I §§10 (STATING IN PERTIN- ENT PART...NOR SHALL ~RI~ATB ~RO~SRT~ FIRST MARE, or secured) 4 B) Fourteenth Amendment U.S. Const. (STATING IN PER- TINENT PART...NOR SHALL ANY STATE DEPRIVE ANY PERSON OF LIFE, LIBERTY, OR PROPERTY WITHOUT DUE PROCESS OF LAW, NOR DENY TO ANY PERSON... THE EQUAL PROTECTION OF THE LAW). 1. On October 3, 2007. Petitioner was given a "CRITERIA GUIDED" transfer from SCI•GRATERFORD to SCI•CAMP HILL Special Management Unit program for exercising a constitionjally protected right (GRIEVANCES, AND LAW SUIT) sanction by DAVID Di6uglielmo. Upon arrival at SCI•CAMP HILLS (S.M.U.) program. Co. Martz, initial- ly, after seeing PETITIONERS property...sheiks of "DOWNSIZING" was his introuction. Petitioner, was then remove from the van into the waiting custody of Lt. Kreider, Sgt. Berry Jones, Co. Adam Huber, Co. Bridwell, Co. Hartman, Co. Brant;. etc. Co. Martz, would, then come back after wheeling Petitioner property inside E•BLOCR building to lead monotones of: "LAW SUIT": LAW SUIT"! "JACKSON IS FILING A LAW SUIT"!, and each of the above named defend ants would "GRIM" in, as Petitioner would walk in shackles (ON ANKLES), and bounded with waist belt, and cuffs on jwrist from the van to the inside of E•BLOCR (SMU) building, directly to it's "STRIP CAGE", after a brief oncamera interview by "LIEUTENANT RREIDER). Petitioner, would be given a jumpsuit, and no under- wears, socks, ar T•SHIRT, SHEARERS, and escorted to ED2.019 cell. Petitioner, would remain in this simi•naketness fate of being until after shift change (2pm to lOpm shift). The condition of the cell (ED2.019) was unsanitary. It had not been clean out, nor the toilet had been flush. Feces was still in it. The cell 5 floor had a pool of what smelt of URINE in the middle of the flo- or, that had be freshly put there, and the stench of URINE was obvious_ This, psychologically affect of Petitioners, as Petitioner could not sleep with security light blinking on, and off. Petition- er,. suffers insomnia, and nerve damage todate. 2. On October 12, 2007. Petitioner was taken to the pro- perty room by Co. Adam Huber, and Co. Martz to inventory jproperty for the first time since initial inceptionl. Tese tw(2}o SMU OF- FICIALS in conspiracy, and retaliated harassment maliciously, sadistically, and objectively with a culpable state of mind sorted.. through Petitioners property with a bias intent to cause harm knowingly by confiscating, and destroying personal, and legal itemsjmaterials without receipt, and outside Petitioner presents without permission from Petitioner, nor commission officer. Co. Adam Huber, and Co. Martz sort through Petitioners property in an egregious manner, refuse to allow Petitioner to send confiscat- ed items home, that was schedule to be destroy. Petitioner was handed a confiscation sheet (DC•154A) with the items that was schedule to be destroy, that Petitioner wasn't allow to send home absent the items that was already destroy, and/or missing without a receipt. This confiscation slip was pre•sign by Co. Martz. These "OFFICIALS" refer to Petitioner as a "DICKHEAD" for refusing jto sign the confiscation slip (DC•154A). Co. Adam Huber, would re- fuse to turn Petitioners T.Y., and RADIO on to make sure it work instead they made a verbral claim after being ask by Petitioner... that it works. Petitioner, was threaten, that if Petitioner didn't 6 sign the confiscation slip the rest of Petitioner's property would be destroy, and there was nothing Petitioner could do about it. The "INMATE PERSONAL PROPERTY INVENTORY (DC•153) SHEET" differ greatly from October 2, 2007 at SCI•GRATERFORD, before transfer and the October 12, 2007 "PROPERTY" receipt at CI•CAMP HILL. The March 6, 2009 "PROPERTY" receipt at SCI•CAMP HILL, that Co. A. Huber, Co. II B. Jones, Co. Martz, and COHORTS, that was prepare for transfer back to SCI-GRATERFORD. Several items was missing, and are still missing todate, despite filing an institutional grievance form (DC•804, OCTOBER OF 2007) on this subject, that was arbitrarily decided by superintendent Donald Kelchner, who also would arbitrarily decided against Petitioner concerning legal mail (See Griev.#204?61;AND #205138) from the U.S. DEPARTMENT OF JUSTICE was not privilege correspondnce. Petitioner would grieve the destruction of property in accordance with Department Of Cor- ections policy, and all appeals were arbitrarily AFFIRM, despite proof to the contrary. 