between JEP~Y W. S~FARTZ, hereinafter referred to as Contractor,
JERRY W. SWARTZ, hereinafter referred to as Owner, whereby the
contractor undertook and agreed to erected and construct a dwelling
on the certain lot of ground situate in North Middleton Township,
C,,m~erland County, Commonwealth of Pennsylvania, and more fully
described in Exhibit "A" which is attached hereto and made a part
hereof known as Lot #59, 55 Longview, Carlisle and Lot #55 Sub, nit
View, Carlisle, North Micldleton Township, C,~mherland County, PA.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of {$1.00) Dollar to
Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their subcontractors, and all parties acting through or under
them, covenant and agree that no mechanic's liens or claims shall
be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under them,
hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said buildings
or any of them, and agree that this instrument, waiving the right
of lien, shall be an independent covenant.

LOT #59: All that certain lot, plot or tract of laud in accordance with a plan of North Ridge Phase 4
as prepared by Hartman and Associates, located in North Middleton Township, Cumberland
County, Pennsylvania, more particularly bounded and described as follows, to wit:
Beginning at a point on the northern right-of-way line of Long View, said point being located North
eighty-eight degrees, eleven minutes, forty-nine seconds East (N 88° 11' 49" E), a distance of two
hundred sixty-three and seventy-six hundredth feet (263.76') from the terminus ora curve connecting
said right-of-way line with the eastern right-of-way line of West View, thence from said point of
Beginning, by Lot No. 58 and beyond North one degrees, forty-eight minutes, eleven seconds West (N
01° 48' 11" W), a distance of two hundred fifty-seven and two hundredth feet (257.02') (erroneously
omitted from said plan) to a point; thence by Lot No. 60 South forty-three degrees, eleven minutes,
forty-nine seconds East (S 43° 11' 49" E), a distance of two hundred forty-two and three hundredth
feet (242.0Y) to a point on the northern right-of-way line of Long View; thence by said right-of-line
the following three (3) courSes 1) South forty-six degrees, forty-eight minutes, eleven seconds West (S
46° 48' 11" W), a distance of forty-seven and ninety-nine hundredth feet (47.99') to a point; 2) by a
curve to the right, having a radius of one hundred seventy-five feet (R= 175.00'), an arc distance of
one hundred twenty-six and forty-three hundredth feet (A/L = 126.4Y) to a point; 3) South eighty-
eight degrees, eleven minutes, forty-nine seconds West (S 88° 1 I' 49" W), a distance of eight and

Associates as recorded in the Office of the Recorder of Deeds of and for Cumberland County in Plan

LOT #55: ALL THAT CERTAIN plat, tract, parcel or lot of land located in North Middleton
Township, Cumberland Courtly, Pennsylvania bounded and described as follows, to wit:
BEGINNING at a point on the northeastern side of Summit View (50.00 feet wide) at the southern
corner of Lot No: 56 on the hereinafter mentioned plan of Lots; thence along Lot No. 56, North 53
degrees 13 minutes 24 seconds East, 129.36 feet to a point at lot No. 64, North Ridge Phase I, being
lands now or late of Dennis and Judy Kochert recorded in Deed Book 196, Page 825; thence by the
same, South 37 degrees 11 minutes 53 seconds East, 91.25 feet to a concrete monument; thence by
Lot No. 54, South 57 degrees 20 minutes 47 seconds West, 131.48 feet to a point on Summit View;
thence by Summit View the following two courSes and distances: (I) by a curve extending to the left
in a northwestwardly direction and having a radius of 425.00 feet, an arc distance of 30.58 feet to a
point; (2) North 36 degrees 46 minutes 36 seconds West, 51.24 feet to a point, the place of
BEGINNING.
