COMPLAINT
AND NOW, comes Plaintiff, EBERY LUMBER COMPANY, by its attorneys,
KUNDRAT & ASSOCIATES, and states the following cause of action:
1. Plaintiff, Eberly Lumber Company ("Eberly"), is a Pennsylvania corporation with
offices and/or a place of business situate at 135 West Allen Street, Cumberland County,
Pennsylvania, 17055.
2. Defendant, MIKABO ENTERPRISES, INC., t/d/b/a ARCHADECK OF
HARRISBURG ("Mikabo") is a Pennsylvania corporation and owner of the fictitious name
Archadeck of Harrisburg, with a business address of 226 Reigle Road, Marysville, Perry County,
Pennsylvania, 17053.
3. Defendant, MICHAEL S. BOWSER, ("Michael") is an adult individual residing
at 226 Reigle Road, Marysville, Perry County, Pennsylvania, 17053.
4. Defendant, Defendant, KATHLEEN E. BOWSER, ("Kathleen's is an adult
individual residing at 226 Reigle Road, Marysville, Perry County, Pennsylvania, 17053.
5. Plaintiff is, and at all relevant times was, a wholesale distributor of building
supplies.
6. Mikabo is, and at all relevant times was, a contractor.
7. On or about October 23, 2002, Mikabo applied to Plaintiff for credit. A true and
correct copy of the credit application is attached hereto and made a part hereof and marked
Exhibit "A".

8. Plaintiff incorporates by reference Paragraphs 1 through 7 of this Complaint as
though the same were set forth at length herein.
9. Between October 19, 2009, and January 10, 2010, various products, goods,
supplies, and materials (hereinafter collectively referred to as "products") were ordered by
Mikabo from Plaintiff. Plaintiff sold and provided the products ordered by Plaintiff, the same
being represented by invoices attached hereto and made a part hereof and collectively referred to

as Exhibit "B".
10. The prices charged for the products sold to Mikabo as set forth were the fair,
reasonable, and market prices of the products, and the prices that Mikabo agreed to pay.
11. Mikabo has not objected to any of these invoices and has accepted the products
provided thereby, but has failed to pay Plaintiff despite demand pursuant to its open account, all
to the damage of Plaintiff.
12. Plaintiffhas maintained a statement of account keeping an accurate and running
amount of debits and credits for the sale of products sold to Mikabo by Plaintiff.
13. Plaintiff has submitted to Mikabo a monthly statement of account accurately
showing all debits and credits for transactions with Mikabo. The most recent statement of
account shows an amount owing to Plaintiffof $19,045.36 as of September 30, 2010. A copy of
the statement of account is attached hereto and made a part hereof and referred to as Exhibit
K!'~ff~
14. Pursuant to the terms and conditions of sale contained on the credit application,
which terms and conditions were agreed to by Plaintiff and Mikabo, and as further stated on the
invoices attached as Exhibit "B", Plaintiff is entitled to receive a finance charge of 1.5% per
month on past due amounts.
15. Pursuant to the terms and conditions of sale and extension of credit, Mikabo
agreed to pay reasonable attorney's fees and all court and collection costs.
16. Plaintiff has retained the law firm of Kundrat & Associates at a contingency rate
of one-third (1 /3).
17. The amount in controversy is within the jurisdictional amount requiring
compulsory arbitration.

18. Any and all conditions precedent to the bringing of this action have been
performed by Plaintiff.
WHEREFORE, EBERLY LUMBER COMPANY, Plaintiff, respectfully requests this
Honorable Court to enter judgment in favor of Plaintiff and against Defendant, MIKABO
ENTERPRISES, INC., t/d/b/a ARCHADECK OF HARRISBURG, in the amount of $19,045.36,
plus interest at the rate of 1.5% per month from September 30, 2010, attorney's fees in the
amount of $6,348.45, the costs of this action, and such other relief as the court deems just and
proper.
COUNT II
EBERLY LUMBER COMPANY
v.
MICHAEL S. BOWSER
19. Plaintiff incorporates by reference Paragraphs 1 through 18 of its Complaint as
though the same were set forth at length herein.
20. In consideration of the extension of credit by Plaintiff, Michael individually,
unconditionally guaranteed the payment of all amounts owed by Mikabo Enterprises, Inc., t/d/b/a
Archadeck of Harrisburg to Plaintiff in addition to reasonable attorney's fees and costs incurred
in the collection of any amount due from Mikabo Enterprises, Inc., t/d/b/a Archadeck of
Harrisburg, and referenced in Exhibit "A" attached hereto.
21. Pursuant to the terms and conditions of the Guarantee contained in the credit
application, Defendant Michael specifically agreed that:
"... UWE DO HEREBY PERSONALLY GUARANTEE to Eberly
Lumber Company, its successors and assigns, the payment at
maturity, in accordance with the terms of sale, of the price and
value of all goods, wares, and merchandise sold by it to applicant
named above from time to time on and after the collection of any
amount due hereunder...."