3. Grievances on "PROPERTY INTEREST" has a third(30)y days window to ship, or destroy. Co. A. Huber, and Co. Martz know- ingly would d irectfcoerce Petitioner into filing a grievance on schedule to be destroy property in full knowledge, that the grievance system appeal process .last well over 30 days to complete, and property would be destroy before then. Psychologically affects of a sadistical propensity of "PRISON OFFICIALS", and their subor- dinates. 4. Cindy G. Watson (CHIEF GRIEVANCE OFFICE), would make several false claims on final appeal, that Petitioners appeals 7 (INITIAL) was "UNREADABLE", but this was not the case for "GRIEV- ANCE OFFICERS", nor the case doing "SECOND LEVEL APPEAL",lthat was arbitrarily AFFIRM. Cindy G. Watson, would repeat this pattern with respects to "PRIVILEGE MAIL", and other obvious institutional violation in conspiracy with fellow employees, that would sanction Co. Adam Huber, and COCONSPIRATORS action in destroying items Petitioner paid for off of commissary, legal books, and literature. (See INMATE PERSONAL PROPERTY INVENTORY DC-153 FORM/OCTOBE$R 12, 2007). 5. Lieutenant Grunder of SCI-GRATERFORD made an equally false claim that out of the si(6)x packs of cigaretts, that was documented on the "INMATE PERSONAL PROPERTY INVENTORY DC•153 FORM" (September 5, 2006)_ On(1)e was open, and could not be transfer with Petitioner (OPEN PACKS OF CIGARETTES) to SCI•CAMP HILL, PA., and had to be put into the trash can, but Lieutenant Grunder doesn't provide Petitioner with a confiscation receipt for the destroyed property (See Griev.~205138). Arbitrarily AFFIRM "SECOND LEVEL APPEAL", and declare "UNREADABLE" by CindyG. Watson with a "BIAS" propensity towards "INMATES". None of Petitioners cigarett packs was open. They (SCI•GRATERFORD STOLE, TAEFT, AND DESTROY WITHOUT RECEIPT PETITIONER'S CIGARETT PACK). 6. On October 17, 2007. Petitioner receive a LEGAL COR- RESPONDANCE from the "U.S. DEPARTMENT OF JUSTICE/U.S. MARSHAL SERVICE COURTROOM 2110 (MARSHAL FORMS)". This legal package was deliver by Co. Bickert already open outside of Petitioner's pre- sent on the 2pm to lOpm shift. This, particular package came with 8 1 a self-address envelope. Petitioner would camplete this information. Place the competed information in a self•address envelope. Seal it close, and on October 18, 2007 gave this information (LEGAL PACKAGE SELF-ADDRESS ENVELOPE) to Co. Eger (WHO. WAS A Co.I AT THAT TIME, BUT NOW IS A Co. II). Sergeant Eger deliver this package to Lieutenant SIMMS in the bubble control, who in turn conspirer with Co. A. Huber, Co. Spiels, Chrisopher Chambers etc. to confis- Cate legal package. Co. Spiels was dispatched to ED2.019 cell with a confiscation slip for legal package i n continuous retali- ated harassment, and conspiracy as these SMU OFFICIALS was aware of Petitioners Civil Action claim at previous institution. 7. On October 21, 2007_ Petitioner was confronted by Co. Adam Huber, Lieutenant Simms, Chrisopher Chambers (UNIT MANAGER), and CCII Baker, concerning the confiscated legal package, that they claim was not "PRIVILEGE CORRESPONDANCE" from the U.S. Depart- ment Of Justice/U.S. Marshal Service. These SMU OFFICIALS wanted to open the envelope, and read it's contents, and place that content in a regular envelope to be assess the cost of mailling. Petitioner would refuse, and legal package would be confiscated anyway, and Petitioner would file Griev_#204761, Chrisopher Chambers, John A. Palakoviceh/Donald Relchner, andCindy G_ Watson (WHO WOULD DECLARE GRIEVANCE UNREADABLE WITH A BIAS PROPENSITY AGAINST PETITIONER, AND IN CONSPIRACY WITH FELLOW D.O.C. EMPLOYEES), that this parti- cular legal package was not "PRIVILEGE MAIL". Petitioner would lose tw(2)o key witnesses in Civil Action case partially do to this erroneous interferance by DOC PRISON OFFICIALS. 