Diehl, hereby averring the following: 1. Plaintiff, Pauline Andriutsa, is an adult individual residing at Country Meadows Nursing Home, Building 1, Apartment 40, 4905 E. Trindle Road, Mechanicsburg, Pennsylvania 17050. 2. Defendants, Anil Patel and Rekha Patel, are husband and wife, with a business at 860 North Front Street, Wormleysburg, Pennsylvania 17043. 3. On or about May 27, 2006, Defendants obtained a loan from Plaintiff and her deceased husband, Dimitrie Andriutsa, in the total amount of One Hundred Seventy-Five Thousand Dollars ($175,000.00). 4. The loan was evidenced by a Promissory Note dated May 27, 2006. A true and correct copy of the Promissory Note is attached hereto as Exhibit "A." 5. The loan was disbursed in two parts: A. Seventy-Five Thousand Dollars ($75,000.00) loaned to Anil Patel; and B. One Hundred Thousand Dollars ($100,000.00) loaned to Rekha Patel. True and correct copies of the cashier's checks are attached hereto as Exhibit "B." 6. Defendants paid the accrued interest only through the fourth quarter of 2009 with the last payment being received in January, 2010. 7. Despite demand for full payment, no further payments have been received since January, 2010. 8. The Promissory Note allows for reimbursement of reasonable attorney fees and costs. WHEREFORE, Plaintiff, Pauline Andriutsa, respectfully requests judgment to be entered in her favor and against the Defendants, Anil Patel and Rekha Patel, in the amount of One Hundred Seventy-Five Thousand Dollars ($175,000.00) plus accrued interest at the rate of seven percent (7%), reasonable attorney fees, and court costs.
