COMPLAINT IN CIVIL ACTION
1. Plaintiff, PITNEY BOWES, INC. (hereinafter "Plaintiff') is a corporation
with offices at 500 Ross Street, Suite 154-0470, Pittsburgh PA 15262.
2. Defendant ROMINGER, INC. trading as ROMINGER & ASSOCIATES,
hereinafter "Defendant") is a corporation with it offices located 155 S. Hanover Street,
Carlisle, Cumberland County, Pennsylvania 17013.
3. Before on or about March 22, 2005, Defendant entered into a rental
agreement with Plaintiff to rent one of its postage machines for use in its business.
4. Attached hereto, made a part hereof and marked as Exhibit "1"pages 1
through 4 is a copy of the rental agreement.
5. In addition to renting Plaintiffs equipment, Defendant also participated in
Plaintiffs Purchase Power Account program upon which it purchased U.S. postage for
its use.
6. As requested by the Defendant, Plaintiff created an account for the
Pitney Bowes Purchase Power. vs. Rominger Law Offices Complaint page 4
Defendant's use in purchasing postage services (Account No. 8000-9090-0012-4409)
on credit.
7. The Defendant did purchase postage from Plaintiff on credit during the
period of March 22, 2005 through March 18, 2010 which were posted to its account
8000-9090-0012-4409 for a total of $19,517.84.
8. Attached hereto, made a part hereof and marked as Exhibit "2" is a true
and correct copy of the Statement of Account dated September 19, 2010 when the
balance then due and owing was $19,517.84.
9. The prices charged for the postage utilized by the Defendant were the fair,
reasonable and market prices of the same at the time they were delivered to the
Defendant, and further are the prices that it agreed to pay.
10. Plaintiff has demanded payment of the combined principle balance due of
$19,517.84, but Defendant has failed or refused to pay.
11. In addition to the principal balance, Plaintiff demands interest at the
contract rate of 18% per annum from an average due date of September 19, 2010.
12. Per the Lease Terms and Conditions and Purchase Power terms and
conditions, Defendant is also liable for reasonable Attorneys fees which calculate to be
$2,927.68.
WHEREFORE, Plaintiff demands judgment in its favor and against the
Defendant, ROMINGER, INC. trading as ROMINGER & ASSOCIATES in the principal
sum of $19,517.84 with interest at the 18% thereon from September 19. 2010,

reasonable attorneys fees of $2,927.68 and cost.