22. Despite demand, Michael has refused to pay the past-due balance on the open
account of and all sums due and owing to Plaintiff.
23. Any and all conditions precedent to the bringing of this action has been performed
by Plaintiff.
WHEREFORE, EBERLY LUMBER COMPANY, Plaintiff, respectfully requests this
Honorable Court to enter judgment in favor of Plaintiff and against Defendant, MICHAEL S.
BOWSER, in the amount of $19,045.36, plus interest at the rate of 1.5% per month from
September 30, 2010, attorney's fees in the amount of $6,348.45, the costs of this action, and such
other relief as the court deems just and proper.
COUNT III
EBERLY LUMBER COMPANY
v.
KATHLEEN E. BOWSER
24. Plaintiff incorporates by reference Paragraphs 1 through 23 of its Complaint as
though the same were set forth at length herein.
25. In consideration of the extension of credit by Plaintiff, Kathleen individually,
unconditionally guaranteed the payment of all amounts owed by Mikabo Enterprises, Inc., t/d/b/a
Archadeck of Harrisburg to Plaintiff in addition to reasonable attorney's fees and costs incurred
in the collection of any amount due from Mikabo Enterprises, Inc., t/d/b/a Archadeck of
Harrisburg, and referenced in Exhibit "A" attached hereto.
26. Pursuant to the terms and conditions of the Guarantee contained in the credit
application, Defendant Kathleen specifically agreed that:

"... UWE DO HEREBY PERSONALLY GUARANTEE to Eberly
Lumber Company, its successors and assigns, the payment at
maturity, in accordance with the terms of sale, of the price and
value of all goods, wares, and merchandise sold by it to applicant
named above from time to time on and after the collection of any
amount due hereunder...."
27. Despite demand, Kathleen has refused to pay the past-due balance on the open

by Plaintiff.

In consideration of the extension of credit by Eberly Lumber Company to the applicant named above, for the
sale of goods, wares and merchandise upon credit, I/WE DO HEREBY PERSONALLY GUARANTEE to Eberly
Lumber Company, its successors and assigns, the payment at maturity, in accordance with the terms of sale,
of the price and value of all goods, wares, and merchandise sold by it to applicant named above from time to
time on and after the collection of any amount due hereunder. In addition, Applicant hereby agrees that in the
event legal action is instituted to enforce payment of the amount due pursuant to such extension of credit, the
Applicant shall be liable for reasonable attorney's fees, costs, and expenses of collection, as well as all
accrued interest.
This guarantee shall remain in full force and effect unless and until withdrawn by My/Our given ten (10) days
written notice of the withdrawal of the guaranty to Eberly Lumber Company. Notice of acceptance of this
guaranty and non-payment at maturity are hereby waived.
TERMS AND CONDITIONS OF SALE
The following terms and conditions of sale are applicable on all products sold by Eberly Lumber Company:
(1) All invoices are to be paid within thirty (30) days from the date picked up or delivered. A finance charge
of 2% per month compounded monthly shall be charged to any late balance. If any invoice is not paid within
forty-five (45) days, business will be handled on a C.O.D. basis.
(2) Any credit line established is subject to periodic review and amendment.
(3) A charge of $20.00 will be made to any customer account that passes a bad check. A Criminal Complaint
will automatically be filed if the check is not made good within ten (10) days after the customer is notified. If two
bad checks are issued within any three {3) month period, any credit line will automatically be revoked.
(4) Prior to the establishment of a credit line, Demand Promissory Notes and/or Personal Guarantees may
be required by all applicants, principals, and/or owners.
(5) All returns are the responsibility of the purchaser and a return charge shall be made. Special ordered
goods are not returnable.
{6) Eberly makes NO WARRANTY of any kind, expressed or implied, including but not limited to NO
WARRANT OF MERCHANTABILITY and NO WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE.
There are NO WARRANTIES which extend beyond the description shown on any invoice.
(7) Applicant certifies that it is a dealer in the products purchased from Eberly and is knowledgeable as to
the proper ordering and installation procedures.
{8} All terms and conditions of sale stated above are subject to modification by Eberly at any time, and any
conflicting terms and conditions contained on the invoice or statement of account submitted to applicant shall
be deemed controlling.
