COMPLAINT
1. Plaintiff, Thomas Somerville Company, is a corporation organized under the
Laws of the Commonwealth of Pennsylvania with an address of 16155 Trade Zone
Avenue, Upper Marlboro, Maryland 20774-8733.
2. Defendant, Tim Hake, is an adult individual with an address of 76 Beard Road,
Mechanicsburg, PA 17050.
3. Defendant, Tim Hake Mechanicals, is a business with an address of 76 Beard
Road, Mechanicsburg, PA 17050.
4. On or about April 4, 2010 to September 1, 2010, the Plaintiff provided the
Defendants with services and products totaling $10,370.33. Attached hereto as
Exhibit "A" is a true and correct copy of the account receivable statement.
5. The Defendants executed a Credit Application with a personal guaranty on
April 13, 2007. Attached hereto as Exhibit "B" a true and correct copy of the Credit
Application.
6. The Plaintiff as made repeated requests for payment and the Defendants have
made one payment of $500 on October 19, 2010.
COUNT I -BREACH OF CONTRACT
7. Paragraphs 1 through 6 are incorporated herein by reference as though set
forth at length.
8. The Plaintiff produced materials pursuant to the Defendants' request.
9. The Plaintiff produced the materials that it was contracted to produce in a
timely, good and workmanlike manner.
10. The Defendants breached the contract between the parties by failing to pay for
the materials produced and services provided.
11. As a result of the Defendants' breach of contract, the Plaintiff has suffered
damages in the amount of $9870.33.
WHEREFORE, Plaintiff respectfully requests this Honorable Court to enter an Order as
follows:
a. Granting judgment for the Plaintiff and against Defendants in the amount of
$9870.33;
b. Granting Plaintiff its costs incurred in connection with this action;
c. Granting attorney fees in the amount of $3290.11;
d. Granting Plaintiff interest and,
e. Granting such other relief as the Court deems equitable and just.
COUNT II -- UNJUST ENRICHMENT
12. Paragraphs 1 through 11 are incorporated herein by reference as though set
forth at length.
13. Count II -Unjust Enrichment is pled in the alternative to Count I.
14. From April 4, 2010, Defendants have been afforded the value of the Plaintiffs
material and have failed to make payment.
15. As a result, the Defendants have been unjustly enriched and received benefit.
16. Acceptance and retention of this benefit by the Defendants, under the
circumstances, is inequitable.
17. As a result of the Defendants' failure to pay Plaintiff, Defendants have been
unjustly enriched in the amount of $9870.33.
WHEREFORE, Plaintiff respectfully requests this Honorable Court to enter an Order as
follows:
a. Granting judgment for the Plaintiff and against Defendants in the amount of
$9870.33;
b. Granting Plaintiff its costs incurred in connection with this action;
c. Granting attomey fees in the amount of $3,290.11;
d. Granting Plaintiff interest and,
e. Granting such o#her relief as the Court deems equitable and just.
COUNT III -FRAUD
18. Paragraphs 1 through 17 hereof are incorporated herein by reference as though set
forth at length.
19. In order to induce the Plaintiff to produce materials and services for the Defendants,
the Defendants represented to the Plaintiff that they would pay for the materials
produced and services provided.
20. Plaintiff believes, and therefore avers, that such representation was
materially false, in that Defendants have not paid for the materials produced
and services provided.
21. Such material misrepresentation was made by Defendants with actual
knowledge of its falsity, or in reckless disregard of its truth or falsity, as to the
actual intent of Defendants with respect to their intent to pay for the materials
produced and services provided.
22. In just able reliance upon the material misrepresentation of Defendants,
Plaintiff produced materials for the Defendants.
23. The Plaintiff would not have agreed to produce the materials and services
if Plaintiff had been aware of the fact that Defendants would not pay.
24. As a result of the misrepresentations of Defendants and their failure to pay
for the materials produced as originally agreed, Plaintiff has been damaged in
the amount of $9870.33.
WHEREFORE, Plaintiff respectfully requests this Honorable Court to enter an Order as
follows:
a. Granting judgment for the Plaintiff and against Defendants in the amount of
$9870.33;
b. Granting Plaintiff its costs incurred in connection with this action;
c. Granting attomey fees in the amount of $3,290.11;
d. Granting Plaintiff interest and,
e. Granting such other relief as the Court deems equitable and just.

PLAINTIFF'S MOTION TO COMPEL DEFENDANTS TIM HAKE AND TIM HAKE
MECHANICALS TO ANSWER INTERROGATORIES IN AID OF EXECUTION
AND NOW comes, Plaintiff, Thomas Somerville Company, by and through its
Counsel, Brian K. Zellner, Esquire of Hynum Law and avers the following:
1. On or about January 6, 2011 Plaintiff entered judgment against the
Defendants.
2. On or about January 14, 2011, Plaintiff addressed Interrogatories to the
Defendants in Aid of Execution.
3. Plaintiff's Counsel had requested that the Defendants provide Answers to its
interrogatories by letter dated January 14, 2011.
4. In an attempt to resolve this discovery dispute, Plaintiff's Counsel sent letters
to the Defendants asking that they provide answers to the Interrogatories.
5. To date, Plaintiff has not received Answers from Defendants to its
Interrogatories sent on or about January 14, 2011.
6. Plaintiff respectfully requests your Honorable Court to compel Defendants to
Answer the Interrogatories.
WHEREFORE, Plaintiff respectfully requests this Court to grant Plaintiffs Motion
to Compel Defendants to Answer the Interrogatories in Aid of Execution.
