The Plaintiff is the New Cumberland Federal Credit Union with a principal place of business located at 345 Lewisberry Road, New Cumberland, York County, Pennsylvania 17070. Plaintiff is a federally chartered nonprofit credit union. 2. The Defendant Xuan T. Nguyen, Jr. is an adult individual residing at 16 Mallard Court, Mechanicsburg, PA 17055. 3. The Defendant is not a current member of the Armed Forces. COUNT I: NCFCU CAR LOAN 4. On June 3, 2008 Defendant executed a Loan Agreement attached as Exhibit "A" in the amount of Fifteen Thousand Three Hundred Fifty and 00/100 ($15,350.00) Dollars at 5.740% interest and pledged as collateral a 2003 Ford F150 (VIN 2FTRX18L23CA97982). Defendant was the borrower under this Loan Agreement. 5. The terms of Exhibit "A" required timely payments of $296.26 monthly for 59 months and a final payment of $248.91 in the 60~' month. 6. Defendant failed to make timely payments and the car was repossessed and sold. 7. After applying the proceeds from the auction towards the vehicle loan there remains a principal balance due of $3,196.87 plus past due interest at 5.740% with a $0.50 per diem from November 15, 2010. 8. Defendant has made no regular payments despite repeated requests. 9. Pursuant to the Loan Agreement the Defendant agreed to pay all "court costs and reasonable attorney fees" incurred in any collection action. WHEREFORE, Plaintiff respectfully requests entry of judgment in the amount of $3,188.35 (principal plus past interest) at 5.740% interest from November 15, 2010 and a per diem of $0.50 together with all court costs and an award of reasonable attorneys' fees. COUNT II: NCFCU LOAN 10. On June 3, 2008 Defendant executed a Loan Agreement attached as Exhibit "B" in the amount of Four Thousand Eight Hundred Sixteen and 38/100 ($4,816.38) Dollars at 11.400% interest. Defendant was the borrower under this Loan Agreement. 11. The terms of Exhibit "B" required timely payments of $159.65 monthly for 35 months and a final payment of $144.63 in the 36th month. 12. There remains a principal balance due of $1,375.76 plus past due interest at 11.400% with a $0.43 per diem from November 15, 2010. 13. Defendant has made no regular payments despite repeated requests. 14. Pursuant to the Loan Agreement the Defendant agreed to pay all "court costs and reasonable attorney fees' incurred in any collection action. WHEREFORE, Plaintiff respectfully requests entry of judgment in the amount of $1,375.76 (principal plus past interest) at 11.400% interest from November 15, 2010 and a per diem of $0.43 together with all court costs and an award of reasonable attorneys' fees. COUNT III: NCFCU CREDIT CARD 15. On November 9, 2007 Defendant Xuan T. Nguyen, Jr., executed a Credit Card Application attached as Exhibit "C" with a credit limit of Five Thousand and 00/100 ($5,000.00) Dollars. 16. Defendant failed to make timely payments. 17. Their remains a principal balance due of $5,295.57 plus past due interest at 12.900% with a $1.87 per diem from November 15, 2010. 18. Defendant has made no regular payments despite repeated requests. 19. Pursuant to the Loan Agreement the Defendant agreed to pay all "court costs and reasonable attorney fees' incurred in any collection action. WHEREFORE, Plaintiff respectfully requests entry of judgment in the amount of $5,295.57 (principal plus past interest) at 12.900% interest from November 15, 2010 and a per diem of $1.87 together with all court costs and an award of reasonable attorneys' fees. All references to "you," or "your" mean each person who signs this Agreement as a borrower. 1.