9 8. On January 20, 2009, after just being cell search fiv(5)e days prior. The Gam to 2pm shift SMU OFFICIALS was formed on the very day "PRESIDENT BARRACRA OBAMA" was schedule to make his inar- guration speech. This, clandestne agenda, couple with others was in direct opposition to the ethic intimadation, discrimination, racism etc_ by the same guards on the Gam to 2pm shift, that's been threatening, taunting, depriving, and poisoning SMU INMATES food trays, and other basic human needs, mail, and property in- tentionally with a culpable state of mind subjectively to cause harm objectively, malicious, and sadistically propensity that's beyond reproach. Now, the same SMU OFFICIALS on this day during cell searches with a bias propensity. Lieutenant Kuzur, Sergeant Maxwell, Co. Liddick, Co. Zeigler, Co. Brant, Co. Huber, Co_ Hart- man etc. All participated in this racially bias act to extract Petitioner from cell in a clandestine cell search, where inmaes were assaulted for submitting to a cell search, and not submitting to a cell search. Petitioner was O.C. MACE twice despite consenting cuff up. Lieutenant Kuzur would give the order, and Sergeant mad well would spray the "MACE". Pe titione.r, had walk to the cell door, when Lt. Ruzur open the "WICRET SLOT", and Sgt. Maxwell would spray Petitioner with O.C. MACE, then close the "WICKET SLOT" back. Petitioner, would stand at the door waiting to cuff up when Lieutenant Ruzur, and Sergeant Maxwell would repeat the first, order. Spraying Petitioner with O.C. MACE again, and clos- ing the wicket slot. Prior to this malicious, and sadistical act by SMU OFFICIALS. Petitioner expressed concerns to Lt. Kuzur of 10 ( ~ having_a Captain, and camera pres ent to review what was going on with cell search, as Petitioner had stated, that he was in fear of his life... Co. Brant, would speak for Lieutenant Ruzur and deny Petitioner this oportunity, then the events just describe earlier happend. Petitioner, would cuff up, and Sgt. Maxwell would put these cuffs on extrat tight_ (PETITIONER WEARS THESE MARKINGS TODATE}. Petitioner, was move from ED1.007 cell with out any force enterance, after cuffing up, and taken to EC2.020 cell, where Co. Brant grabbed- Petitioner right arm, and punch several punches into Petitioner's right rib cage causing pain while carrying Petitioner into EC2.020 cell Co. Brant, and Co. Adam Huber would knee Petitioner in the ~ead between the cell door... and once inside the Co. Brant, Co. Huber, Co. Hartman, Co. Liddick, Sgt. Maxwell, Co. Zeigler, and Lieutenant Ruzur would conspirers to slamming Petitioner down on a steel mental bed frame causing continuous pain in LEFT SHOULDER, AND BACK. These SMU OFFICIALS would pick Petitioner off of the steel mental bed frame carry Petitioner out of the cell to look at the nurse, who didi nothing. These officer would take Pet itioner back into the cell, and Co. Brant would knee Petitioner head against the open- ing of the door cutting Petitioner behind left ear drawning blood and pain. These SMU OFFICIALS would SLAM Petitioner back down on the steel mental bed frame as Petitioner put u p no resistance, and not once did any on(1}e of these guards have to tell Petitioner to stop, and they continue there racism against Petitioner as Sergeant Maxwell took the scissors, and began cutting Petitioner's clothes off. Co. Brant would punch Petitioner in the face leaving 11 swelling,. and he would hold his fist against Petitioner face delivering short punches. Co. Liddick said" "WE GOT YOU NOW NIG- GA" as they all laugh as, Co. A. Huber stretched Petitioner's legs over the edge of the bed frame and bang them down repeatly as to break'em Petitioner was numb with pain as each on(1)e of these SMU OFFICIALS would cut off over te(10)n pieces of Peti=~ tioner's DREADLOCKS laughing. Co. Hartman told the others to "TURN HIM OVER, AND LET'S SEE HIS JOHNSON", in which they did. Co. Zeig- ler and all the rest would comment about Petitioner's penis, and "NIGGA DREADLOCR'S". Those SMU OFFICIALS, would leave Petitioner in this hard cell for si(6)x days with nothing on, nothing to drink, no toiletries, and total nakedness. The Pa. Barbacci would not come althought Pa. Barbacci was aware. FIV(5)E inmates got cell extracted that day, and Pa. Barbacci did not show up in con- spiracy. Pa. Barbacci, and the medical department DELIBERATE IN- DIFFERENCE to serious medical needs. These SMU OFFICIALS WOULD CONTINUE TO SABOTAGE FOOD TRAYS, AND DEPRIVE PETITIONER OF FOOD TRAYS DAILY. Petitioner would often not eat as Sgt. Jones, Co. Adam Huber, Co. Banks, Co. Martz, Co. Liddick, Co. ZEIGLER, Co_ Brant etc. would spit, cough over open food tray being given to Petitioner, and the placing of fingers on the food prior to giving Petitioner a food tray. Co.II Maxwell would write a false report on the cell extraction, and SMU OFFICIALS would again deny PETITIONER any opportunity to despute the false charges, claiming Petitioner refuse to go to the misconduct hearing as they sign a waiver form, denying Petitioner any opportunity to due process. 