AGRIE]EMENT TO INDEMNIFY, ~, AND
THIS AGREEMENT, by and among Amy J Nichols, Executrix of the
Nichols, Deceased and Amy J Nichols, Robert F. Nichols, Jr., and Timothy J.
WHEREAS, James F. Nichols died July 29, 2009, a resident of
Pennsylvania; and
WHEREAS, James F. Nichols died intestate, the sole surviving
Nichols, Robert F. Nichols, Jr., and Timothy J. Nichols; and
WHEREAS, The OiEce of the Register of Wills of Cumberland County
Administration to Amy J Nichols on November 2, 2009; and
WHEREAS, said Executrix has duly administered the estate according
Commonwealth of Pennsylvania; and
WHEREAS, Amy J Nichols, Robert F. Nichols, Jr., and Timothy J.
furnished with a complete listing of the estate assets, receipts and disburses
WHEREAS, it is the desire of the parties to this Agreement that final
estate be accomplished without a formal accounting to the Orphans' Court D
of Common Pleas of Cumberland County, it being the desire of the parties to
delay and publicity of a formal accounting.
NOW, THEREFORE, in consideration of the mutual promises,
recited herein, the parties do agree as follows:
1. Amy J Nichols, Robert F. Nichols, Jr., and Timothy J. Nichols do hereby r
discharge Amy J Nichols, Executrix, from any and ail liability which she b
which may from time to time arise in connection with her service as Execs;
of James F. Nichols, Deceased, and hereby authorize and request the Orph
Division to charge the same against his share of said estate, and in conside
distribution, hereby agree to refund any amounts so distributed which may
fully discharge any tax liability of the estate, debts of the decedent, or adm
expenses.
2. Each parry to this Agreement acknowledges that this Agreement shall be i
recorded in the estate proceedings and that the terms hereof shall be binds
respective heirs, successors, executrixes, administrators and assigns.
