For dates of death on or after July 1, 1994 and before Jan. 1, 1995, the tax rate imposed on the net value of transfers to or for the use of the surviving
spouse is 3 percent [72 P.S. §9116 (a) (1.1) (i)].
For dates of death on or after January 1, 1995, the tax rate imposed on the net value of transfers to or for the use of the surviving spouse is 0 percent
[72 P.S. §9116 (a) (1.1) (ii)]. The statute does not exempt a transfer to a surviving spouse from tax, and the statutory requirements for disclosure of
assets and filing a tax return are still applicable even if the surviving spouse is the only beneficiary.
For dates of death on or after July 1, 2000:
• The tax rate imposed on the net value of transfers from a deceased child 21 years of age or younger at death to or for the use of a natural parent, an
adoptive parent, or a stepparent of the child is 0 percent [72 P.S. §9116 (a) (1.2)].
. The tax rate imposed on the net value of transfers to or for the use of the decedent's lineal beneficiaries is 4.5 percent, except as noted in
72 P.S. §9116 1.2) [72 P.S. §9116 (a) (1)].
. The tax rate imposed on the net value of transfers to or for the use of the decedent's siblings is 12 percent [72 P.S. §9116 (a) (1.3)]. A
sibling is defined under Section 9102, as an individual who has at least one parent in common with the decedent, whether try blood or adoption.

SETTLEMENT ESCROW AGREEMENT

SETTLEMENT AGENT ("COMPANY"):
Duncan & Hartman
The undersigned parties have requested that the Company hold in escrow the sum of $1,350.00 (the "funds")
from the proceeds of the settlement of the property described in the above order number. These funds are to be
retained without interest by the Company on the following teams and conditions:
Payment of Inheritance Taxes on the Estate of Nelson L Minich, deceased
The funds are to be paid to Register of Wills of Cumberland County, PA upon satisfaction of the ;above
terms and conditions and after receipt by the Company of written confirmation from all parties hereto.
In the event costs or expenses, including attorneys fees, are incurred by Company because of litigation or
otherwise, arising out of the holding of the funds, the Company shall be entitled to reimburse itself out of the
funds for any such costs and expenses, inclusive of attorneys fees. If the Company is unable for any reason to
reimburse itself out of the funds, the undersigned parties do hereby jointly and severally agree to indemnify the
Company for any and all costs and expenses, including attorneys fees, that the Company may sustain arising out
of any acts taken by the Company in good faith pursuant to this Agreement.
It is understood and agreed that the event of a dispute, the Company, may in its absolute discretion pa.y the
funds into Court and allow the Court to determine the proper disposition of the funds or continue to hold the funds
pending receipt by Company of uniform written direction from all parties hereto.
The Company, acting as escrow agent, shall not be liable for any error of judgment or for any act taken or
omitted to be taken in good faith or in reliance on any written notice, certificate or other documents believed by it
in good faith to be genuine and to be signed or submitted by an authorized signatory, absent the gross neglil;ence
or willful misconduct of Company.
A charge of $25.00 for the first six months shall be made for funds held in escrow by the Company; and a
minimum charge of $25.00 shall be made for every year beyond the initial six month period in which the iEunds
are held.
In consideration of the completion of settlement, the undersigned do consent and agree to the terms and
conditions hereof.

ESCROW AGREEMENT
THIS AGREEMENT, made and entered into this 14th day of October, 201.0, by and
between, Pa Real Estate Settlement Services LLC, hereinafter known as Escrow Agent, and
the Estate of Nelson L. Minich, hereinafter also known as ESTATE.
WHEREAS, at the time of settlement of the premises designated as 2092 Newville Road,
Plainfield, PA 17081, the state and federal inheritance taxes have not been paid and accepted by
the approporaite govement agencies relinquishing a lien on the said real property. As a condition
of settlement, ESTATE has placed in escrow with ESCROW AGENT the amount of Fourteen
Thousand Five Hundred and 00/100 ($14,500.00) Dollars for the purpose of completion of
inheritance tax return within 60 days of the date of this agreement. Payment of any taxes due will
be disbursed from escrowed funds. Said escrow funds shall be returned to ESTATE upon
confirmation that the state and, if applicable, the federal inheritance tax have been paid and
accepted by the appropriate agencies. Should the inheritance tax become delinquent, in the sole
opinion of the ESCROW AGENT, the ESCROW AGENT shall have the right to release the
escrow funds to the appropriate state and federal agencies including but not limited to the
Pennsylvania Department of Revenue in order to secure the release of any potential lien against
the said property. ESTATE indemnify ESCROW AGENT for the payment of any accrued
Pennsylvania Inheritance and/or Federal Estate taxes as well as any claim on behalf of the
Department of Public Welfare attributable to the Estate of Nelson L. Minich.
This Escrow Agreement represents the entire agreement between the parties, and may not
be modified or altered except by a subsequent written agreement executed by and between the
parties hereto. The parties hereby agree that the terms and conditions of this Agreement shall
bind and inure to the benefit of their heirs, executors, administrators, successors and assigns.
This Agreement shall be interpreted and construed under the laws of the Commonwealth of
Pennsylvania.
IN WITNESS WHEREOF, and intending to be legally bound, the parties hereto have
hereunto set their hands and seals as of the day and year first above written.

declare this to be my last will and revoke any will previously made by me.
ITEM I. I direct that all my just debts and funeral expenses, including my gravemarker

nder that Premarital Agreement. I also provide her all my household goods with th.e exception
of the following items that should go to the following named. individuals:
A. Baby crib should be given to Patricia Minich.
B. My five guns should be given to Charles N. Minich, Jr., Scott A.
Rhoades, Edward Feuchtenberger, William Feuchtenberger and Chris Bottoms.
My Executrix shall have the sole determination as to which guns should be
provided to those individuals.
C. Antique chest should be given to Patricia Minich.

D. Grandfather's clock should be given to Kimberly- L. Rhoades.
+ ITEM IV. I give to my granddaughter KIMBERLY L. RhOADES a portion of the real

estate that I own on North Middleton Road which his defined as Lot 1 under the Final
Subdivision Plan for Nelson L. Minich dated January 11, 2007 and recorded in Plan Book B,
~~ Page 108, of the Recorder of Deeds of Cumberland County, Pennsylvania.
,1 ITEM V. I give to my grandson MARSHALL M. MINICII, JR. the sum of Ten
l Thousand ($10,000.00) Dollars. I am making conscious and purposeful decision to leave
Marshall M. Minich, Jr., the amount listed in this specific bequest and am not treating him the
same as my other grandchildren. The decision was made by me alone without outside influence.
