of Assessment
Appeals, by Stephen D. Tiley, Esquire, Assistant Cumberland County Solicitor for Tax Matters;
as follows:
On or about November 24, 2010, Appellant filed a "Petition and Notice of
Appeal." The Court, by the Honorable Albert H. Masland, entered an Order on December 1,
2010, fixing a hearing date of April 18, 2011. By Order dated April 13, 2011, that hearing was
cancelled and the matter was continued generally. The parties have now settled this case.
2. This assessment appeal relates to market value as of August 10, 2010, the date the
appeal was originally filed before the Board of Assessment Appeals, and year 2011 taxes. The
appeal emanates from the year 2010 Cumberland County, Countywide, reassessment.
3. The property which is the subject of this appeal consists of a single family
residence situate at 312 North 26`h Street in the Borough of Camp Hill, Cumberland County,
Stipulation & Joint Motion for Agreed Order- William R. Balaban & Robin E. Balaban Page 1 of 3
Pennsylvania. The property is further identified as Cumberland County Tax Parcel No. 01-20-
1852-244.
4. The parties stipulate that the total fair market value of the property as of the date
the original appeal was filed before the Board of Assessment Appeals, August 10, 2010, is
$665,000.
5. As a result of the year 2010 Cumberland Countywide reassessment, the
predetermined ratio for the year 2010 Countywide reassessment value is 100% of year 2010
value. There is no common level ratio applicable to the year 2010 Countywide reassessment
value. The parties stipulate that for the year 2010 Countywide reassessment value, first
applicable for taxes beginning in year 2011, the fair market value of the property is $665,000,
and the assessment shall be $665,000. The assessment shall continue in this amount for future
years, until changed as provided by law.
6. The Cumberland County Assessment Office shall allocate the total assessment
between land and improvements as provided by law and the procedures of the Cumberland
County Assessment Office.
7. The year 2010 Countywide reassessment value of $665,000, and the assessment
in that amount, shall be implemented beginning with year 2011 County and municipal taxes, and
beginning with 2011/12 School Real Estate Taxes. The said year 2010 Countywide reassessment
value of $665,00 shall be effective for tax years beginning on and after January 1, 2011, and
shall continue thereafter unless and until changed as otherwise provided by law.
8. The Cumberland County Assessment Office shall promptly notify the appropriate
taxing bodies of the change in assessment, and instruct the taxing bodies to make appropriate
refunds.
9. Each party to this appeal shall bear its own costs.

10. The Court is requested to enter the proposed Order attached hereto.
11. The undersigned Attorneys each hereby warrant to the other, and to the parties,
and to the Court, that he/she has reviewed this Settlement Stipulation with his/her client or