9. On January 26, 2009. Co. Liddick, Co. Banks, Co. Sabol- ski, Co. Huber, Sgt. Berry Jones, Co. Martz, Lieutenant Proce, 12 etc. would amass at EC2.020 cell door to take Petitioner back to ED1.007 cell, after being given clothes that day which was nothing more than a jumpsuit on, and apair of sneakers, that was tw(2)o left shoes of different sizes, that was old and worn out, with no socks on. Petitioner was place back into assign cell, where this cell (ED1.007) had not been decontaminated from Janu- ary 20, 2009. Co. Adam 9uber, and CO-CONSPIRATORS would enter this cell for the first time, and "THEFT", "CONFISCATE", and "DEST- ROY" Petitioner's personal, and legal property eyewitnesses re- ~poreted Co. Adam Huber packaging trash bags of Petitioner's pro- perty, and took it around to the yard and sat it out to be pick up by the trash tuck. David Crews in ED1.001 cell, DC•0924, would give a "DECLARATION" to this property interest violation (See Crews DECL_ Exhibit P1). 10. On January 26, 2009. Petitioner would be written up for tw(2)o false re~iports, when being move from EC2.020 cell back to ED1.007 cell by Co. Martz, and Co. Banks, that was false claim- ing Petitioner refusing to give up the food tray, that they pick- up, that Petitioner never got when they pass them out (FOOD TRAYS) that this false report would put Petitioner back on a foodloaf, and the other misconduct tha was written was for a false claim of refusing to move, in which they claim (Co. BANKS), that all these guards claim they witness this false report. Petitioner was in cell with no clothes on, these guards didn't feed Petitioner a lunch tray, so how could Petitioner refuse to give up a tray that P etitioner never had, and these guards gave Petitioner a 13 jumpsuiton this day, so Petitioner had to come to the door to get the jumpsuit, after being in a cell "SI(6)X" days with not- king on. Co. Martz never put the tray in the food box for Lunch, and he never open up the food box to get a tray Petitioner never had. These SMU OFFICIALS would lie, and deny Petitioner access to the misconduct hearing again on false waivers, and continuous retaliation harassment, and conspiracy. Those SMD OFFICIALS BIAS• NESS towards Petitioner base on ethic, political belief, color of skin, religion, for exercising a constitutionally protected right etc. arbitrarily sanction to continuous isolated confine- ment time. 14 ~'-, EXHAUSTION OF LEGAL REME DIES: 1. petitioner use procedural process at SCI-CAMP HILL, and SCI•GRATERFORD in an attempt to resolve property interest violation. (GRIEVANCE SYSTEM-DC•804) 2. On October 12, 2007; January 24, 2008; June 12, 2008; June 16, 2008; October 2, 2008; December 31, 2008; January 9, 2009; January 16, 2009; January 31, 2009; March 9, 2009; and March 27, 2009. (Griev.#204761; #236071; #236569;-#245239; #255809; #256995; #257871; #266730 etc.). In presenting the material facts contained in this "PETITION FOR REVIEW" at each stage of the appeal process Petitioners grievance concerns, and procedural process protection was either arbitrarily deny, or ignore by superlatives in conspiracy with SMU subordinates. 3. On October 12, 2007, while at SCI-CAMP HILL. Petitioner would file griev.#205138 to SCI•GRATERFORD on missing and/or Best= roied pack of cigaretts. A Lieutenant Grunder would erroneously claim was open, and had to be desrroy prior to transfer, but pro- vided Petitioner with no proof of on(I)e pack of cigaretts out of si(6)x was open. Petitioner don't smoke, and receive no con- fiscation receipt for "DESTROIED" pack of cigarttes. U.S. Const. Amend. 5,14. From June 12, 2008 through January 16, 2009 (OCTOBER 12, 2007 through May Of 2008; and February Of 2009 through March 9, 2009 is not included). 15 4. Petitioner, had file over forth(40)y grievances on the inhumane treatment by SMD OFFICIALS, that was all arbitrarily., and biasly in conspiracy AFFIRM by SCI•CAMP HILLS su perlatives, that lacks an appropriate remedy. I, PETITIONERS understand, tht the statements therein are made subject to the penalties of 28 USCA § 1746relating to unsworn falsification to authorites. FEDERAL LA4J. STATE LAW pursuant 18, Pa.
